1. Accept the work.
2. Authorize the City Clerk to file a Notice of Completion.

3. Authorize the City Clerk to release the bonds 35 days after
Notice of Completion has been filed.

The contract for`the widening of Pacific Coast Highway at Jamboree Road
has been completed to the satisfaction of the Public Works Department.
The bid price was: $18,500.50
Amount of unit price items constructed: $19,105.46
Amount of change orders: None
Total Contract cost: $19,105.46
Amount budgeted in Account #19- 3386 -052:
and #25- 3386 -052 $23,500.00
One half of the cost will be paid by the State Division of Highways.
The City's share will be paid from Gas Tax funds.
The contractor is Patco Construction of Corona del Mar, California.
The contract date of completion was June 16, 1970. Work was completed
on April 20, 1970.

RECOMMENDATIONS:
1. Approve the plans and specifications..
2. Authorize the City Clerk to advertise for bids to be opened
at 10:00 A.M., February 17, 1970.

This project will provide for the widening of Pacific Coast Highway to allow
for the installation of two left turning lanes from the Coast Highway onto Jamboree Road
northbound: This improvement will result in a shorter stopping time for the through
traffic on the Coast Highway and still permit a large left turning movement onto Jamboree
Road.
The estimated contract cost is $19,500.00. The project will be funded one -half
by City Gas Tax.Funds and one -half by the State Division of Highways. The plans were
prepared by Williamson and Schmid Engineers of Santa Ana. The estimated date of com-
pletion is June 1, 1970.

(1) To modify the traffic control signal system,
safety lighting and channelization and construct the
roadwork hersinbefore mentioned, through construction by
contract with construction contractor licensed by the State
of California, said contract to be carried out in accordance
with laws governing CITY with reference to the character
of the work to be done thereunder, and to be completed in
conformity with plans and specifications of CITY or >TATL,
and to the satisfaction of and subject to the approval of STATE.

(2) To bear CITY',: share (2/4) of design
engineering coats, construction en,7inecrinn costs, and
construction costs required to complete the work referred
to herein, such share to be a sum bearing the same
proportion to the total cost of work referred: to herein
as the number of leas of highways under jurisdiction of
CITY at the intersection involved hears to the total
number of legs of highways at such intersection.
(s) To reimburse STATE for CITY'S proportionate
share of the cost of maintenance and operation of said
traffic control signal system and safety liahtina, such
share to be determined in the manner provided in that
Agreement for maintenance of State highways within the
CITY which is in effect at the time said costs are
incurred, or if no such agreement exists, such share to
be a sum bearing the same proportion to the total cost of
maintenance and operation of said traffic control signal
system and safety lighting as the number of legs of highways
under jurisdiction of the CITY bears to the total number of
legs of highways at such intersection.

SECTION II
STATE AGRELS;
(1) To nay to'CITY, promptly upon renuition
of a statement therefore; STAR& -a ahare (2/4) of the design
engineering costs, construction~ engineering costa, and
construction coats required to complete the work referred
to herein, such share to be a sum bearing the sale
proportion to the total cost of work referred to herein
as the number of legs of highways under jurisdiction of
STATE at the intersection involved bears to the total
number of legs of highways at such intersection.
It is estimates: that STATE'S share is $13,000.
The actual amount of STIM" S share will be determined after
the work is completed, but in no event shall STATE'f' share
exceed $13,000 unless otherwise provided in a subsequent
agreement between CITY and State.
(2) To maintain and operate the entire traffic
control signal system and safety lighting as installed.
SECTION III
It is mutually understood and agreed;
(1) That design engineering costs, including all
overhead charges attributed to design engineering, are to

be 22 percent of construction costs of the work referred
to herein.
(2) That obligations of SATE under terms of this
Agreement are .subject to the allocation of f by the
California Jiqhway Commission.
(3; ^iiat neither STATL nor any officer or c^-ployee
thereof shall be responsible for any damage or liability
occurring by reason of anything done or onmittoo to be done
by CITY under or in connection with any wot%k, authority or
jurisdiction delegateC to CI_Y under this .-iroement. It is
also understood and agreed that, nursuant to Government
Code Section 895.4 CITY shall fully ind;e *,nify ancz hold State
harmless fro-, any liability i pose(?. for injury (as defined
by Government Code Section *010.8) occurring by reason of
anything, done or omitted to be done by CTLX under or in

thereof, is responsible for any damage or liability occurring
by reason of anything done or omitted to be done by STAT =3
under or in connection with any work, authority or jurisdiction
not delegated to CITY under this Agreement. It is also
understood and agreed that, pursuant to Government -Code
Section 895.4, STATL shall fully indemnify and hold CITY

harmless from any liability ia;posed for injury (as defined
by Government Code Section 810.6) occurring by reason of
anything done or omitted to be done by S':AZ3 under or in
connection with any work, authority or jurisdiction not
delegated to CITY under this agree: ^.lent.
(5) That, should any portion of the project be
financed with Federal Funds or State Gas `?ax Funds all
applicable procedures and policies relating; to the use of
such funds shall apply notwithstanding other provisions of
this agreement.

this Agreement to be executed by their respective officers,
duly authorized, the provisions of which Agreement are
effective as of the day, month and year first hereinabove
written.

SUBJECT: COOPERATIVE FINANCING AGREEMENT FOR THE WIDENING OF PACIFIC COAST HIGHWAY
AT JAMBOREE ROAD
RECOMMENDATION:
Adopt a resolution authorizing the Mayor and the City Clerk to execute
the subject agreement with the State of California.
DISCUSSION:
This project was rebudgeted from FY1968 -69 to FY1969 -70 in an effort to secure
State participation in the project.
The State has studied the project and has classified it as a safety improvement
to Pacific Coast Highway.
The subject cooperative financing agreement provides for the State to pay for
one -half of the design engineering costs, construction costs,and construction engineering
costs; up to a maximum of $13.000. The preliminary cost estimate for the construction of
the project is $20,000. The City's portion of construction costs will come from Gas Tax
Funds. Ten thousand six hundred dollars has been included in the 1969 -70 proposed
Capital Improvement Projects for the City's share of thg work.
