Traffic Signal Maintenance Agreement
Enclosed is executed original and one copy of agreement between the
City of Costs Most and City of Newport Beach to share the cost of
maintenance of a traffic control signal at the intersection of West -
cliff Drive -17th Street aad Irvine Avenue for transmittal to Costa
Mesa traffic engineer.
Said agreement was authorised by the City Council at its regular Meeting
held March.27. 1967 by the adoption of Resolution No. 6540. copy of
which is attached for your files.

Subject: Agreement with Costa Mesa to share the costs of
maintenance of a traffic control signal
Transmitted are the original and three copies of a proposed
agreement with the City of Costa Mesa providing that the
energy costs, luminaire costs and maintenance costs of the
traffic signal at the intersection of Westcliff Drive -
Seventeenth Street and Irvine Avenue shall be shared equally
by the cities commencing with the fiscal year 1965 -66.
The attached resolution, if adopted by the City Council, will
approve said agreement and authorize its execution on behalf
of the City.
The Traffic Engineer requested preparation of the resolution
for consideration by the Council at their meeting on March 27,
1967.

AGREEMENT
THIS AGREEMENT, made and entered into this 19th day of
September, 1966, by and between the CITY OF COSTA MESA, a Munici-
pal Corporation, hereinafter called COSTA MESA, and the CITY OF
NEWPORT BEACH,
W I T N E S S E T H t
VMEREAS, there is an electric traffic control signal at the
intersection of Westcliff Drive - Seventeenth Street and Irvine
101 Avenue, being on the border of both said Cities, and
WHEREAS, said signal was installed jointly by COSTA MESA
and NEWPORT BEACH, said signal, serving traffic from both Cities,

RECOMMENDATION:
THAT THE CITY PAY 50 PERCENT OF THE COST FOR OPERATION OF THE TRAFFIC
SIGNAL AT IRVINE AVENUE AND WESTCLIFF DRIVE FOR FISCAL YEARS 1960 -61
THROUGH 1964 -65.
DISCUSSION:
THE TRAFFIC SIGNAL AT IRVINE AND WESTCLIFF WAS INSTALLED BY COSTA MESA IN
1959 WITH THE CITIES OF NEWPORT BEACH AND COSTA MESA SHARING EQUALLY IN THE CON-
STRUCTION COSTS.
THERE APPEARS TO HAVE BEEN A VERBAL AGREEMENT BY BOTH CITIES AT THE TIME
OF CONSTRUCTION TO SHARE IN THE COST OF MAINTENANCE AND OPERATION. HOWEVER.. THE
CITY OF NEWPORT BEACH HAS NEVER RECEIVED AN INVOICE FOR ITS SHARE OF COSTS FOR
MAINTENANCES ELECTRICAL ENERGYy AND LUMINAIRE CHARGES.
A DETAILED TABULATION OF EXPENDITURES FOR ENERGY AND LUMINAIRE CHARGES SINCE
THE DATE OF INSTALLATION AMOUNTS TO A TOTAL COST OF $24,200.45. THIS SUM DOES NOT
INCLUDE MAINTENANCE COSTS BECAUSE THE COSTA MESA ACCOUNTING RECORDS DID NOT DETAIL
THEM SEPARATELY FOR THIS SIGNAL.
THE ATTACHED COPY OF A LETTER FROM COSTA MESA DEFINES THESE CCSTS MORE FULLY
AND INCLUDES A REQUEST FOR PAYMENT OF ONE —HALF THE AMOUNTO OR $19100.00. INASMUCH AS
THE INTERSECTION IS DIVIDED EQUALLY9 WITH TWO LEGS APPROACHING FROM EACH CITY9 THIS
50 -50 FORMULA 15 EQUITABLE.
THE APPROVED BUDGET FOR FISCAL YEAR 66 -67 HAS APPROPRIATED $216.030 TO PAY
FOR THE CITY OF NEWPORT BEACH'S SHARE OF THE ENERGY AND LUMINAIRE CHARGES FOR THE
CURRENT YEAR.
IN THE EVENT THAT THE RECOMMENDATION 13 APPROVED9 A BUDGET AMENDMENT HAS
BEEN SUBMITTED FOR CONSIDERATION BY THE COUNCIL.

Dear Bob:
At 17th and Irvine Avenue the traffic signal is partly in Costa Mesa and
partly in Newport Beach. This signal was constructed in the latter part
of 1959 with Newport Beach and Costa Mesa sharing equally in the construc-
tion cost.
At that time there was an oral agreement between the City Managers that
Newport Beach would pay their share of the maintenance and energy costs.
For some reason Newport Beach has not been billed for maintenance, energy
and luminaire charges and therefore has not paid its share of these costs
since the installation.
The energy and luminaire costs to operate the intersection by fiscal year
are detailed below. Maintenance costs have been deleted since no accurate
records are available to fiscal year 1965 -66. Fiscal year 1965 -66 has been
deleted from this since we will bill you separately at a later date for
maintenance, energy and luminaire costs.
