On June 21, 1968 we commenced shipment to the subject project of a quantity of J.-,ins-
Manville 'ITRANSITEI' Water Pipe billed to Dale Casada Construction
Company having a value of 2,-934.32 as partial shipment of an
order with total approximate value of $3,000.00 our invoice number YK -12415
The materials supplied are subject to our regular terms of Net 30 Days, therefore, V.i;ment .
is not as yet due. This notice is furnished in the routine transaction of business to com-
ply with the requirements of notice to the owner, lending institution and general contraot,or
in relation to shipments of material to works of improvement in the State of California.
This notice, however, is not intended to reflect in any way on the integrity or credit
standing of our customer, but is given in compliance with the provisions of the California
Code of Civil Procedure (Sections 1190.1 and 1193) and California Government Code (Section
4210) as relating to works of improvement, to assure qualification and validity of our
rights of filing Mechanics' Liens, provision of Notice of Withhold on private construction
and our right to file Stop Notice with the public agency concerned on public work. Should
materials furnished on subject project not be paid for, liens will be filed.
We have appreciated the opportunity of furnishing Johns - Manville materials for this project,

Reference is made to the extension of the major storm drain at the
23rd Street intersection. The plans called for the reinforcing bars
in the existing headwall to be exposed 24 inches and incorporated into
the new work.
During construction it was found that the existing bars on the southerly
side were too short. G. L. Keller, your sub- contractor was instructed
to weld extensions onto every other existing bar, the work to be performed
on a force account basis.
Please invoice us for the cost of the welding. Change Order 5 will be
issued to cover the extra cost.

Gentlemen:
During the design of the subject project it was realized that an
additional catch basin would be needed in the future on the northerly
side of 22nd Street westerly of Irvine Avenue, however no provision
was made for this construction.
Under the present contract, the inlet proposed for this location
was an Orange County Standard #307. Due to the sloping bottom and
shallow upstream end, the future connector pipe and new inlet would
be difficult to construct. By Change Order Number 1, this inlet was
replaced by an L.A.C.F.C.D. #2 -0 -163 catch basin. This type has a
relatively flat bottom and has the full depth at the upstream end.
A block -out, filled with brick and mortar, will be left in the
upstream wall to accommodate the future connector pipe.
It is requested that you approve Change Order Number 1 and
return two signed copies.

PROBLEM: What to do with the partially placed RCB bottom slab at Sta.
25 +00 ±(Irvine Avenue)? The slab, on a 1:1 slope, was placed
July 5, 1968 and partially removed because the concrete couldn't
be vibrated to assure proper compaction and coverage of steel.
DISCUSSION:
Two alternatives exist.
1. Remove the partially placed slab and reconstruct per plans.
2. Clean exposed curtain of steel, cut the partially covered
vertical steel at the concrete and construct a thickened
slab per drawing No. C- 1112 -1
B. W. Williamson and the City preferred the first alternate but
agreed to accept alternate 2 if it would be done at no additional
cost to the City. An advantage of not removing the partially placed
slab is that the slab has stopped the ground water seepage.
The City and B. W. Williamson suggested that the existing headwall
be braced to keep it from falling and injuring someone.

Forming of the R. C. B. was discussed. It was noted the forms on
the cutoff wall had bulged. In this one instance, the contractor
will not be required to correct this deficiency. Any further
bulges or deviations from the lines on the plans will have to be
corrected. Adequate forms will be required for the walls and
deck. The walls must be of uniform thickness, straight and
plumb. Carl Kellar assured the City that adequate plywood forms
would be used. It was suggested that the walls and deck be
formed together for additional lateral support.

Re: Our Job No. 67 -27
Reference is made to our agreement for engineering services
to prepare plans and specifications for Irvine Tustin Avenue be-
tween 22nd Street and University Avenue.
The man -hours our firm has expended to date charged at the
rates contained in our agreement amounts to $23,653.00, which ex-
ceeds the agreed maximum of $17,500 by $6,153.00.
We respectfully request that we be compensated for extra work
in the amount of $6,153.00 caused by delays and changes which were
beyond our control.
Our proposal to the city contained a maximum figure of $19,000
which was reduced to $17,500 at your suggestion. A number of events
caused our costs to exceed our estimates which are listed below.
1. Our estimate of engineering costs was based on attack-
ing the job and completing the work within 90 days as
outlined in the agreement. We had the majority of the
work completed in July of 1967. You were unable to
furnish decisions on right -of -way, utilities, and
storm drain concerning the Irvine Company so the job
was filed. We had to complete the job during April
and May of 1968 which caused considerable extra re-
search and back - tracking to pick up all the loose
ends. We were also very busy with other work during
April and May of 1968.
2. A considerable portion of the extra work was caused
by a change in the materials report. The materials
report dated March 21, 1967 called for capping every-
thing but 2200 feet. We spent considerable time
carefully designing a V-2-inch cap for the existing
pavement to provide an acceptable riding surface.

The revised materials report dated June 23, 1967 re-
moved all but 150 feet of the capping. Good design
practice made it absolutely necessary to redesign
r all the profiles.
3. Removal of curb and gutter on the easterly side
` from Station 33 + 88 to University Avenue in April
,11 ' of 1967 changed part of the drainage system and k�u
.' caused considerable changes to the plans.
The low bid on the contract by Mark Construction amounted to
$284,542.98, which makes our engineering costs roughly 8.33% of the
construction costs including topo surveying'.
The American Society of Civil Engineer's Manuals and Reports
on Engineering Practice No. 45, labeled "A Guide for the Engage-
ment of Engineering Services ", indicates the median compensation
for basic services is 6.841Y. of construction costs on a job of
$300,000 in the not too difficult category. Basic services do not
include "special services" which include land surveys, boundaries,
monuments, and related office computations and drafting. Our
original estimate for the field work and related work amounted to
$6,890.00, which is 2.42% of the construction costs. The combined
basic and special services as recommended in the A.S.C.E, manual
would come to 9.26% of the construction costs.
We generally do not contract for work as a percentage of the
construction costs but try to prepare actual estimates of the work
involved. Our original proposal for the work involved was $19,000.
I feel we could have performed the work at this cost had the work
proceeded to completion in a normal manner, and had we not had the
change in the materials report.
We have also suffered increased costs due to Union contracts
and an overall increase in wages which went into effect in August
of 1967. Our standard fee schedule was revised in August of 1967
showing a considerable increase. A copy is included for your
reference.
We are now staking the construction for Mark Construction, and
will do all we can to keep the job running smoothly to your satis-
faction.

Contractor's representatives met Utility Representatives and discussed any
relocations which are necessary and what coordination would be required.
R. L. Knieper of C.M.S.D. stated that the contractor would be responsible for
obtaining a permit for sewer work and paying inspection fees. Carl Post
questioned having to pay fee and was shown section 7 -08 "Permits and Licenses"
of C.N.B. Standard Specifications. Permit can be obtained at Costa Mesa City
Hall. John Palen (ph. 646 -8915) will be the inspector.
Changes discussed which will be followed by Change Orders where necessary follow:
1. Delete catch basin item 25 on 22nd St., and replace it with item 19.
2. Add a water lateral at Sta.21 +40.
3. Use a reducer and the existing 6" value at Sta.40 +60±
The contractor was requested to submit a construction schedule and traffic control
diagram.
Dust control was mentioned. Contract documents were given to Carl Post.

Ten property owners have requested construction of curb, utter and /or
sidewalk adjacent to their property be included "in this contract. The cost of
these items will be paid by them. Three owners have deposited funds. The re-
mainder are expected to make deposits in the immediate future.
Plans and Specifications for the Irvine /Tustin Avenue portion of this
project were prepared by Williamson and Schmid, Civil Engineers of Santa Ana.
The 23rd Street portion was prepared by-the Public Works Department.
The estimated date of completion is 7 November, 1968.

Sum basis allows no flexibility and deviation for
unforeseen conditions.
7. Since the Technical Staff approved the project as
four lanes on sixty feet of right of way, an esti-
mate showing the break down of costs for AHFP,
City only and County only quantities will have to
be submitted for approval prior to granting an
authorization to advertise.

RECOMMENDATIONS:
1. Approve the Plans and Specifications.
2. Authorize the City Clerk to advertise for bids to be opened
at 10.00 A.M., dn�June 4, 1968.
3. Adopt a resolution cepting an easement for street and high-
way purposes exten ng Northerly -from 22nd Street to University
Drive.
4. Adopt a minute resolution authorizing the Mayor and the City
Clerk to execute a right -of -way certification for the subject
project.
5. Approve a partial waiver of Irvine Company improvement obli-
gations under the Capital Improvement Policy in exchange for
excess right -of -way dedication.
DISCUSSION:
This project will provide for the widening of Irvine /Tustin Avenue to
four lanes divided between 22nd Street and University Drive. The existing align-
ment will be generally followed, however, in the vicinity of Private Road the
curvature will be reduced to provide better sight distance at that intersection.
Curb, gutter, and sidewalk, to be funded by the adjacent property owner, will be
constructed in several locations.
In addition to the work on Irvine /Tustin Avenue, the contract includes
the reconstruction of 23rd Street from Tustin Avenue to Irvine Avenue and the in-
�tallation of an 8" diameter water main in 23rd Street to complete the loop serving
—dhe City area Westerly of Irvine Avenue.

There is presently appropriated a total of $98,000,00 in gas tax funds
for this project. It had been planned to finance the remaining gas tax portion with
an F.Y. 1968 -69 appropriation. However, it is now proposed to advance the addition-
al funding to F.Y� 1967 -68. A budget amendment will be presented for Council con-
sideration when bids are received.
Cooperative financing agreements have been executed with the Arterial
Highway Financing Program and with the County of Orange. The County will finance
all work within County territory. The AHFP will finance 50% of the cost of the
eligible work on Irvine /Tustin Avenue within the City of Newport Beach.
Eleven property owners along Irvine /Tustin Avenue have requested that
construction of curb, gutter, and /or sidewalk adjacent to their property be in-
cluded in this contract. The cost of these items will be paid by them. Completion
of these sections of curb and gutter will provide continuous curb and gutter along
the westerly side of Irvine /Tustin Avenue, A total of $450.00 has been deposited
to date for this work. It is expected that most of the remainder will be deposited
prior to construction. Where deposits are not received the work will be deleted.
Inasmuch as the entire right -of -way needed for the widening is being
d e dicated on the easterly side rather than being split equally between both sides
of the street, the value of the excess should be credited towards the Irvine Com-
pany improvement obligations under the Capital Improvement Policy. The Irvine

certification that the AHFP work is within public right -of -way, and that the
County will not be held responsible for,any liabfility arising from use of the
right -of -way. The certification has-been-prepared by the City Attorney in the
form requested by the County.
The estimated completion date is December 1, 1968.

Irvine Avenue and more particularly to the widening of
Irvine Avenue contemplated by the City of Newport Beach
under an A,H.F.P, project.
Enclosed are three sets of plans (Sheets 1, 3, 9 and 10)
showing a portion of the contemplated road construction and
all of the construction pertinent to the Santa Isabel Storm
Channel. Please review the plans for your approval.as soon as
possible.. The City of Newport Beach is accepting bids for the
Dimprovements of Irvine Avenue, including this work on June 4, 1968.
it is my understanding that this Channel was originally built by
the City of Costa Mesa with some contributing funds by the Flood
Control District and with the approval of the City of Newport
Beach. Our records indicate the Channel downstrean of Irvine
Avenue lies within an easement across Irvine Company land.
I have discussed briefly the problem of dissipation of excess
r energy from this storm drain system with Mr. John Huntsman of
your office and have designed the system accordingly.
Enclosed are two copies of Hydraulic Calculations for your review
and approval.
Please note that the invert of the junction and drop structure
on the easterly side of Irvine Avenue can be filled to provide
supercritical flow into the downstream system if this is
desired in the future.
It is probable that the ultimate downstream storm drainage
facility will be an underground or vertical walled facility,
because of the property values and relatively cheap underground

facility. Continuation of the 84" RCP to the Back Bay will
not impede the flow from the Santa Isabel Storm Channel in
any way.
The storm drain system entering the junction structure from
the south has a time of concentration during the peak flow of
less than 20 minutes as opposed to over 1 hour for the Santa
Isabel System, according to Don Stevens' office. The contri-
bution of this atom drain to the overall system should have
little effect on the operation of downstream channel and will
have absolutely no effect on the operation of the upstream
system.

Item #4, Mudjacking, has been revised from the figure quoted in our letter
of April 4th. Test holes were recently drilled along the length of the
trench failure to obtain some idea of the porosity of the backfill. Based
on the information obtained, the mudjacking contractor has been able to prepare
an estimate of the quantity of material which will be required. The mud -
jacking will be performed on a unit price basis. The final cost will be
based on the quantity of material actually used.
We would like to begin the repair work in mid -May. If the project is ac-
ceptable to you please issue a Purchase Order in the amount of $4,600.00 to
this City. Your final cost will be based on prices actually bid for the
work. If you have any questions please call me at 673 -2110, extension 26.

caused by settlement of the backfill above the 72" centerline storm
drain running from Cherry Lake along Heather Lane. The estimated costs

Subject: Improvement of Irvine/Tustin Ave from 22nd Street to University Dr.
Gentlemen:
The City of Newport Beach, in conjunction with the County of Orange, is pre-
paring a project to widen Irvine /Tustin Avenue to four l=M divided. Two sections
contain feeder lima belonging to yore district. These lint parallel the easterly
border of the district.
Presently the adjoining land east of the District is undeveloped. A complete
analysis has ffist been made of the optimum method of savoring this undeveloped
area; however, it appears a distinct possibility that the area any desire con-
nections to your system. In order to prepare for this possibility, we would In*
to install 8" $ stubs to your feeder lines at the locations shown on the attached
drawing. The stubs would be run from existing manholes to the new proposed edge
of pavement and capped at each end for future use. This action would avoid
costly construction and traffic interference at a later data should connections
be necessary. The stubs would have no effect on the present operation of the
system. All work would be performed at no cost to the District.
Please review our proposal and advise us of your decision as soon as possible
so that we may complete the engineering for the project. Construction is
scheduled for April, 1968.

Dear Sir:
We are entering the final stages of design of the Irvine/Tustin
improvement project. Prior to issuing the final drawing, we
would like to add the locations of the future utilities which
will be placed in or across the roadway to allow these instal-
lations to be completed before the street is paved.
Please send us the latest Company thoughts regarding required
locations for water and sewer !tubs plus the proposed locations
of any other utilities which will be located beneath paved
portions of the street. We realize that plans for development
of the area to the east may not be firm, and a certain amount
of hypothesizing will probably be required. It is hoped, never-
theless, that locations can be predicted with sufficient accuracy
to provide a long term benefit.
