RECITALS: An agreement for engineering services in connection with the improvement of Irvine and Tustin Avenue from Twenty - second Street to University Drive in the City of Newport Beach was previously entered into by and between Engineers and City on April 10, 1967. Engineers have completed the engineering services required by the contract. Said services entailed considerable redesign and redrafting in accordance with the request of the City. The prior agreement contains no provision for an increase in engineering fees due to changes in the scope of the project. City has determined that an increase in engineering fees as submitted by Engineers is fair and reasonable. TO: CITY COUNCIL July 14, 1969 FROM: Public Works Department E- / SUBJECT: ENGINEERING SERVICES AGREEMENT FOR THE IMPROVEMENT OF IRVINE /TUSTIN AVENUE FROM 22ND STREET TO UNIVERSITY DRIVE (C- 1112)1,./ RECOMMENDATION: Authorize the City Manager to execute a modification to the subject agreement to provide for an increase in fee of $3,480 due to design changes. DISCUSSION: The engineering services agreement with Williamson and Schmid, Engineers, provides for a maximum fee of $17,500 for the design of the Irvine /Tustin Avenue improvements. No provisions were made in the agreement for an increase in fee due to a change in the scope of the project. During the design of the project several items were changed which appreciably changed the scope of the project and increased the design engineering time. The primary change was in the structural section of the roadway. This required a redesign of the roadway profile and redrafting of several sheets of plans. Since this project is a cooperative project with the AHFP and the County Road Department, approximately 60% of the additional cost will be paid by the County. The City's portion will come from Gas Tax Funds. (Al - eph Devlin lic W rks Director ldg L f GDR aem 3/3 /67 (8) 1 AGREEMENT 2 (Improvement of Irvine /Tustin Avenue from 22nd Street to University Drive) 3 4 THIS AGREEMENT is made and entered into this ,j�.day 5 of (. ., (', , 1967, by and between WILLIAMSON AND 6 SCHMID CIVIL ENGINEERS, a corporation, herein referred to as 7 "Engineer ", and the CITY OF NEWPORT BEACH, a municipal corpor- 8 ation, herein referred to as 11City ". 9 RECITALS: 10 City proposes to construct certain street improvements 11 of Irvine /Tustin Avenue from 22nd Street to University Drive as 12 set out in the AHFP Preliminary Project Statement (Revision #I), 13 dated February 7, 1967, and CNB Drawing R- 5073 -X. 14 Engineer has submitted a proposal to perform the 15 necessary engineering services in connection with said improve - 16 ments. 17 AGREEMENT: 18 1. City engages Engineer to furnish the services here - 19 inafter mentioned, at and for the compensation herein stipulated, 20 and Engineer accepts said engagement upon the terms hereinafter 21 1 set forth. 22 I 2. Engineer shall: I 23 1 (a) Undertake a preliminary investigation of the 24 I overall project, including discussions and negotiations 25 with all agencies involved in the project. 26 (b) Make a hydrology study for all areas within 27 the project except 23rd Street. 28 (c) Make field surveys necessary for design. 29 (d) Prepare two sets of preliminary prints showing 30 the grade and alignment for roadway and storm drain improve - 31 ments accompanied by quantity and cost estimates. 32 (e) Prepare detailed plans and specifications for 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 0 i , the project. Plans shall be prepared on standard sheets to be furnished by the City. Specifications shall be in typed form suitable for use in soliciting competitive bids. (f) Prepare contract proposal in typed form, suit- able for inclusion in the bidding documents. (g) Provide consultation as may be required from time to time by the Public Works Director until construction is completed. (h) Check shop drawings and make minor revisions of plans and specifications necessary to accommodate changed conditions discovered during construction. (i) Prepare legal description(s) and sketch(es) for the additional right -of -way as shown generally on CNB Drawing R- 5073 -1. (j) Provide centerline monumentation of the new street alignment in accordance with City standards. 3. City shall provide Engineer with the following: (a) Linen sheets for the preparation of plans. (b) Existing hydrology studies. (c) Existing field survey data. (d) R value and traffic index for determining structural section. (e) Subsurface investigations and recommendations between the private road and 23rd Street. (f) Consultation as needed to accomplish the project. 4. Original drawings, reports, notes, maps and other documents shall become the property of the City and may be reproduced as deemed necessary by the Public Works Director. 5. City reserves the -right to terminate this agreement at any time by giving Engineer three (3) days prior written notice in the United States mails, postage prepaid, and addressed to 2. c I Engineer's business office. In the event that City terminates 2 this agreement, it shall reimburse Engineer on the basis of his 3 standard fee schedule contained in his proposal dated March 20, 4 1967. 5 6. All plans, specifications and other documents for 6 the project shall be completed to the satisfaction of the Public 7 Works Director and delivered to him within ninety (90) calendar 8 days following execution of this agreement. 9 7. In consideration of the performance of the above 10 described engineering services, City agrees to pay Engineer an 11 amount based upon the standard fee schedule contained in Eng- 12 ineer's proposal dated March 20, 1967, but in no event shall 13 said amount be greater than $17,500. The amount to be paid 14 Engineer shall be payable as follows: 15 (a) Monthly partial payments, each payment to be 16 the amount earned as determined by the fee schedule. The 17 sum of the monthly partial payments shall not exceed ninety 18 percent (90 %) of the above maximum fee. 19 (b) The balance of the total amount to be paid 20 upon acceptance of the construction work by the City 21 Council, but in any event not later than eighteen (18) 22i months after the signing of the plans by the Public Works 23 Director. 24 In addition, City shall reimburse Engineer for the 25 actual cost of reproduction of copies of said plans, 26 specifications and related documents, and filing fees, 27 checking fees and other related costs authorized by the 28 Public Works Director and advanced by Engineer. 29 8. DISCUSSION: THE PROJECT TO WIDEN IRVINE /TUSTIN AVENUE TO FOUR LANES- - DIVIDED BETWEEN 22ND STREET AND UNIVERSITY DRIVE AT AN ESTIMATED COST OF $323,OCO WAS APPROVED BY THE CITY COUNCIL ON DECEMBER 12, 1566. ORANGE COUNTY HAS APPROVED THE PROJECT FOR PARTICIPATION IN THE FISCAL YEAR 1967 -68 ARTERIAL HIGHWAY FINANCING PROGRAM AND WILL FINANCE APPROX- IMATELY $135,000 OF THE WORK WITHIN THE CITY. IN ADDITION, ORANGE CC'UNTY WILL FINANCE ALL WORK ON TUSTIN AVENUE WHICH FALLS WITHIN THE COUNTY. THE ADDITIONAL ESTIMATED COST TO THE COUNTY I5 $46,000 FOR THIS WORK. THE CITY IS RESPONSIBLE FOR ENGINEERING THE ENTIRE PROJECT. THE ARTERIAL HIGHWAY FINANCING PROGRAM FUNDS ARE NOW AVAIL- ABLE AND CONSTRUCTION WILL BEGIN AS SOON AS DESIGN IS COMPLETED. IF ENGINEERING IS BEGUN IMMEDIATELY, CONSTRUCTION CAN BE STARTED IN LATE SUMMER AND SHOULD BE COMPLETED PRIOR TO NEXT WINTER'S RAINY SEASON. Laura Lagios • 0 DECEMBER 121 1966 T0: CITY COUNCIL FROM: PUBLIC WORKS DIRECTOR ' SUBJECT: IMPROVEMENT OF IRVINE /TUSTIN AVENUE FROM 22ND STREET TO UNIVERSITY DRIVE RECOMMENDATION: ADOPT A RESOLUTION REQUESTING THE COUNTY OF ORANGE TO INCLUDE THE SUBJECT PROJECT WITHIN THE FISCAL YEAR 1967 -68 ARTERIAL HIGHWAY FINANCING PROGRAM. (AHFP) DISCUSSION: IRVINE /TUSTIN AVENUE IS CLASSIFIED AS A PRIMARY STREET FROM WESTCLIFF DRIVE TO PALISADES ROAD. THE STANDARD PRIMARY STREET HAS FOUR TRAVEL LANES, TWO PARKING LANES AND A MEDIAN STRIP. IRVINE /TUSTIN AVENUE NORTHERLY OF 22ND STREET PRESENTLY HAS ONLY TWO TRAVEL LANES. INTERMITTENT PAVED PARKING IS AVAILABLE ON ONLY ONE SIDE; NO PAVED PARKING IS PROVIDED ON THE OTHER. THE PROPOSED PROJECT WILL UPGRADE A PORTION OF THE PARTIALLY DEVELOPED ROADWAY TO FULL PRIMARY STANDARDS. CURB AND GUTTER WILL BE PROVIDED ALONG THE MEDIAN AND BOTH EDGES OF THE ROADWAY. EXISTING CURB AND GUTTER WILL BE SALVAGED WHERE POSSIBLE. DRAINAGE WILL BE PROVIDED AS NECESSARY. THE ALIGNMENT JUST NORTHERLY OF PRIVATE ROAD WILL BE MODIFIED SLIGHTLY TO REDUCE CURVATURE AND TO INCREASE THE SIGHT DISTANCE. THE ESTIMATED COST OF THE PROJECT INCLUDING ENGINEERING, IS $323,000. THE PROPOSED WIDTH OF RIGHT -OF -WAY THROUGHOUT THE PROJECT IS 100 FEET. THE EXISTING RIGHT -OF -WAY WIDTH IS 60 FEET NORTHERLY OF SANTA ISABEL AND VO FEET SOUTHERLY OF SANTA ISABEL. SUBJ< IMPROVEMENT OF IRVINE /TUSTIN AVENUE PAGE 2 IN ANORMAL WIDENING PROJECT, ANY ADDITIONAL ACQUISITION IS CUSTOMARILY SPLIT EQUALLY BETWEEN PROPERTY OWNERS ON BOTH SIDES OF THE STREET. IN THIS CASE, ALL DEVELOPMENT HAS TAKEN PLACE ON THE WESTERLY SIDE OF THE STREET, AND IT WILL BE MOST ADVANTAGEOUS TO ACQUIRE THE ADDITIONAL RIGHT-OF -WAY ENTIRELY FROM THE EASTERLY SIDE. IF THIS IS DONE, HOWEVER, IT WILL PLACE AN UNFAIR BURDEN ON THE EASTERLY PROPERTY OWNER, THE IRVINE COMPANY. THE IRVINE COMPANY HAS GIVEN PRELIMINARY INDICATIONS THAT IT WOULD BE WILLING TO PROVIDE THE ADDITIONAL RIGHT -OF -WAY AT NO COST IN RETURN FOR A PARTIAL RELEASE FROM ITS OBLIGATION TO CONSTRUCT IMPROVEMENTS EQUIVALENT TO ONE -HALF OF A kO FOOT STREET AS REQUIRED BY COUNCIL POLICY. The Public Works Director requested preparation of this resolu- tion for Council consideration on December 12, 1966.
