7,. WHEREAS, the Board of Supervisors by Resolution of May 31, 1956
8 adopted the Master Plan of Arterial Highways to serve the entire County
91' including the incorporated cities thereof, and
10: WHERFAS, Article 2 and 3 of Chapter 9, Division 2 of the Streets
lli and Highways Code authorize a county if it so desires to expend funds
121; apportioned to it out of the California Highway Users Tax Fund for aid

13ii to cities and in the improvement, construction, or repair of streets

14' within a city, and
15i; WHEREAS, the Orange County Board of Supervisors and the Orange
16 County Division of the League of California Cities have agreed upon a
17�' cooperative financial program for the establishment, construction, and

18 maintenance of a County Arterial Highway System known as the Arterial
191 Highway Financing Program, and
201: WHEREAS, the Board of Supervisors has, by appropriate action, pro -
21 vided in the budget of the Special Road Improvement Fund for the Fiscal

22! Year 1967 -68 funds for _-he im?.rovement of streets within the incorpora-
23 ted cities cf the County, which streets are a part of the County's
24'! Master Plan of Arterial Highways, and
WHEREAS, the Board of Supervisors on November 5, 1958 has by formal
resolution adopted the formal procedure for the administration of the

27;: Arterial Highway Financing Program, which procedure is outlined in a
28!., document on file with the County Clerk, formally known as the County of
29�! Orange Arterial Highway Financing Program Procedure Manual, and
30'! WHEREAS, it is mutually agreed between the parties that

a street included in the Orange County Master Plan of Arterial Highways
is a street of general County interest and should be improved in accord
ance with the policies of the Arterial Highway Financing Program..Said
work of such improvement shall be referred to hereinafter as the Projec
NOW, THEREFORE, IT IS AGREED by the parties hereto as follows:
1. The procedures outlined in the Arterial Highway Financing Program.
Procedure Manual herein referred to shall be made a part of this
agreement.
2. The Contracting Authority for the Project is hereby designated
as the City.
3. The Project Engineer for the Project is hereby designated as j
the City.
4. The Construction Engineer for the Project is hereby designated
as th9 City. }
5. All soils engineering and material and construction testin; ::•.es -j
sary for the Project shall be performed by the County. This 51i_111

include preliminary soils investigations, structure foundation
investigations, recommendations for structural sections an6
compaction requirements, and quality control of materials and

construction.

6. The work shall be subject at all times to inspection by the

authorized representatives of both parties.
7. Funds to be used for the Project: 1

(c) Final adjustments of Project costs will be made on the basis of
the County 50 per cent, the City 50 per cent on eligible
items in the Contract.
(d) Any funds spent prior to much 7' 1967 shall not be con-
sidered in the final accounting of this Project.
8. After completion of construction, the party having responsibility
for maintenance of the Project shall maintain the roadway structure:
and facilities in the safe and usable condition to which they have
been improved or constructed under this Project.
9. County -wide extension of Arterial System:
To promote uniformity of County Arterial Highway System with City
Master Plan of Major Streets, both parties agree to continue the
promulgation of the A.H.F.P. as outlined in the aforementioned
Procedure Manual.
IN WITNESS WHEREOF, City has caused this agreement to be executed
by its Mayor and attested by its Clerk, and County has caused this agree-
ment to be executed by the Chairman of its Board of Supervisors and
attested by its Clerk, on the dates written opposite their signatures,
all thereunto duly authorized by Minute Order of the City Council and

Financing Program Project Administration Agreement between
the County of Orange and the City of Newport Beach for the
improvement of Irvine/ Tustin Avenue from 22nd Street to
University Drive. Said agreement was authorized by the
City Council at its regular meeting held April 10, 1967 by
the adoption of Resolution 6545.
Also enclosed is a certified copy of a page from the Draft
Minutes of April 10 relating to this action and a certified copy
of Resolution No. 6545.

DESCUSSION:
THE PROJECT TO WIDEN IRVINE/TUSTIN AVENUE TO FOUR LANES - DIVIDED FROM
22ND STREET TO UNIVERSITY DRIVE WAS APPROVED BY THE CITY COUNCIL ON DECEMBER 12,
1966. THE COUNTY OF ORANGE HAS SUBSEQUENTLY APPROVED THE PROJECT FOR FUNDING AS
PART OF THE ARTERIAL HIGHWAY FINANCING PROGRAM.
THE ESTIMATED COST OF THE PROJECT IS $316,6OOj OF THIS AMOUNT APPROXf-
MATELY $135,500 WILL BE FUNDED BY AHFP. AN ADDITIONAL $1:6,000+ WILL BE FINANCED
BY THE COUNTY OF ORANGE THROUGH A COOPERATIVE AGREEMENT FOR WORK ACCOMPLISHED ON
TUSTIN AVENUE WITHIN THE COUNTY.
THE SELECTION OF THE ENGINEER FOR THIS PROJECT AND THE MAXIMUM FEE WERE
APPROVED BY THE COUNCIL ON MARCH 27, 1967- CONSTRUCTION IS SCHEDULED FOR AUGUST,
1967-

ment with the County of Orange,which have been approved by me as
to form, together with a copy of transmittal letter dated March
213 1967, to Joseph T. Devlin from the County Road Department.
Also transmitted is a resolution which, if adopted by the City
Council, will authorize the execution of the agreement.
The Public Works Director requested preparation of the resolu-
tion for action by the Council at their meeting on April 10.
