WITNESSETH:
WHEREAS, the State has adopted a route for the proposed
Newport Freeway located generally along the present alignment of
Newport Boulevard; and
WHEREAS, the City Council is of the opinion that the
route of the proposed Newport Freeway should be relocated to an
alignment along Superior Avenue; and
WHEREAS, the City Council has determined that an
ing study of a Superior Avenue alignment is needed; and
WHEREAS, a proposal to prepare such a study has been
made to the City by Engineer, which firm is well qualified to
prepare such a study;
NOW, THEREFORE, City and Engineer for the consideration
hereinafter named agree as follows:
1. Scope of Services to be Provided by Engineer.
Engineer agrees to perform the following services:
(a) Determine the feasibility of utilizing
Superior Avenue for the Newport Freeway to a point in the
vicinity of 15th Street at a freeway -to- freeway interchange
with the proposed inland route of the Pacific Coast Free-
way, including preliminary design presentations showing
both freeway alignments, connecting ramps and adjoining
streets, and the freeway interchange.
(b) Investigate possible connections to the
Pacific Coast Freeway at the northerly extension of Balboa

(c) Investigate and present preliminary design
for a separation structure between Newport Boulevard and the
proposed inland alignment of the Pacific Coast Freeway.
(d) Investigate the feasibility and prepare pre-
liminary designs for possible interconnections between the
Pacific Coast Freeway and Newport Boulevard.
(e) Investigate the effect of the proposed realign-
ment of the Newport Freeway along Superior Avenue in compari-
son with current geometric designs of the Newport Freeway in
the vicinity of Harbor Boulevard and 17th Street as prepared
by the California Division of Highways.
(f) Analyze and compare the community -wide traffic
service implications of the interchange between the Newport
Freeway and the proposed inland alignment of the Pacific
Coast Freeway with the interchange between the adopted
Pacific Coast Freeway alignment and the Newport Freeway,
based upon existing designs as prepared by the California
Division of Highways.
(g) Evaluate the retention of Newport Boulevard as
a separate and distinct inter -city arterial.
(h) Evaluate the retention of Pacific Coast High-
way as a separate and distinct inter -city arterial.
(i) Employ a qualified model maker to prepare a
facsimile model of the freeways and interchanges based upon
the above studies for use in presentations to the public.
(j) Work cooperatively with a planning consultant,
to be furnished by the City, whose function will be to evalu-
ate land use planning and community values as they may be
affected by the alternative designs referred to above.
(k) Present findings, conclusions and recommenda-
tions at public and private meetings as may be required.

gl!graphs, traffic data, and other information available in its files
4iwhich may be needed by Engineer in order to perform the above

7i Engineer will prepare the preliminary and final analysis
8!and the facsimile model of the freeways and interchanges within a
91time period sufficient to allow review by City prior to City's
10 .,preparation of a final report and scheduled presentation before
llithe California Highway Commission in May, 1967.
121 4. Compensation.
13,1! City agrees to pay Engineer for its services at hourly
14'lrates for the actual man -hours expended by Engineer's professional
15.�employees, plus 200 per cent of the total of said amount, said
16 hourly rates to be based on the average annual hourly salary of
171leach employee, computed from the following monthly salary schedule:

(a) Senior engineers $900 to $1400
(b) Engineers $700 to $900
(c) Technical personnel, in-
cluding traffic analysts
and draftsmen $400 to $700
City agrees to reimburse Engineer for the actual cost of
Ithe facsimile model of the freeways and interchanges. City shall
also reimburse Engineer for its actual travel expenses and for
;living expenses based upon a maximum rate of $20 per employee per
I day.
2711 Engineer agrees that secretarial and other indirect

30H; It is agreed that the maximum compensation to be paid to

City agrees to pay Engineer within thirty (30) days after
3li the receipt of itemized bills. Final bills will be submitted to

City within sixty (60) days following the expiration or termination
of this agreement. Engineer agrees to allow City or City's autho-
rized agent to examine its records to verify the correctness of the
amounts billed to City.
5. Independent Contractor.
In carrying out the terms of this agreement, Engineer
I shall at all times be an independent contractor and not an employee
of City.
6. Term of Agreement.
This agreement shall be effective for a term of six (6)
months commencing with the date of its execution by City unless
sooner terminated by either party. This agreement may be extended
for an additional term by resolution adopted by the City Council.
7. Termination.
18 This agreement may be terminated at any time by either
1911party in the following manner: The party desiring to terminate
2011this agreement shall cause a written notice of termination to be

mailed by certified or registered mail to the other party addressed,
as follows: To the City Clerk, City Hall, 3300 Newport Boulevard,
Newport Beach, California; to De Leuw, Cather & Company, 1256
Market Street, San Francisco, California. Termination shall be
effective upon the date of receipt of such notice.
8. Documents and Other File Materials.
Upon the expiration or termination of this agreement,
Engineer shall, upon request of City, turn over to City copies
of data, memoranda, reports, design drawings, calculations,
letters and other documentation pertaining to the services in-
eluded herein.
IN WITNESS WHEREOF, the parties hereto have executed this

Gather & Company Agreements, We have contacted Mr, Robert
Gruenwald and have arranged to get the planning Agreements to him.
You will probably be receiving those signed Agreements within a few
days.

In order to make an all out effort to implement the new plan to
preserve the Newport Boulevard arterial connection between
Costa Mesa and Newport Beach, and to effect a more advantageous
interchange between the Newport Freeway and the Coastal Freeway
by securing a Superior Avenue alignment for the Newport Freeway,
it appears advisable to permit the firm of DeLeuw, Cather & Company,
consulting engineers, to employ the services of a planning consultant.
The Committee has been informed by the staff that there are surplus
salary funds in the Planning Department in the amount of $2, 500, 00,
and surplus consulting funds in the Public Works Department in the
amount of $3, 500. 00 which may be used to defray these costs if
sufficient monies are not available by public contributions.
It is therefore recommended by the Freeway Committee that the
City of Newport Beach allocate a sum not to exceed $10, 000. 00
in order that the firm of DeLeuw, Cather may employ the services
of Robert E. Grunwald & Associates at a sum not to exceed the
amount of $4, 150. 00, for the development and presentation of
planning studies to augment the engineering studies.

RECOMMENDATIONS:
DISCUSSION:
ADOPT A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE AN AGREEMENT WITH THE FIRM OF DELEUWy LATHER
AND COMPANY FOR THE SUBJECT STUDY IN AN AMOUNT NOT TO
EXCEED $10,000.
ON FEBRUARY 14, 1967, THE CITY COUNCIL AUTHORIZED THE FREE-
WAY COMMITTEE TO NEGOTIATE WITH DELEUWy LATHER AND COMPANY FOR THE NEC-
ESSARY PLANNSNG AND ENGINEERING STUDIES OF THE PROPOSED REALIGNMENT OF
THE NEWPORT FREEWAY ALONG SUPERIOR AVENUE FOR PRESENTATION TO THE HIGH°
WAY COMMISSION. IT IS FELT THAT THE CITYtS POSITION COULD BE BEST PRE-
SENTED TO THE STATE HIGHWAY COMMISSION BY A COMBINED ENGINEERING AND
PLANNING STUDY COMPLETE WITH A SIMPLE MODEL SHOWING THE PROPOSED FREE-
WAY TO FREEWAY INTERSECTION ON SUPERIOR AVENUE WEST OF THE CITY OF
NEWPORT BEACH CORPORATION YARD.
THE ESTIMATED COST OF THE DIFFERENT ELEMENTS OF THIS REPORT
ARE AS FOLLOWS:
1. ENGINEERING STUDY $ 4,350
2. PLANNING STUDY 4,150
3. MODEL 1,500
MAXIMUM ESTIMATED COST $70,000
IT IS PROPOSED THAT THE REPORT WOULD BE COMPLETED IN TIME
FOR THE MA.Y, 1967 MEETING OF THE STATE HIGHWAY COMMISSION. THE ENGIN-
EERIN:: AND PLANNING WOULD ESSENTIALLY BE A PRELIMINARY ANALYSIS OF (1)
THE FEASIBILITY AND EFFECTS OF UTILIZING SUPERIOR AVENUE FOR THE NEWPORT
FREEWAY; AND (2) THE RETENTION OF NEWPORT BOULEVARD AS A SEPARATE AND
DISTINCT INTER -CITY TRAFFIC ARTERIAL. SINCE IT APPEARS THAT THE PROPOSED
INTERCHANGE AT SUPERIOR AVENUE WOULD RESULT IN A GREATLY SIMPLIFIED AND
LESS COSTLY INTERCHANGE, IT 15 FELT THAT A SIMPLE MODEL WOULD BE AN IN-
VALUABLE TOOL IN DEMONSTRATING ITS ADVANTAGES TO THE COMMISSION.
