AGREEMENT FOR NON-STANDARD IMPROVEMENTS THIS AGREEMENT, made and entered into this ,/7 day of ?WV 198q, by and between RODNEY F. EMERY, hereinafter referred to as "OWNER", and( the CITY OF NEWPORT BEACH, a municipal corporation, organized and existing under and by virtue of its Charter and the Constitution and the laws of California, hereinafter referred to as "CITY"; WITNESSETH WHEREAS, OWNER owns a parcel of real property located in Newport Beach, County of Orange, State of California, described as follows: Corona The land referred to in this report is situated in the State of California, County of Orange, City of Newport Beach, and is described as follows: All of Block "033" of Corona del Mar, as shown on a map recorded in Book 3, Pages 41 and 42 of Miscellaneous Maps, Records of Orange County, California. Excepting therefrom the following: Beginning at the northerly most corner of said Block "033"; thence southeasterly along the northeasterly boundary of said Block 033, around a curve concave southwesterly and having a radius of 384.60 feet, a distance of 264.45 feet; thence south 20 degrees 5' 00" west 171.38 feet; thence in a northwesterly direction a distance of 60.19 feet more or less to a point in the northwesterly line of said block; thence north 10 degrees 32' 33" east along said northwesterly line a distance 237.00 feet to an angle point therein; thence north 30 degrees00' 52" west a distance of 70.15 feet to the most westerly corner of said block; thence north 40 degrees 00' 00" east a distance of 116.6 feet to the point of beginning. Said real property is commonly known as 2741 Ocean Boulevard, del Mar, California; and WHEREAS, OWNER desires to construct certain improvements (hereafter "non-standard improvement") within the public right of way of Clay Street, a public street; and WHEREAS, said improvements may interfere with CITY's ability to construct, operate, maintain, and replace CITY facilities within said easements; and Page 1 of 4 89=105543 STATE OF CALIFORNIA ) ) ss.
