THIS AGREEMENT, made and entered into this _'day of
1969, BY AND BETWEEN.
CITY AF NEWPORT BEACH,
a.municipal corporation,
= hereinafter referred to as "CITY,"
and
COUNTY.OF.9444= apolitical
subdivision of the State of
California; hereinafter referred
WITNESSETH• to as "COUNTY."
WHEREAS, CITY and COUNTY entered into,_sp_ agreement on September 19,
1967, providing for the constructiqgof roadway improvements
on Tustin Avenue between University Drive and Palisades Road,
and
WHEREAS, CITY and COUNTY have determined that a traffic signal and
highway lighting system at the intersection of Tustin Avenue
and University Drive is warranted, .and
WHEREAS, said traffic signal was not contemplated or provided for in
the hereinabove mentioned agreement, and
WHEREAS, the parties hereto desire to include the construction of said
traffic signal in the same contract for the improvement of
Tustin Avenue between University Drive and Palisades Road.
NOW, THEREFORE, IT IS AGREED by the parties hereto as follows:
I. The provisions in the hereinabove mentioned agreement between the
CITY and the COUNTY shall remain in full force and effect except as
amended herein.
II. The "Project" shall include the installation of a traffic signal
and highway lighting system at the intersection, of Tustin Avenue
and University Drive. The controller at said installation shall be
modular solid state type 90, with 5 phases, and shall be capable
of being expanded to a full 8 phases by addition of plug -in solid
state modules. It shall be furnished with (2) type DP modules,
(2) type S modules, (1) type SP module, solid state'switching relays
inductive loop test switches, (8) inductive loop sensor units and
(2) dual input magnetometer sensor units in a type P -1 cabinet.

III. Upon completion of the Project,, .-POW =-'a share of the traffic
signal and intersection lighting system installation will be
determined in the same ratio to the total cost of such system as
the number of legs under COUNTY jurisdiction entering the intersec-
tion are to the total number of legs entering the intersection.
IV. For the purpose of determining the proportionate share of the
traffic signal costs to be borne by the respective parties hereto,
the CITY limits shall be established as those existing on the day
which COUNTY advertises the project for construction bids.
V. All construction and installation costs shall be based on the con-7
tract unit costs. The total Cost,to COUNTY is presently estimated
to be $15,625 and the total cost to CITY is presently estimated to
be $9,375 based on the fact that two and one-half (2'3s), legs of the
intersection presently lie in COUNTY.area and one and one-half (1')
legs of.the intersection presently lie in CITY area.
VI. Paragraph III, Page 2, of the agreement between CITY and COUNTY
dated September 19, 1967, shall be revised as follows:
III. The total estimated cost for the CITY construction
and right of way is $26,000 which sum includes an
estimate of the engineering and overhead costs for
the CITY portion.
VII. Upon completion of the Project, said traffic signal *hall be
maintained and operated by COUNTY. The maintenance and operational
costs for said traffic signal shall be borne by the parties hereto
in accordance with provisions in the Standard Traffic Signal
Maintenance Agreement No. 169-31 0,between the CITY and the COUNTY.
VIII.It is mutually understood and agreed that CCLINTY shall be responsible-: J
for maintaining and operating the traffic signal-installations on
Tustin Avenue at the intersections of University Drive and at !Mesa-:..'
Drive for a minimum period of two (2) years, from the data that-
both signals at said intersections have been placed in,full d0er

WHEREAS, that portion of Tustin Avenue, between University Drive
and Palisades Road, lying within the City limits of Newport.Beach, is
(deemed to be a highway of County -wide importance, and
WHEREAS, the County of Orange proposes to improve said portion
lof Tustin Avenue.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED that pursuant to the
provisions of Section 1700, Article 3, Chapter 9, Division 2 of the
Streets and Highways Code all of that portion of Tustin Avenue, between
University Drive and Palisades Road, lying within the City limits of
iewwport Beach, is hereby declared to be a County highway during the
1period of improvement of said road by the County of Orange.
BE IT FURTHER RESOLVED that the Clerk of this Board be and he is

On motion of Supervisor Allen, duly seconded and unanimously
carried by Board members present, the Chairman and the Clerk are author-
ized to sign the Agreement dated August 12, 1969, between the County of
Orange and the City of Newport Beach for the installation of a traffic
signal and highway lighting system at the intersection of Tustin Avenue
and University Drive, as recommended by the Road Commissioner and County
Surveyor, in his letter dated August 6, 1969.

On motion of Supervisor Phillips, duly seconded and unanimously

SUBJECT: SUPPLEMENTAL COOPERATIVE FINANCING AGREEMENT FOR A TRAFFIC SIGNAL AND
SAFETY LIGHTING AT TUSTIN AVENUE AND UNIVERSITY DRIVE
RECOMMENDATION:
Adopt a resolution authorizing the Mayor and the City Clerk to execute
the subject agreement with the County of Orange.
DISCUSSION:
On September 19, 1967 the City entered into an agreement with the County of
Orange for the widening of Tustin Avenue between University Drive and Mesa Drive. The
original estimated cost of right -of -way and construction was $7,100.00. This sum has
been encumbered under a prior year's budget appropriation.
The subject supplemental agreement increases the scope of the project to
include a traffic signal and safety lighting at Tustin Avenue and University Drive.
The City will pay for 1; legs (3/8) of the traffic signal. The City's share of the
signal work is estimated at $9,375.00.
The County has revised the cost estimate for the total project with the City's
share now estimated to be $20,000.00.
A budget amendment in the amount of $12,900.00 has been prepared for Council
consideration revising the present appropriation. Sufficient gas tax funds are available.

IV. CITY's share of the construction cost shall be determined
on the basis of the amount of words done on said portion o
roadway lying within its boundaries, as these boundaries
exist at the time of advertising the Project.

referred to above which are chargeable to CITY shall not
exceed fifteen percent (15X) of CITY's share of the Pro-
ject coustructiou cost.
VI. IT IS MUTUALLY UNDERSTOOD AND AGREED:
A. That neither COUM nor any officer or employee
thereof shall be responsible for any damage or lia-
bility occurring by reason of anything done or omitted
to be done by CITY under or in connection with any
work, authority or jurisdiction delegated to CITY
under this agreement. It is also understood and a
that, pursuant to Government Code Section 895.4, CITY
shall fully indemnity and hold COUNTY harmless from and
liability imposed for injury (as defined by Government
Code Section 810.8) occurring by reason of anything
done or omitted to be done by CITY under or in oonnec-
tiou with any work, authority or jurisdiction dele-
gated to CITY under this agreement.

IN RE: RIGHT OF WAY CONTRACT LA PALMA AVENUE YORBA
On motion of Supervisor Phillips, duly seconded and unanimously
carried, the Chairman and the Clerk are authorized to sign the Right of
Way Contract dated September 19, 1967, between the County of Orange and
Mabel Ann Yorba, in connection with the acquisition of additional right
of way for La Palma Avenue, Project No. Y6, Parcel Nos. 143.01, 143.11,
143.21, 143.31 and 143.41.
The County Auditor - Controller is instructed to issue his warrant
in the sum of $1,003.00 in favor of Mabel Ann Yorba and additional
warrants as required for reconveyance and forwarding fees, not to exceed
$15.00 each, in accordance with the instructions from the Department of
Real Property Services; delivery of said warrants to be delayed pending
notice from the Department of Real Property Services that adequate title
to the subject property has been obtained. Said warrants are to be made
payable out of Y6, La Palma Avenue, Work Order No. 3591, Account Code
112 - 3011 -360.

SUBJECT: COOPERATIVE AGREEMENT WITH ORANGE COUNTY FOR THE IMPROVEMENT OF
TUSTIN AVENUE FROM UNIVERSITY DRIVE TO PALISADES ROAD
RECOMMENDATIONS:
ADOPT A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE THE SUBJECT AGREEMENT ON BEHALF OF THE CITY.
DISCUSSION:
THE PROJECT CONSISTS OF THE WIDENING OF TUSTIN AVENUE TO FOUR
LANES BETWEEN UNIVERSITY DRIVE AND PALISADES ROAD. THE WIDENED ROADWAY WILL
CONNECT TO THE CITY FISCAL YEAR 1967 -68 PROJECT FOR THE WIDENING OF TUSTIN
AVENUE SOUTHERLY OF UNIVERSITY DRIVE. UPON COMPLETION, IRVINE /TUSTIN AVENUE
WILL BE FOUR LANES WIDE FROM WESTCLIFF DRIVE TO PALISADES ROAD.
THE CITY WILL BE RESPONSIBLE FOR FINANCING ALL WORK WITHIN THE CITY
LIMITS, INCLUDING THE ACQUISITION OF NECESSARY RIGHT OF WAY WITHIN THE CITY.
THE PROPOSED PROJECT WILL REQUIRE THE ACQUISITION OF A SMALL PORTION OF ONE
LOT ON THE EASTERLY" SIDE OF TUSTIN AVENUE. THE REMAINING RIGHT OF WAY WILL
BE ACQUIRED FROM THE WESTERLY SIDE OF THE STREET IN COUNTY TERRITORY.
THE TOTAL PROJECT COST TO THE CITY IS PRESENTLY ESTIMATED TO BE
APPROXIMATELY $72000.00 OF GAS TAX FUNDS. $5'000.00 IS INCLUDED IN THE CURRENT
BUDGET FOR RIGHT OF WAY ACQUISITION COSTS FOR THIS PROJECT. ALTHOUGH THE
COUNTY IS NOW PROCEEDING WITH RIGHT OF WAY ACQUISITION, ACTUAL CONSTRUCTION
IS EXPECTED TO BE SCHEDULED DURING THE 1968 -69 FISCAL YEAR.

Subject: Joint powers agreement for the improvement of Tustin
Avenue from University Drive to Palisades Road
Attached are the original and three copies of the subject agree-
ment with the County of Orange for certain improvement work on
Tustin Avenue between University Drive and Palisades Road, all
of which have been approved as to form by the County Counsel and
myself. Also transmitted is a resolution which, if adopted by
the City Council, will authorize execution of the agreement on
behalf of the City.
The Public Works Director requested preparation of the resolution
for consideration at the Council meeting on August 28, 1967.
