BEACH, a municipal corporation, hereinafter referred to as "City ",
a permit, license and privilege to use certain real property,
herein termed the "parking lot ", situated in the City and des-
cribed as the westerly one hundred (100) feet of the parking lot
at the Hughes facility, adjoining and parallel to Superior
Avenue, for the purpose of providing a motorcycle training area
for officers of the City Police Department.
This permit and license is given subject to the fol-
lowing terms and conditions:
1. Use of the parking lot by City shall be restricted
to Saturdays and Sundays between the hours of 8 :00 a.m. and
2:00 p.m.
2. Not more than five (5) nor less than two (2)
days before using the parking lot as herein provided, the City
shall notify the Security Office of Hughes at Newport Beach as
to the date and hours of intended use; such notice may be by
telephone.
3. The City in its use of the parking lot will not
interfere with the use of the parking lot as a parking area by
Hughes employees and business visitors.
4. The City shall be permitted to place painted yel-
low markings on the surface of the parking lot which shall not
be in conflict with any markings used for parking purposes and
which shall be approved in advance by the Manager of Administra-
tion, Hughes Aircraft Company, Newport Beach.
5. The City agrees to hold Hughes harmless from any
claims, causes of action or judgments for damages on account of

any injuries to persons or property arising out of City's use of
said parking lot and further agrees to cause Hughes to be named
as an additional insured under the City's comprehensive liability
insurance polic and to furnish Hughes with a certificate of
City's insurer to that effect and to the further effect that said
insurer will give Hughes not less than ten (10) days notice in
advance of the cancellation or reduction of said policy. The
limits of said policy shall not be less than the following:
a. Bodily injury, one person, $1,100,000; one
incident, $1,100,000
b. Property damage, $1,100,000
6. This agreement may be terminated at any time by
either party by giving the other party three (3) days prior
notice in writing of such termination. If notice of termination
is given by City, the notice shall be directed to the office of
the Manager of Administration, Hughes Aircraft Company, 500
Superior Avenue, Newport Beach. If notice of termination is given
by Hughes, the notice shall be directed to the Chief of Police,
City of Newport Beach, City Hall, 3300 West Newport Boulevard,
port Beach. This agreement shall become effective 1 September
1967, and shall continue from year to year until cancelled.
The terms and conditions of this permit are hereby
accepted.

Subject: Use of Hughes Aircraft Company-parking lot for a
motorcycle training area
Attached are the oriinal and.2ke copies of a Permit and
License (Use of Parking Lot:-At the Hughes Aircraft Company),
which was prepared at the request of the Police Department. -
to provide for the use of the-Hughes parking lot for motor-
cycle training exercises. The original and three copies of
thiFreement have been executed;'on behalUof Hughes Aircraft
Company y and approved by mass to form. Xax.3&1by,,-,`M&nager of
Administration for Hughes, has requested that:-three executed
copies 'of the agreement be returned to them.
Because of.the fact that the agreement obligates the City to
hold Hughes harmless from any liability arising out of the
Cityls use of the parking 16ti, it will be necessary that
authorization of the City Council for the City Manager to
execute the agreement be obtained, ft is suggested that this
item be placed on the agenda for the (ouncillm,siting on
September 11, 1967. The appropriate Council action would be
a motion authorizing the City Mang
