IN RE: AMENDMENT TO REAL PROPERTY AGREEMENT UNIVERSITY REGIONAL PARK THE IRVINE COMPANY On motion of Supervisor Allen, duly seconded and carried, the Chairman and the Clerk are authorized to sign the Amendment to Real Property Agreement, dated November 10, 1970, G.A. 541, University Regional Park, to the Real Property Agreement dated December 16, 1969 between the County of Orange and the Irvine Company to clarify the issue of who is to pay for the survey of the University Regional Park. Supervisor Battin voted No. IN RE: EMERGENCY REQUISITION ROAD DEPARTMENT LOWER DOMESTIC WATER LINES FUND: 112 -3011- 190 -SB -22 On motion of Supervisor Hirstein, duly seconded and unanimously carried, the Purchasing Agent is authorized to enter into contract with Isaacs Plumbing, Santa Ana, California, by Purchase Order #B35461, for labor and material to lower domestic water lines as required to accommodate excavation of drive approaches on Chapman Avenue, and to make changes as required without.the necessity of further Board action. The County Auditor - Controller is directed to pay, upon present- ation of proper billing documents, for said Work in accordance with terms and conditions of Purchase Order #B35461, Fund: 112 - 3011- 190-SB -22. WHEREAS, the Board of Supervisors by Resolution of May 31, 1956 adopted the Master Plan of Arterial Highways to serve the entire County including the incorporated cities thereof, and WHEREAS, Article 2 and 3 of Chapter 9, Division 2 of the Streets and Highways Code authorize a county if it so desires to expend funds apportioned to it out of the California Highway Users Tax Fund for aid to cities and in the improvement, construction, or repair of streets within a city, and WHEREAS, the Orange County Board of Supervisors and the Orange County Division of the League of California Cities have agreed upon a cooperative financial program for the establishment, construction and maintenance of a County Arterial Highway System known as the Arterial Highway Financing Program, and WHEREAS, the Board of Supervisors has, by appropriate action, provided in the budget of the Special Road Improvement Fund for the Fiscal Year 1970 -71 funds for the improvement of streets within the incorporated cities of the County, which streets are a part of the County's Master Plan of Arterial Highways, and WHEREAS, the Board of Supervisors on November 5, 1958 has by formal resolution adopted the formal procedure for the administration of the Arterial Highway Financing Program, which procedure is outlined in a document on file with the County Clerk, formally known as the County of Orange Arterial Highway Financing Program Procedure Manual, and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 10.0-13 u 0 WHEREAS, it is mutually agreed between the parties that 32nd Street between Balboa Boulevard and Newport Bouleysrd, a street included in the Orange County Master Plan of Arterial Highways, is a street of general County interest and should be improved in accord- ance with the policies of the Arterial Highway Financing Program. Said work of such improvement shall be referred to hereinafter as the Project. NOW, THEREFORE, IT IS AGREED by the parties hereto as follows: 1. The procedures outlined in the Arterial Highway Financing Program Procedure Manual herein referred to shall be made a part of this agreement. 2. The Contracting Authority for the Project is hereby designated as the City 3. The Project Engineer for the Project is hereby designated as the City 4. The Construction Engineer for the Project is hereby designated as the City 5. All soils engineering and material and construction testing neces- sary for the Project shall be performed by the County. This shall include preliminary soils investigations, structure foundation investigations, recommendations for structural sections and compaction requirements, and quality control of materials and construction. 6. The work shall be subject at all times to inspection by the authorized representatives of both parties. 7. Funds to be used for the Project: (a) The estimated cost of the Project covered by this agreement is: DESIGN ENGINEERING: 10,000 RIGHT OF WAY ACQUISITION: 172,000 CONSTRUCTION CONTRACT: 135,000 CONSTRUCTION ENGINEERING: 4,000 TOTAL: $ d.21, 000 -2- 1 2 3 4 5 6 7 8 91 10'i 11 12' 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 .ego -is 0 (b) On the basis of the above estimate, this Project will be financed as follows: COUNTY FUNDS: $157,500 CITY FUNDS: 1.57,500 6..000* TOTAL: $321,000 (c) Final adjustments of Project costs will be made on the basis of the County 50 percent, the City 50 percent on eligible items in the Contract. (d) Final adjustments of project storm drain costs will be made on the basis of matching funds up to a maximum of fifty percent (50 %) of the total cost of eligible items; that is, County participation shall not exceed a maximum of twenty - five percent (25 %) of the total cost of eligible storm drain construction. (e) It is the intent of the parties hereto to comply with all applicable rules regarding the expenditure of State Gas Tax Funds. Eligibility of any storm drain item will be subject to final audit and determination by the State Controller's Office. Any future adjustment required by said Controller's office shall be made by the City with City funds, including complete refund to the County of any County gas tax funds declared by the Controller to have been expended on ineligible construction. (£) Any funds spent prior to March 1, 1970 shall not be considered in the final accounting of this Project. 8. After completion of construction, the party having responsibility for maintenance of the Project shall maintain the roadway struc- tures and facilities in the safe and usable condition to which they have been improved or constructed under this Project. IN WITNESS WHEREOF, City has caused this agreement to be executed by its Mayor and attested by its Clerk, and County has caused this agreement to be executed by the Chairman of its Board of Supervisors and attested by its Clerk on the dates written opposite their signa- tures, all thereunto duly authorized by the City Council and the Board of Supervisors, respectively. Right of way to be acquired and geometric standards for the Project 16 shall be mutually agreed upon by the parties hereto by the prepara- 17 tion of a project report prior to expenditure of funds. 18 6. Thirty - second Street as a designated secondary street is eligible. Between Balboa Boulevard and Marcus Avenue traffic on 32nd Street is limited to one way. The existing right of way is 30 feet in width with a curb separation of only 20 feet Projected traffic demands show that the street should carry four full traffic lanes for its entire length. The widening is being accomplished in stages, Twelve lots of the 24 required have either been purchased or an escrow has been opened as part of the current year's AHFP project. The proposed project will provide funds to finish acquisition of the 80 foot right of way necessary to construct a standard 64 foot curb to curb (four lanes plus parking) secondary street. All right of way is being acquired from the southeasterly side of the street, The location of the property to be purchased is shown on the attached drawing. Right of way acquisition is being spread over two fiscal years. Construction will be scheduled for the third fiscal year. The existing right -of -way along 32nd Street is 30' wide. An additional 50' is required to permit widening from the present single lane to four full lanes. This requires purchase of 24 lots and the acquisition of two segments of a parking lot serving an adjacent market. Fourteen of the lots are being purchased by AHFP Project 437. The remaining ten lots would be obtained by means of the proposed project. Entire lots are being purchased to avoid severance damages. It is anticipated that the required segments of the parking lot, can be obtained through a trade for excess property from outside the proposed right -of -way. Tne trade would be on an equaitasis. No capital outlay is expected and no funds for purchase of the two segments have been included in the project cost estimate. Access to 32nd Street will be restricted. Improvements in the final phase will include four travel lanes, two'parking lanes, replacement of existing curb, gutter and sidewalk, catch basins, and a traffic signal at the Balboa Boulevard intersection. DISCUSSION: On December 27, 1967 Council, by Resolution 6686, formally requested the Board of Supervisors to provide funds for the subject project, and stated County funds would be matched by City funds. Funds in the amount of $154,000.00 have been approved. The Administration Agreement will formalize responsibilities. The City has been eligible to expend County funds since March 1, 1968, and has begun acquisition action to obtain the required right -of -way. One parcel has been pur- chased, one is in escrow, and appraisals have been requested on six others. The owners of the properties to be appraised have all indicated a desire to begin immediate negotiations. The general layout of the project is shown on City of Newport Beach Drawing No. R- 5056 -S, a copy of which is attached. This project will facilitate the movement of recreational traffic enroute to and from the beach area. 0 December 27, 1967 TO: CITY COUNCIL f FROM: Public Works Department SUBJECT: WIDENING OF 32ND STREET FROM NEWPORT BOULEVARD TO BALBOA BOULEVARD RECOMMENDATION: Adopt a resolution requesting project within the Fiscal Year Program (AHFP). DISCUSSION: the County of Oranqe to include the subject 1968 -69 Arterial Highway Financing The AHFP program is designed to assist cities in upgrading the arterial high- way system within the County. Thirty- second Street as a designated secondary street is eligible. At the present time 32nd Street is unable to adequately handle the current traffic demands. Between Balboa Boulevard and Marcus Avenue traffic is limited to one way. In this area the existing right of way is 30 feet in width with a curb sep- aration of only 20 feet. Projected traffic demands show that the street should carry four full traffic lanes for its entire length. The widening will be accomplished in stages. This year's portion of the project will provide funds to begin acquisition of the minimum 76 foot riqht of way necessary to construct a standard 64 foot curb to curb (four lanes plus parking) secondary street. All right-of-way will be acquired from the southeasterly side of the street. The location of the property to be purchased is shown on the attached drawing. It is proposed that access from the adjacent properties onto 32nd Street be restricted. This restriction results in the remaining property beyond the right - of -way having little value to the present owners. The appraiser shows the City may wish to acquire entire lots to avoid excess severance damages. A tentative schedule for completion of the project, including construction, with the estimated cost of each phase, is: Fiscal Year 1967 -68 Right of Way Acquisition* $40,000 Fiscal Year 1968 -69 Right of Way Acquisition* 308,000 Fiscal Year 1969 -70 Complete the Acquisition* 220,000 Fiscal Year 1970 -71 Construction 84,000 TOTAL $612,000 *Includes acquisition of entire lots The above schedule is based on the assumption that the Arterial Highway Financing Program of the County of Orange will finance 50% of the total cost. Sufficient Gas Tax funds will be available for the Cit 's share from antici- pated revenues. Action is underway to complete this purchase from an owner who has expressed an immediate need to sell, On October 23, 1967 the Council authorized the retention of a professional real estate appraiser to aid in determining the market value of the property to be acquired.
