HomeMy WebLinkAboutC-1152(B) - Appraisal Services1 /25/67 (7)` AGREEMENT FOR APPRAISAL SERVICES 1�i 2; THIS AGREEMENT, made and entered into this 31,,,,Y day 3; of October, 1967, by and between the CITY OF NEWPORT BEACH, herein-1 I 4 5 6 7 8 9 10 ' 11 12 13 after referred to as "City ", and GEORGE HAMILTON JONES, hereinafter) referred to as "Appraiser "; Ij WITNESSETH: WHEREAS, City is planning a public works project for the widening of 32nd Street from Newport Boulevard to Balboa Boulevard which would involve the acquisition of approximately forty -six feet of right of way on the easterly side of 32nd Street; and WHEREAS, in connection with said project, it will be necessary that City acquire various interests in private prop- erty within the project area either through negotiation or by 141 exercising the power of eminent domain; and 15i WHEREAS, in order to determine the fair market value of 16 the property to be acquired by City it will be necessary that City 171 retain the services of a qualified real estate appraiser; and 181 WHEREAS, Appraiser has submitted a proposal to perform 191 necessary appraisal services for City; I 201 NOW, THEREFORE, the parties agree as follows: i 211 1. The work described in items (a) and (b) above shall 4; be completed and the reports called for delivered to City on or I 51 before December 10, 1967. 611 3. Appraiser shall be compensated on the basis of the Iii following hourly rates following his submission to the City of an 8! itemized statement or statements: 91 Appraiser's time: $30.00 per hour Primary Associate's time: 17.50 per hour 101 Secondary Associate's time: 12.50 per hour 111 It is further provided that the maximum fee to be charged City for 121 items (a) and (b) shall not exceed $5,000. At any time prior to 13 the completion of the work, upon request of City, Appraiser shall 14 I cease work, in which event his compensation shall be based on the 151 time expended up to the date when he was requested to cease work. 16 4. When requested to do so, Appraiser agrees to appear 17 in court as an expert witness in any condemnation case involving 181. the above described property and to assist City's legal counsel in 191 preparing any such condemnation case for trial. APPRAISAL SERVICES_.IN_ CONNECTION ..WITH_.THE..ACQUISITION.OF RIGHT OF WAY..ON 32ND STREET.FROU- NEWPORT BOULEVARD TO BALBOA BOULEVARD RECOMMENDATION: Authorize the City Manager to execute an agreement with George Hamilton Jones, MAI, for appraisal services on 32nd Street subject to the approval of the City Attorney DISCUSSION: Preliminary information received from the consulting engineer preparing the traffic study for the peninsula, shows that 32nd Street between Newport and Balboa Boulevards will require widening to four lanes in the near future. This will require the acquisition of 26 parcels along the southeasterly side of 32nd Street. Funds are included in the approved Fiscal Year 1967 -68 budget to obtain appraisals of the properties to be acquired and to acquire one parcel of the needed right of way. A proposal has been received from George Hamilton Jones, MAI, Real Estate Appraiser, to provide the necessary services. Initially, this would include a pre- liminary analysis of the market value of the parcels in question, including a range of the severance damages to be encountered if lots are split. This information is necessary to assist the City in deciding whether it will be more economical to split the lots or to acquire the total parcels. Also included would be a comprehensive appraisal of one parcel. The maxi- mum total fee for the above work would be $5,000.00. This fee is governed to a considerable extent by the work which will be required to ascertain the severance damages. The majority of the structures are apartments, some two story, and a thorough analysis will be needed before a reasonable determination which would be accepted by the courts can be obtained. As funds become available to acquire additional parcels, comprehensive reports on each will be required. These reports will be provided at a maximum total fee of $4,500.00 for the additional 25 parcels. This maximum fee is based on the assumption that the final comprehensive reports would not be requested for up to two years. In that case some of the market data information acquired during L • • To: City Council Page 2 preparation of the preliminary report would no longer be valid and would have to be reworked. If early acquisition.of.the properties involved can be budgeted, the total appraisal fees would probably be reduced. It should be noted that the fees quoted above are maximum figures, and as such, contain the appraiser's con- tingency factor. Mr. Jones, whose office is in Newport Beach, is one of the outstanding condemnation appraisers in Southern California.
