IN ADDITION THERETO IT IS HEREBY AGREED AS FOLLOWS, TO WIT:
First: That the lessee shall pay the lessor said rent in the manner hereinbefore specified, and shall not let or
underlet the whole or any part of said premises, nor sell or assign this lease, either voluntarily or by operation of low,
nor allow said property to be occupied by anyone contrary to the terms hereof, without the written consent of the lessor;
Second: That should said rent be not paid when due or should the lessee default in any of the covenants or
conditions contained herein, the lessor, or his representative or agent, may re -enter said premises and remove all
persons therefrom;
Third: That the lessee shall occupy said demised premises and shall keep the same in good condition, including
such improvements as may be made thereon hereafter, the usual wear and tear and damage by the elements excepted,
and shall not make any alterations thereon without the written consent of the lessor and shall not commit or suffer to be
committed any waste upon said premises;
Fourth: That said premises shall notke used by the lessee, nor anyone else, during the term hereof or any exten-
sion thereof, for the sale of any intoxicatingiliquors, nor for any illegal or immoral purpose, and that possession of said
premises by the lessee or his successors or assigns shall not be construed as conveying any title thereto or ownership

Fifth: That all Governmental laws and ordinances shall be complied with by the lessee;
Sixth: That the lessee waives all rights under Section 1942 of the Civil Code of California and releases the lessor

This agreement is entered into this 2312� day of ,
1968, by and between the CITY OF NEW ( 7. BEACH, ftereinatter
referred to as "City ", and.MR. FRANCIS J. HORVATH, Realtor,
hereinafter referred -to as "Realtor ".
BACKGROUND DATA:
1. City has commenced action on a public works pro-
ject to widen 32nd Street in the City of Newport Beach, which
project will require the acquisition of several parcels of real
property on 32nd Street and the subsequent removal of improve-
ments located thereon.
2. Actual construction of the new street will not be
commenced for approximately two years from this date.
3. City anticipates acquiring many of the properties
for this project before the actual construction date and as
these properties are deemed to be in good condition for continued
occupancy, City desires to rent the premises which it will acquire
so as to realize income.
SERVICES TO BE RENDERED BY REALTOR:
City employs Realtor to furnish services hereinafter mentioned
at and for the compensation stipulated:
1. Obtain tenants to occupy all premises.
2. Prepare premises for occupancy prior to renting.
3. Inspect premises at the time any tenant vacates.
4. Itemize all damages inflicted by any tenant and
advise City immediately.

5. Collect all rent monies.

6. Maintain all rent monies collected in a
trust account with an itemized account-
ing of all collections.
7. Disburse all funds to City for rentals no
later than the 10th day of each month.
8. Arrange for all necessary repairs to the
rental properties. All repairs in excess
of $25.00 must receive the prior written
approval of City Public Works Director.
9. Make periodic inspections of all property
to insure general satisfactory care and
maintenance by the tenants.
GENERAL PROVISIONS:
1. This agreement shall continue in force until
such time as the City has removed the improvements upon the
last parcel of property pursuant to the street widening pro-
ject. City shall have the right to terminate this agreement
upon presenting written notice thereof to Realtor.
2. This agreement may be amended or modified only
by written agreements signed by both parties.
3. Realtor hereby agrees to, and shall, hold City,
its elective and appointed boards, commissions, officers,
agents and employees, harmless from any liability for damage
or claims for damage, for personal injury, including death,
as well as from claims for property damage which may arise
from Realtor's operations under this agreement, whether such
operations be by Realtor or by any one or more persons directly
or indirectly employed by or acting as agent for Realtor.
COMPENSATION:
For services rendered, Realtor shall receive as compensation a
fee equal to ten percent (10%) of the rental monies actually
collected in any month. Said fee shall be deducted from the

We are returning the original agreement for property management
services with Francis J. Horvath, which has been approved by the
City Attorney as to form and is ready for execution by the City
Manager.
When the individual lease agreements for the 32nd Street properties
are presented by Mr. Horvath, it would be in order for the City
Manager to execute them on behalf of the City.
