TO BALBOA BOULEVARD, AND FOR THE 32ND STREET AND SEASHORE DRIVE EXTENSIONS
WESTERLY OF BALBOA BOULEVARD
RECOMMENDATIONS:
1. Authorize modification of the 32nd Street widening project to also
include design of the 32nd Street and Seashore Drive extensions
westerly of Balboa Boulevard.
2. Adopt a resolution authorizing the Mayor and the City Clerk to
execute an agreement with Shuirman- Simpson Civil Engineers for
the subject engineering services.
DISCUSSION:
Included in the current budget is a project for the widening of 32nd Street
from Newport Boulevard to Balboa Boulevard; this project provides for preparation of
the plans by a private engineer. An additional project for the extension of 32nd Street
westerly of Balboa Boulevard and for the extension of Seashore Drive to 32nd Street is
tentatively scheduled for the 1971 -72 fiscal year.
In order to coordinate design features such as the establishment of grades
for drainage, and for over -all economy, it would be desirable to combine the design of
both projects in a single engineering services agreement. (The current project includes
the construction of intersection improvements on the westerly side of Balboa Boulevard
so as to enable the construction of the traffic signal facilities in their ultimate
location.)
A proposal has been received from Shuirman - Simpson, Civil Engineers, to perform
the engineering services. This firm is well qualified to perform work of the type
required, and has satisfactorily ,completed consulting civil engineering services for the
city in the past.
Compensation will be at their standard hourly rates with a guaranteed maximum
fee of $12,500, plus an estimated amount of $600 for the actual cost of reproducing plans
and preparing an aerial photograph. This fee falls within the schedule recommended by
the American Society of Civil. Engineers for work of the type involved.
Funding will be as follows:

The cost of the design work for the current project, estimated to be $9,200,
is eligible for 50% financing with County Arterial Highway Financing Program (AHFP)
funds; the other 50% and the remaining cost will be financed with Gas Tax Funds. Current
estimates indicate that adequate funding is available in the present appropriation.
Plans for the two projects will be prepared
separate bidding. Construction of the current project
commenced in January, 1971.

CONTRACT FOR ENGINEERING SERVICES
(Improvement of 32nd Street
and Seashore Drive)
THIS CONTRACT is made and entered into this,'AO711
day of oTU Q 1970, by and between the CITY OF NEWPORT
BEACH, a municipal corporation, herein referred to as "City ",
and SHUIRMAN- SIMPSON, a civil engineering consulting firm,herein
referred to as "Engineer ".
RECITALS:
1. The City intends to undertake a Public Works
project for the widening of 32nd Street from Newport Boulevard
to Balboa Boulevard and for the 32nd Street and Seashore Drive
extension westerly of Balboa Boulevard and the installation of
a traffic signal at Balboa Boulevard and 32nd Street.
2. Engineer has submitted a proposal to City to
perform certain engineering services in connection with said
project which City desires to accept.
AGREEMENT:
1. General
City •engages Engineer to perform the services
hereinafter described for the pompensation herein stated and
Engineer agrees to perform said services upon the terms
hereinafter set forth.
2. Services to be Performed by Engineer
The Engineer shall:
(a) Prepare construction drawings to an appropriate
scale for all street, drainage, street lighting, traffic
signal, and other incidental and related improvements..

(b) Prepare supplementary special provisions.
(c) Prepare detailed cost estimates.
(d) Design field surveys.
(e) Coordinate with the public utility companies.
(f) Periodically observe work in progress and provide
general consultation during construction.
(g) Prepare drawing revisions necessary to resolve
field changes.
(h) Attend meetings and conferences as required.
3. Original drawings, reports, notes, maps and other
documents shall become the property of the City and may be
reproduced as deemed necessary by the Public Works Director.
4. City reserves the right to terminate this contract
at any time by giving Engineer three (3) days' prior written
notice in the United. States mails, postage prepaid, addressed
to any of Engineer's business offices. In the event that City
shall terminate this contract, it shall reimburse Engineer on
the basis of its standard fee schedule contained in its proposal
dated July 15, 1970.
5. All engineering services for the project as set
forth in paragraph 2 of this agreement shall be completed to
the satisfaction of the Public Works Director of City within
ninety (90) calendar days following authorization by City to
proceed.
6. In consideration of the performance of the above
described engineering services, City agrees to pay Engineer an
amount based upon the standard fee schedule contained in
Engineer's proposal dated July 15, 1970, but in no event shall

said amount be greater than $12,500. The amount to be paid to
Engineer shall be payable as follows:
(a) Monthly partial payments, each payment to be
the amount earned as determined by the fee schedule. The
sum of the monthly partial payments shall not exceed
ninety percent (90%) of the above maximum fee. The
aerial photo map and printing beyond that necessary for
the preparation of the drawings will.: be invoiced at
cost.
(b) The balance of the total amount to be paid
upon acceptance of the construction work by the City
Council, but in no event not later than twelve (12)
months after the Public Works Director signs the plans.
In addition, City shall reimburse Engineer
for the actual cost of reproduction of copies of said
plans, specifications and related documents, and filing
fees, checking fees and other related costs authorized
by the Public Works Director and advanced by Engineer.
7. The scope of the project may be changed and the
maximum fee increased upon prior written approval of the Public
Works Director.
8. Engineer shall indemnify and save harmless the
