SUBJECT: PROPOSAL FOR OPENING OF BAYSHORES COMMUNITY ENTRANCE GATE AT
MARINO DRIVE
RECOMMENDATION:
Receive and file report. No further action is required.
DISCUSSION:
Situation. At the February 26, 1973, City Council meeting, a Harbor Permit
was approved for the complete reconstruction of the Bayshores Marina. Mr.
Frank James of 2841 Bayshore Drive appeared before the City Council during
the public hearing and proposed that an entrance drive on Pacific Coast Highway
into the Bayshores Community at Marino Drive, which is now closed, be ordered
opened for the following reasons:
1. Intersection congestion at the present Bayshores entrance at the
Dover Drive /Pacific Coast Highway /Bayshore Drive intersection would be relieved;
2. Construction equipment in Bayshores during the Marina redevelopment
could be more equitably dispersed throughout the tract rather than relying solely
on Bayshore Drive for access.
The staff was instructed to report back in 30 days on Mr. James'pro-
posals.
Cit Staff Traffic Affairs Committee. The Traffic Affairs Committee met with
Mr. James on February 27 and witR Mr. W. Stephen Smith, III, Director of Property
Management for the Irvine Company, on March 6. The Committee also consulted by
telephone with Mr. Burr Sherick, President of the Bayshores Community Association.
These are the findings of the Committee from our investigation:
1. Bayshores is a private community without public streets. It is
improbable, therefore, that the opening or closing of the Marino Drive access
gate is within the City's jurisdiction.
2. Residents of the majority of the 251 single family lease hold
parcels within Bayshores are opposed to the opening of the Marino Gate. The
Committee inspected audited petitions circulated between September 28 and December
8, 1972, and signed by 126 lease hold representatives which stated that: "We, the
undersigned residents of Bayshores, are totally opposed to any attempt by the

Irvine Company or others to reopen in any manner that gate in Bayshores known
as the 'back gate'."
3. The Committee also inspected a petition circulated by Mr. James
in June 1972 which was signed by only 18 lessees asking "your immediate considera-
tion of the reopening of the Marino Gate ".
4. It would be possible to utilize Marino as an exit only, but it does
not appear that even this limited use is supported by a majority of lease holders.
Approximately three years ago a near majority of residents voted to ask that the
gate be closed on weekends and evenings and the gate was eventually left closed
continuously.
5. Bayshores Community Association, Inc. has just been established on
February 28, 1973, and will receive custody of the street system, beach, and
other lessor -owned community facilities within Bayshores. The lessor is now also
offering all lessees an opportunity to purchase the fee interest in their building
lot if they so wish. Mr. Smith is serving as interim Corporation President.
Community Association membership and dues payment will become mandatory for
community residents. Since the Corporation may now be legally recognized as the
custodian of the street system, the gate opening should be considered only upon
the request of the Corporation.
6. As an element in the City's overall transportation plan study, it
has been suggested that it may be advisable to consolidate.the Bayshores Community
and Balboa Bay Club entrances into a common signalized access point off Pacific
Coast Highway westerly of Dover Drive. Such an action would serve to relieve the
badly congested Dover Drive /Pacific Coast Highway / Bayshore Drive intersection.
This would be a major undertaking, however, and the merits of the proposal are
well beyond the capability of the City Staff Traffic Affairs Committee to analyze.
CONCLUSION:
The City Staff Traffic Affairs Committee recommends that no further
action be taken on the Marino Drive opening question until such time as Bayshores
Community Association, Inc., the legally recognized custodian of the Community's
private street system, may request that the opening be given further study.

GENTLEMEN:
Since the Bayshore Marina was originally built the West gate
(Marino Dr.) showing ingress and egress as shown on the Tract
Map (Exhibit "A) has been permanently closed.
This Tract Map provides for ingress and egress at two locations
namely the said Marino Drive gate on the West end of Bayshores
and the East gate located at the intersection of Bayshore Dr,
Pacific Coast Highway, Dover Dr., and the back bay bridge.
Your attention is called to the already "near critical level"
of traffic at the aforesaid intersection (Newspaper article
dated August 17,1972 pertaining to Mr.Jaffe's figures of 63,000
cars per day, 2,300 cars every hour during peak periods of the
day over the Coast Highway bridge) Exhibit "B"
Pictures marked Exhibit "C" and "D" were taken in January
showing traffic coming out of the Bayshore Drive gate heading
North andl4.st across Coast Highway and slowing traffic coming
south out of Dover Drive and trying to turn East over the bridge
being slowed up and resulting in cars being backed up as far as
can be seen on Dover Drive.

results in congestion and slow -up at the Dover Drive /Bayshore
intersection.
At present there are some 251 homes in Bayshores with many owners
using two cars or more, their guests, commercial vehicles plus
traffic to the present Bayshores Marina and also at this inter-
section the added load of Swales Anchorage and the Anchorage
Apartments.
It is approximately 750 feet from the West end (Marino Ave gate)
to the Bayshores Marina and approximately 2150 feet or apx.,4 /lOths
of a mile from the marina to the East (Bayshore Drive gate) which
traffic in summer passes the congested area of the " beach " on
Bayshore Drive.
In order to relieve some of the traffic at this intersection of
the East gate (Bayshore Drive) it is requested that the approval
of this Marina and additional homes be contingent upon the opening
of the West (Marino gate) as provided for in the TRACT MAP,
