FICKER, A.I.A., hereinafter referred to as "Architect "; WHEREAS, Owner desires to contract with Architect for the services hereinafter described; and WHEREAS, Architect is willing to perform said services on the following terms and conditions and for the compensation hereinafter set forth; NOW, THEREFORE, the parties agree as follows: to Architect agrees to provide his professional services to accomplish the following work which is hereinafter referred to as the "project ". a. Construct an addition of approximately 2000 square feet in area to the existing Corona del Mar Branch Library building at 420 Marigold Avenue. b. Make certain alterations in the existing Corona del Mar Branch Library building. c. Develop the total Corona del Mar Branch Library site for use in conjunction with the new structure and revision. (This phase of the Architect °s services shall not include landscaping or a sprinkler system.) 2. The Architect's basic services shall consist of the five (5) phases hereinafter described and include normal structural, mechanical and electrical engineering services. a. Schematic Design Phase (1) The Architect shall consult with the Owner to ascertain the requirements of the project and shall confirm such requirements to the Owner. (2) The Architect shall prepare Schematic Design Studies consisting of drawings and other documents illus- trating the scale and relationship of project components for approval by the Owner. (3) The Architect shall submit to the Owner a Statement of Probable Construction Cost based on current area, volume or other unit costs. b. Design Development Phase (1) The Architect shall prepare from the approved Schematic Design Studies, for approval by the Owner, the Design Development Documents consisting of drawings and other documents to fix and describe the size and character of the entire project as to structural, mechanical and electrical systems, materials and such other essentials as may be appropriate. (2) The Architect shall submit to the Owner a further Statement of Probable Construction Cost. c. Construction Documents Phase (1) The Architect shall prepare from the approved Design Development Documents, for approval by the Owner, 2. t A � Working Drawings and Specifications setting forth in detail the requirements for the construction of the entire project including the necessary bidding informa- tion, and shall assist in the preparation of bidding forms, the Conditions of the Contract, and the form of Agreement between the Owner and the Contractor. (2) The Architect shall advise the Owner of any adjustments to previous Statements of Probable Con- struction Cost indicated by changes in requirements or general market conditions. (3) The Architect shall assist the Owner in filing the required documents for the approval of governmental authorities having jurisdiction over the project. do Bidding or Negotiation Phase (1) The Architect, following the Owner's approval of the Construction Documents and of the latest Statement of Probable Construction Cost, shall assist the Owner in obtaining bids or negotiated pro- posals, and in awarding and preparing construction contracts. e. Construction Phase Administration of the Construction Contract (1) The Construction Phase will commence with the award of the Construction Contract and will termi- nate when final payment is made by the Owner to the Contractor. (2) The Architect shall provide Administration of the Construction Contract as set forth in Articles 1 through 14 inclusive of the General Conditions of the Contract for Construction, AIA Document A201, Tenth Edition, dated September, 1966, and the extent of his duties and responsibilities and the limitations of his 3. /w,", 0 0 authority as assigned thereunder shall not be modified without his written consent. (3) The Architect, as the representative of the Owner during the Construction Phase, shall advise and consult with the Owner and all of the Owner's instructions to the Contractor shall be issued through the Architect. The Architect shall have authority to act on behalf of the Owner to the extent provided in the General Conditions unless otherwise modified in writing. (4) The Architect shall at all times have access to the Work wherever it is in preparation or progress. (5) The Architect shall make periodic visits to the site to familiarize himself generally with the progress and quality of the Work and to determine in general if the Work is proceeding in accordance with the Contract Documents. On the basis of his on -site observations as an Architect, he shall endeavor to guard the Owner against defects and deficiencies in the Work of the Contractor. The Architect shall not be required to make exhaustive or continuous on -site inspections to check the quality or quantity of the Work. The Architect shall not be responsible for construction means, methods, techniques, sequences or procedures, or for safety precautions and programs in connection with the Work, and he shall not be responsible for the Contractor's failure to carry out the Work in accordance with the Contract Documents. (6) Based on such observations at the site and on the Contractor's Applications for Payment, the Archi- tect shall determine the amount owing to the Contractor and shall issue Certificates for Payment in such amounts. 4. !0'. 4 The issuance of a Certificate for Payment shall con- stitute a representation by the Architect to the Owner, based on the Architect's observations at the site as provided in Subparagraph (5) and on the data comprising the Application for Payment, that the Work has pro- gressed to the point indicated; that to the best of the Architect's knowledge, information and belief, the quality of the Work is in accordance with the Con- tract Documents (subject to an evaluation of the Work as a functioning whole upon Substantial Completion, to the results of any subsequent tests required by the Contract Documents, to minor deviations from the Con- tract Documents correctable prior to completion, and to any specific qualifications stated in the Certificate for Payment); and that the Contractor is entitled to payment in the amount certified By issuing a Certifi- cate for Payment, the Architect shall not be deemed to represent that he has made any examination to ascertain how and for what purpose the Contractor has used the moneys paid on account of the Contract Sum. (7) The Architect shall bey in the first instance, the interpreter of the requirements of the Con- tract Documents and the impartial judge of the performance thereunder by both the Owner and Contractor. The Archi- tect shall make decisions on all claims of the Owner or Contractor relating to the execution and progress of the Work and on all other matters or questions related thereto. The Architect's decisions in matters relating to artistic effect shall be final if consistent with the intent of the Contract Documents. (8) The Architect shall have authority to reject Work which does not conform to the Contract Documents. The Architect shall also have authority to require the 5e r � Contractor to stop the Work whenever in his reasonable opinion it may be necessary for the proper performance of the Contract. The Architect shall not be liable to the Owner for the consequences of any decision made by him in good faith either to exercise or not to exercise his authority to stop the Work. (9) The Architect shall review and approve shop drawings, samples, and other submissions of the Contractor only for conformance with the design con- cept of the project and for compliance with the infor- mation given in the Contract Documents. (10) The Architect shall prepare Change Orders. (11) The Architect shall conduct inspections to determine the Dates of Substantial Completion and Final Completion, shall receive written guarantees and related documents assembled by the Contractor, and shall issue a final Certificate for Payment. (12) The Architect shall not be responsible for the acts or omissions of the Contractor, or any Subcon- tractors, or any of the Contractor's or Subcontractor's agents or employees, or any other persons performing any of the Work. 4. ADDITIONAL SERVICES The following services shall be considered additional services and Owner agrees to compensate Architect for any such additional services upon an hourly basis at the rate of Twenty Dollars ($20.00) per hour for principal architects and Twelve Dollars ($12.00) per hour for other employees, subject to the condition that City shall not be liable to pay for any additional services unless such services have been authorized in writing by the Public Works Director. a. Providing special analyses of the Owner's needs, and programming the requirements of the project. 6. M b. Providing financial feasibility or other special studies. c. Providing Detailed Estimates of Construe- tion Costs. d. Providing consultation concerning replace- ment of any Work damaged by fire or other cause during construction, and furnishing professional services of the type set forth in Paragraph 3. as may be required in con- nection with the replacement of such Work. e. Providing professional services made neces- sary by the default of the Contractor in the performance of the Construction Contract. f. Furnishing the Owner a set of reproducible record prints of drawings showing significant changes made during the construction process, based on marked up prints, drawings and other data furnished by the Con- tractor to the Architect. g• Providing interior design and other services required for or in connection with the selection of furni- ture and furnishings. h• Providing services as an expert witness in connection with any public hearing, arbitration proceed- ing, or the proceedings of a court of record. io Providing services for planning tenant or rental spaces. 5. This agreement.may be terminated by either party upon five (5) days' written notice. In the event of termination by Owner without fault on the part of Architect it is agreed that Owner shall pay Architect for its actual services completed to the date of notice of termination on the basis of the hourly rates set forth in Paragraph 4. hereof, provided that Architect shall turn over to Owner all drawings, plans, memoranda and other written matter in Architect's possession relating to the project. 6. Ficker. 2, Adopt a resolution authorizing the Mayor and City Clerk to execute the agreement. 3. Approve a budget amendment in the amount of $3,000 for the architectural services, DISCUSSION: On December 12, 1967, the City Council authorized the staff to enter into an agreement with William P. Ficker for design of a relocatable 2,000 sq. ft. addition to the Corona del Mar Library, including preparation of site development plans. It was directed that the fee be paid from the Building Excise Tax-Fund and that the contract be approved by the City Council. Mr. Ficker has submitted a proposal in which he proposes to design the building and site improvements, and supervise the construction for the sum of $4,000, which is approximately 10% of the estimated construction contract cost. If the cost of the new building alterations to'existing building, site devel- opment, and architectural fee exceeds $45,000", the architect will be required to modify the plans and specifications at no cost to the City. The total cost of the project is estimated to be: Architect's fee $ 4,000 2,000 square foot addition 30,000 Alterations to existing building 6,000 Site development 5,000 Sub -total 7000 Plant Material and sprinklers for installation by City Forces 1,500 Furnishings and shelving 7,500 Total Cost $54,000 The $30,000 for the new building is in keeping with the estimated figure listed in the memorandum to the City Council for the Library Board, dated December 4, 1967. The proposal provides that 75% of the architect's fee is payable upon approval by the City of construction drawings and documents. The remaining 25% of the fee is for supervision of construction. Therefore, the amount of money to be appropriated at this time is $3,000. Upon completion of the plans, and depending on the availability of funds, the staff will recommend to the City Council whether to appropriate funds to construct a portion or all of the project in the current fiscal year,or to budget for its construction in the 1968 -69 fiscal year. Devlin Mr, Kenneth Perry President, Board of Library Trustees City Librarian City Manager Assistant City Manager Assistant City Attorney Public Works Director Assistant City Engineer The foiiowing points were discussed: 1, Mr. Hardacre announced that he had designated Mrs. Banning and Mrs. Sheely to work with the architect to establish the functional requirements of the project and suggest a general floor plan which would be suit- able. Mrs. Banning and Mrs. Sheely are authorized to speak for the Board of Library Trustees concerning technical requirements and spatial requirements during the preliminary design stages of the project. 2. The Public korks Department will administer the archi- tectural services contract, starting with the preparation of a contract by the City Attorney, securing approval of the contract by the architect, City Manager and the City Council, and then following through to completion of the pro ect.. 3. It was agreed by Mr. Hardacre and Mrs, Sheely that approximately two thousand square feet os additional space is required. Provision should be made for an office; a workroom; a restroom for the staff; and a small room used mainly for book display and shelf space, but which could be closed off by folding doors for group discussions. 1�Here possible, these special purpose rooms should be located in the new addition, 4. Shelves are not to be included in the architect's contract as it is intended to have them designed and installed under separate contract in accordance with the requirements established by the City Librarian. The staff and the architect will present an estimate to the City Council that will include the total cost for complete development of the library addition and site. The estimate will be broken into component parts so that if desired, the project may be built in stages, depending upon availability of funds. When the costs are known, a recommendation will be made to the City Council by the City Manager as to how much of the project can be built with available funds. 6. The Board of Library Trustees will be asked to approve the work at the end of the following stages: a.. Schematic design phase; b. Preliminary design phase; c= Construction drawings; d. Completion. 7. City Library Consultant, Harold L. Hamill, aptly summarized this fact in his July, 1967 report to the City: "The Corona del Mar Branch is a surprisingly busy small library. The present building was opened in 1959, and its 2100 square feet have become badly crowded and outgrown. The library is well located to serve the Corona del Mar community, bosh for the present and the future. It is on a site large enough to permit expansion . . . The branch's book collections and service potential are severely hampered by lack of space . There is little opportunity for readers to sit in the library and study in comfort both because of the lack of room for tables and chairs and because of the noise and confusion produced by crowded conditions. Workroom space is almost non - existent." The book capacity of this library is approximately 11,500, and the existing collection of over 17,000 volumes illustrates the space problem. With a book circulation now in excess of 115,000 per year, the library falls into the large branch category, as defined by the American Library Association. This branch now has an active registration of approximately 5,540 patrons. OF FLOOR AREA 2767.7 1907.6 Corona del May 111,764 2,100 sq. ft. 5322.1 When the Corona del Mar Branch was completed in 1959, the Corona del Mar area had a population of around 5,000. The population for this area is now more than 15,000. As the area is growing at a rate of approximately 2,000 per year, the use demand for the Corona del Mar Branch can be expected to grow in Ii ke manner. This is the only convenient facility available to serve the needs of residents in the new subdivisions and lands annexed to the City. In addition, the branch will continue to be increasingly used by the elementary and high school students who find that their schools lack adequate library facilities. High =" Mayor and City Coup`. Page 2 December 4, 1967 57 school students continue to fill the library to capacity during after - school hours, leaving no room for adult seating. In addition to individual student use, there are now 17 regularly scheduled classroom visits per month to this library. The most critical space needs are for a reference and children's reading area, office use, work space, storage, and a janitor's closet. It is anticipated that a building addition of approximately 2,000 square feet would satisfy the present and future needs of the Corona del Mar Branch. This analysis is based on the assumption that a main library facility will be constructed in conjunction with the proposed Civic Center Complex. After considering a variety of means of solving the Corona del Mar Library space problem, the Board of Library Trustees has concluded that a portable 2,000 square foot structure would best satisfy the need. By con- structing a relocatable building much like the addition to City Hall, maximum flexibility will be achieved. It will satisfy the immediate need for space and provide the City with a means of relocating this addition should experience reflect a substantial decline in the use of the Corona del Mar Branch once a new Main Library is in operation. As Mr. Hamill pointed out in his report, the present needs of the community cannot be met unless better housing of the library's functions is provided. In view of the present and predicted population of Corona del Mar, and the Civic Center planning, a reasonable expansion of the library would seem to be an addition of 2,000 square feet . This would permit book collection and service facilities to be increased within reasonable limits, but not to such an extent that the branch would become in any way a rival or duplication of the proposed new Main Library, a project of much greater magnitude." Although it was estimated in Mr. Hamill's report that the 2,000 square foot addition would likely cost around $44,000 to design and construct, the ability to satisfy the space needs with a relocatable addition precludes such an expendi- ture. It is now envisioned that the new addition can be constructed for $27,000 to $30,000. Recognizing that the Corona del Mar Library space shortage is critical now and that the use demand will continue to increase, the Board of Library Trustees respectfully urges the City Council to consider authorizing an immediate funding of monies necessary for this project. It is proposed that the library addition be financed either by savings realized on other capital improvement projects, the building excise tax fund, substitution for another funded capital improvement project, or by some combination of the above. This will allow for the project to be completed before the end of this fiscal year. It is envis- ioned that the furniture and equipment needed for this addition, likely to cost approximately $7,500, will not have to be budgeted until Fiscal Year 1968 -69. RECOMM2ENDATION: The Board of Library Trustees respectfully requests that the City Council allow the Board to meet and discuss this urgent matter further at the December 11, 1967 Study Session. �c iI n /��\ ROGER W. DISCUSSION: The contract for construction of the addition to the Corona del Mar Library has been completed to the satisfaction of the architect and of the City staff. A copy of a letter from the Architect, William P. Ficker, A.I.A., is attached for reference. The bid price was: Amount of change orders: Total contract cost: $35,175.00 1= Change Order No. 1, in the amount of $541.00, provided for panic hardware on the existing front door, two underground drains from the parking lots, and two additional foundation pads. This change order exceeded $500.00 and was approved by the Council on September 23, 1968. Change Order No. 2, in the amount of $154.00, provided for revisions to the charging desk in order to make it more functional and comfortable. Change Order No. 3, in the amount of $453.75, provided for the installation of planters with redwood headers along the masonry wall at the north side of the library property, and for grading and paving to eliminate an earthen drainage ditch beside the fire station. In addition to the above costs, the appropriations for the project are to finance the architect's fee of $4,114.87, the purchase of furniture and fixtures, and landscaping costs. The latter work has not yet been completed. DISCUSSION: The project in the 1968 -69 Capital Improvement Budget for the addition to the Corona del Mar Library inadvertently did not take into consideration the need for drapery materials. These are needed to diminish the glare from the afternoon sun as well as protect the books and carpeting in the new addition from the adverse effects of sunlight radiation. The Council- approved project provided for the building addition and some remodeling to the existing library structure, furnishings, carpeting and shelving, but did not provide for drapery materials. It is proposed that eleven panels of crater parchment flameproofed drapes be installed in conjunct- ion with this project. During the course of construction, certain savings have been realized as a result of the project costing less than the engineers' estimate. When the project is completed, there will be sufficient monies avail- able in the account to cover the cost of needed drapery materials. While this expenditure might normally not necessitate Council approval, since sufficient funds are available in the account, this does represent an item that was not specifically provided for in the contract and, therefore, prior Council approval is appropriate. It is recommended that Council authorization be given for the purchase of these drapes in order that they may be installed prior to the opening of the new addition. A Budget Amendment has been prepared which will authorize an intrafimd transfer of $905.00 in the Building Excise Tax Fund from the Corona del Mar Library addition account No. 27- 7097 -011 to the Corona del Mar Library addition furnishings account No. 27-7094 -016. The Board of Library Trustees met on July 16, 1968 and recommended that the contract be awarded to the low bidder. Even though the Board felt the building addition is critically needed, they could not justify the additional $1,677.00 cost by awarding to the third low bidder in order to secure earlier completion. Approve the Plans and Specifications. 2. Authorize the City Clerk to advertise for bids to be opened at 10:00 A.M., July 15, 1968. DISCUSSION: The estimated cost of the contract work is $39,550.00, not including carpeting or asphalt tile in public areas. The agreement with the architect pro- vides that he will receive an additional $1,000.00 for his services during the bidding and construction phases. Previously he has been paid $3,000.00 for services rendered, up to and including preparation of the contract documents. The proposed work consists of demolishing the existing residence between the library and fire station; constructing a new movable addition of 1,770 square feet enclosed under 2,221 square feet of roof; modifications to the existing building to include a new work room, combination librarian's office and study; new men's room; modification of the existing men's room for staff use; modification of the existing women's room; and painting of the exterior of the old building to tie it visually to the new addition.. Site work includes a new parking lot on both sides and to the rear of the building; and construction of a masonry wall between the parking lot and the resi- dence to the north. This wall was not considered in the estimate submitted to the City Council on February 13, 1968. The wall is required by Section 20.08.211 (B) of the Municipal Code. No furnishings are included in the contract work other than the charging desk. Landscaping, carpeting, shelving, window coverings and other furnishings will be done by the City under separate arrangements. DISCUSSION: The contract for construction of the addition to the Corona del Mar Library has been completed to the satisfaction of the architect and of the City staff. A copy of a letter from the Architect, William P. Ficker, A.I.A., is attached for reference. The bid price was: Amount of change orders: Total contract cost: $35,175,00 1,148.75 6, 23. Change Order No. 1, in the amount of $541.00, provided for panic hardware on the existing front door, two underground drains from the parking lots, and two additional foundation pads. This change order exceeded $500.00 and was approved by the Council on September 23, 1968. Change Order No. 2, in the amount of $154.00, provided for revisions to the charging desk in order to make it more functional and comfortable. Change Order No. 3, in the amount of $453.75, provided for the installation of planters with redwood headers along the masonry wall at the north side of the library property, and for grading and paving to eliminate an earthen drainage ditch beside the fire station. In addition to the above costs, the appropriations for the project are to finance the architect's fee of $4,114.87, the purchase of furniture and fixtures, and landscaping costs. The architect is sending a letter to the City Council recommending award of the contract to Gentosi Brothers. The Board of Library Trustees met on July 16, 1968 and recommended that the contract be awarded to the low bidder. Even though the Board felt the building addition is critically needed, they could not justify the additional $1,677.00-cost by awarding to the third low bidder in order to secure earlier completion. The items included in Change Order No. 1 are enumerated below. Items 1 and 2 have been required as a result of plan checking by the Building Department. Panic hardware is required to be installed on the existing main door to the library because of the increase in occupant load of the remodelled building. The two storm drain inlets will collect runoff from the building roof drains and parking lot, and discharge through cast iron pipes under the sidewalk to the street. Approve the Plans and Specifications. 2. Authorize the City Clerk to advertise for bids to be opened at 10:00 A.M., July 15, 1968. DISCUSSION: The estimated cost of the' 'contract work is $39,550.00, not including carpeting or asphalt tile in public areas. The agreement with the architect pro- vides that he will receive an additional $1,000.00 for his services during the bidding and construction phases. Previously-he has-been paid $3,000.00 for services rendered, up to and including preparation of the contract documents. The proposed work consists of demolishing the existing residence between the library and fire station; constructing a new movable addition of 1,770 square feet enclosed under 2,221 square feet of roof; modifications to the existing building to include a new work room, combination librarian's office and study; new men's room; modification of the existing men's room for staff use; modification of the existing women's room; and painting of the exterior of the old building to tie it visually to the new addition. Site work includes a new parking lot on both sides and to the rear of the building; and construction of a masonry wall.between the parking lot and the resi- dence to the north. This wall was not considered in the estimate submitted to the City Council on February 13, 1968. The wall is required by Section 20.08.211 (B) of the Municipal Code. No furnishings are included in the contract work other than the charging desk. Landscaping, carpeting, shelving, window coverings and other furnishings will be done by the City under separate arrangements. Approve a budget amendment in the amount of $3,000 for the architectural services. DISCUSSION: On December 12, 1967, the City Council authorized the'staff to enter into an agreement with William P. Ficker for design of a relocatable 2,000 sq. ft. addition to the Corona del Mar Library, including preparation of site development plans. It was directed that the fee be paid from the Building Excise Tax-Fund and that the contract be approved by the City Council. Mr. Ficker has submitted a proposal in which he proposes to design the building and site improvements, and supervise the construction for the'sum of $4,000, which is approximately 10% of the estimated construction,-contract cost. If the cost of the new building alterations for existing building, site devel- opment, and architectural-fee-exceeds $45;000; the architect will be required to modify the plans and specifications at no cost to the City. Therefore, the amount of money to be appropriated at this time is $3,000. At the time construction funds are-budgeted, the remaining 25% of the architect's fee will be included.
