HomeMy WebLinkAboutC-1164 - Beach erosion control project, Stage 2, 1968 (see also Historical Files in Box No. CC-26)I� ' 1 AGREEMENT FOR CONTRIBUTION OF COSTS BETWEEN 2 COUNTY OF ORANGE AND CITY OF NEWPORT BEACH BEACH EROSION CONTROL PROJECT, STAGE 2 3 4 5 THIS AGREEMENT is made and entered into this �. 6 �,�,[ �� � ,/ day of 1968, by and between the 7 COUNTY OF ORANGE, A political subdivision of the State of 8 California, hereinafter called "COUNTY" and the CITY OF i 9 NEWPORT BEACH, a municipal corporation, hereinafter called 10 "CITY". 11 WHEREAS, Congress has by the enactment of Public 12 ) Law 874, 87th Congress, adopted and authorized a beach 13 erosion control project which extends from Anaheim Bay Harbor W 14 to the West Jetty of Newport Beach Harbor in Orange County; oo 15 and au = 16 WHEREAS, the aforesaid project is financed on 9 17 the following basis: 18 Federal Government 67% 19 State of California (Depart- ment of Water Resources) 16k% I;' 20 Shoreline Owners both public i 21 and private, including State Division of Beaches and 22 Parks l6 kV 23 100% 24 and 25 WHEREAS, Phase 1 of the said project included the 26 placement of 4,000,000 yards of sand on the beaches in the I ' 27 vicinity of Surfside and Sunset Beach at a total of $2,159,000; 28 and 29 WHEREAS, the costs for Phase 1, payable by the i 30 shoreline owners, were allocated in accordance with a formula 31 whereby the owners of private beach paid their proportionate i 32 share and the owners of public beach paid 50% of their ISO:rp I i ..THS em 312u/6$ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 33 proportionate share with the COUNTY paying the remaining 50 %; and WHEREAS, Stage 2 Construction of the said project includes the construction of a 200 -foot groin at the exten- sion of 40th Street, Newport Beach, and the placement of 410,000 cubic yards of sand on the beaches adjacent to the groin at an estimated cost of $700,000; and WHEREAS, the COUNTY has advanced $75,075 as the share for all city and private shoreline owners for Stage 2 Construction, not including State Division of Beaches and Parks; and WHEREAS, the city and private shoreline owners' share of cost for Stage 2 Construction, based on the formula used for Phase 1, is as follows: Private beach owners: Huntington Pacific Corporation $21,320.00 Surfside Colony, Ltd. 39555.00 Public beach owners: City of Newport Beach 12,550.00 City of Huntington Beach 6,275.00 County Sunset Beach) 6,275.00 County 50% for locally owned public beach) 25,100.00 Total Advanced by COUNTY for Stage 2 Construction $75,075.00 and NOW, THEREFORE, the parties hereto mutually agree as follows: 1. The CITY agrees to pay the COUNTY after July 1, 1968 the sum of $12,550 which represents the CITY'S contribution towards the cost of Stage 2 of the aforesaid beach erosion control project. 2. The COUNTY agrees to furnish to the CITY an accounting of the expenditures of all funds received for Stage 2 of the aforesaid project, and to refund to the project, and to refund to the CITY its pro rata share of any refunds received of monies advanced in excess of actual costs within thirty (30) days after receipt thereof by the COUNTY. The County Auditor - Controller is authorized to administer the collection of said costs in accordance with the agreement,. This agreement has been reviewed by the City staff and is recommended for approval. The reimbursement formula is the same as that used for Phase I of the Beach Erosion Control Project. In order to expedite construction the County entered into an agreement with the State of California Department of Water Resources, and advanced $75,075 as the local shoreline owners' share of the $700,000 project cost. The local shoreline owners' share for Stage 1 Construction of the Federal project, completed in 1964, was reimbursed in accordance with a formula whereby the County paid 50 per cent of the pro -rata cost for the City - owned p blic beaches. The Cityls portion of the local shoreline owners$ pro -rat share for Stage 2 Construction, based on the formula, is $12,550. An agre ment for reimbursement to the County is forwarded herewith for approva and execution by your City Council.
