THS -mec 3/25/68 (Rev. 4/8/68) AGREEMENT FOR ECONOMIC CONSULTING SERVICES (Newport Beach Civic Center Site Evaluation and Master Planning Study) r e_Y6� THIS AGREEMENT is made and entered into this day of , 19689 by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "City ", and ECONOMICS RESEARCH ASSOCIATES, hereinafter referred to as "ERA "o RECITALS- The City. Council and administrative staff a:y engaged in a study to determine the most suitable site for a new Civic Center. The firm of Welton Becket and Associates has been re- tained by the City to furnish the professional architectural and engineering services necessary to enable the City Council to evaluate the alternate sites and to make an informed decision as to the best site for the City °s purposes. The City Council has decided to retain the firm of Economics Research Associates to assist Welton Becket and Associates by performing research, par- ticularly in the economic field. NOW, THEREFORE, the parties agree as follows- I. SERVICES TO BE PROVIDED. ERA agrees to furnish the following professional services- A. Site Evaluation. to In cooperation with Welton Becket and Associates to make a detailed economic analysis and site disposition study of the following three potential Civic Center sites- a. The existing City Hall site, hereinafter referred to as Site A. This study shall not include any consideration of the acquisition of property surrounding Site A. b. The site westerly of Jamboree Road and southerly of the future extension of Santa Barbara Drive, hereinafter referred to as Site B. C. The site north of Coast Highway and west of MacArthur Boulevard in Newport Center, herein- after referred to as Site C. The study shall take into consideration the physical space and potential facilities to be included in the Civic Center. Each of the sites studied will be evaluated accord- ing to its physical capacity to accommodate the uses projected with careful consideration of the effect of the anticipated future growth of the City. Cost analyses will be performed covering all major aspects of the study. The study will include, but will not necessarily be limited to, the following research tasks: a. Analysis of current and projected growth patterns of the City of Newport Beach. Growth fore- casts prepared by the City's planning staff will be studied and, where appropriate, these will be modi- fied. The effect of differences in forecasts on space planning for the Civic Center will be measured. b. Evaluation of alternative sites in terms of compatibility of the Civic Center and existing or planned surrounding land uses. This will be based on the experience of other civic centers and on analy- sis of the functional relationships between civic center uses and other activities. The Irvine Company °s plans for development surrounding the alternative sites will be explored in detail. C. Measurement of the physical capacity of each alternative site to accommodate civic center and other uses, such as the chamber of commerce, school adminis- trative offices, a county court annex, cultural facil- ities, and other suitable uses. Included will be an analysis of the effect of the Civic Center on adjoining 2. property in terms of changes in land value and the general environment, d. Analysis of the accessibility of each alternative site and evaluation of freeway and local street access as it would affect a civic center complex, e, Analysis of the expansibility of the present civic center sites including study of the costs of pro- ceeding with high - density development, acquisition of additional nearby property, and continuing use of present facilities and leasing additional space. In this regard, local office space rental rates will be re- viewed, fo Analysis of the effect of relocating the pres- ent City Hall and police facilities on land surrounding the existing civic center in the event a decision is made to build the center elsewhere. Specifically, as- sessment will be made of the impact on businesses in the area resulting from moving the civic center. go Analysis of the most economical use of the present civic center. This highest and best use study will culminate in an estimated re -use value for the prop- erty. While not representing a formal appraisal, value assigned to the property will be based on income- producing capacity of the site's highest and best use. ho Financial analysis of development expenses involved in site acquisition, provision of utility ser- vices, costs of construction, and maintenance. This will be done in conjunction with Welton Becket and Associates. ie In collaboration with Welton Becket and Asso- ciates., to provide assistance in promoting site selection through preparation of a summary report and exhibits, J. Appearances as necessary for conferences with the City Council and the City Council Building Committee during the course of the study. After the presentation scheduled in paragraph B below, ERA staff will remain on call for additional meetings or presentations at per diem or hourly rates. B. Report and Presentation. Upon completion of the services described in paragraph A above, ERA shall, in concert with Welton Becket and Associates, prepare a comprehensive written report evaluating the sites studied and recommending the site which ERA and Welton Becket and Associates jointly agree should be utilized as the site for the proposed Civic Center. The City shall be furnished 25 copies of said report. ERA further agrees to make an oral presentation before the City Council in conjunction with representatives of Welton Becket and Associates. II. PAYMENT FOR SERVICES. A. Amount of Payment, City agrees to pay ERA for its services on a monthly basis upon submission of itemized bills. The maximum cost to City, including expenses and all reimbursables, shall not exceed the sum of $9,000. ERA's fee shall be computed at the rate of 2.3 times its payroll costs. B. Reimbursements. City agrees to reimburse ERA for the following expenses in addition to the compensation for services set forth in paragraph A above: 1. Blueprinting and photographic process repro- ductions other than blueprints or reproductions used solely for ERA's internal needs. 2. Transportation and living expense incurred beyond a 50 -mile radius of ERA's Los Angeles office; 4. such expenses shall not exceed a maximum of $30 per day per employee. 3. Long distance telephone and telegraph charges, not including such charges incurred for communication between ERA's Los Angeles office and the City of Newport Beach. 4. Photographs and maps, if purchased by ERA, 5. Costs incurred in the preparation of brochures or other special promotional materials ordered by City. City agrees to pay ERA for reimbursables upon sub- mission of itemized statements at 30 -day intervals. III. TIME OF COMPLETION, ERA agrees to complete all of the services described in this agreement within 40 days from the date of execution of this agreement by City> IV. TERMINATION OR ABANDONMENT OF AGREEMENT. At any time prior to the completion of the services provided for in this agreement, City may on three days' prior written notice to ERA terminate this agreement. In the event of termination by City without fault on the part of ERA, it is agreed that City shall pay ERA for its services completed and all reimbursable costs incurred to the date of notice of termi- nation. V. ASSIGNMENT. This agreement shall not be assigned by ERA without the written consent of City. VI. MATERIAL TO BE FURNISHED CITY. In the event this agreement is terminated, or upon com- pletion of the work, ERA agrees to furnish to City copies of all memoranda, correspondence, computations and study materials 5. in its files pertaining to the work described in this agreement which City requests. Peach, C:Jiforn.i.a Doa.r Mr. 1\4a.ycr: March 19, 1968 �D/IS�PO� SI �6P) Proposal 'No. 2027 -R2 As a result Of a mc:ai.ng held Monday, January 15, 1968 with representatives of the City of Newport Leach and subsequent conversations with Welton Beckc;t and Associates, Economics Research Associates is pleased to submit this proposal relevant to assisting the city in selecting an optimum) location for the Newport Peach civic center, It is our under- standing that the city wants a detailed economic analysis and site disposi- tion study to be made of three alternative civic: center locations in Newport Leach: (1) the existing city hall site and its surrounding area; (2) a site north of Pacific Coast Highway and west of MacArthur Boulevard in Newport Center; and (3) a site west of Jamboree Road and south of the future extension of Santa Barbara Drive on the peninsula south of The Bluffs, The fundamental. objective of the study will be to supply the City of Newport Beach with a definitive site location and financial analysis that will afford determination of the optimum location for the civic center. The study will tale into account the physical. space and potential facilities to be included in the civic center. Each alternative site will be evaluated according to its physical capacity to accommodate the uses projected. Detailed attention will be given to the future growth of Newport Beach, the compatibility of existing and planned land uses surrounding each alternative site, the case of access and circulation factors affecting travel to and from the various sites, and the econonii.cs of site acquisition. Care- ful cost analyses will be performed covering all. major aspects of the study. In collaboration with the architect, provision of assistance in promoting site selection through preparation of a summary report and exhibits. This will be in addition to a comprehensive final report that can be utilized or circulated by the city in joint city - consultant presentations to citizens and community organizations. METHOD OF APPROACH In conducting the research, E.R.A. will make a thorough review of pertinent published data. However, research emphasis will be place on development of necessary primary data, and field surveys will be cou- ductcd in this regard. During the course of the study the client will be kept informed of research progress, and close liaison will be maintained among the E. R. A. project team, the planning consultant, and Newport Beach city officials. TIMF, AND COST The study will. run concurrent: with the time schedule and require- ments of the planner- architect as approved by the City of Newport Beach. Costs will not exceed $9, 000 for professional staff time and all travel and miscellaneous expense. Billings will be submitted monthly as costs are incurred. This budget allows for one major public presentation. Require- ments for additional presentations will be fulfilled at unit hour or per diem costs, as appropriate. Twenty -five copies of our report sumrnarizing study findings and recommendations will be submitted in combination with the work of the planner- architect.
