IN RE: NOTICE OF COMPLETION NEWPORT AVENUE AND MAIN STREET RELOCATION OF IRRIGATION FACILITIES SANTA ANA VALLEY CONTRACTORS, CONTRACTOR On motion of Supervisor Baker, duly seconded and unanimously carried, the letter from the Road Commissioner and County Surveyor stating that the contract for relocation of irrigation facilities at Newport Avenue and Main Street, with Santa Ana Valley Contractors, Contractor, has been satisfactorily completed on March 19, 1969, is received and ordered filed and the work accepted. The Chairman and the Clerk are authorized to sign the notice of completion. IN RE: AGREEMENT ARTERIAL HIGHWAY FINANCING PROGRAM PROJECT CITY OF NEWPORT BEACH On motion of Supervisor Allen, duly seconded and unanimously carried, the Chairman and the Clerk are authorized to sign the Arterial Highway Financing Program Project Agreement, dated April 1, 1969, between the County of Orange and the City of Newport Beach, for the improvement of Westeliff Drive, from Irvine Avenue to Dover Drive, Project No. 483. Irvine Avenue to Dover Drive WITNESSETH• MEMORANDUM OF AGREEME e�n'te�' red into this 1-.,el e day of �'6�' 19 by and between: CITY OF NEWPORT BE&CH a municipal corporation, hereinafter referred to as the City, and COUNTY OF ORANGE, a political subdivision of the State of California, hereinafter referred to as the County. WHEREAS, the Board of Supervisors by Resolution of May 31, 1956 adopted the Master Plan of Arterial Highways to serve the entire County including the incorporated cities thereof, and WHEREAS, Article 2 and 3 of Chapter 9, Division 2 of the Streets and Highways Code authorize a county if it so desires to expend funds apportioned to it out of the California Highway Users Tax Fund for aid to cities and in the improvement, construction, or repair of streets within a city, and WHEREAS, the Orange County Board of Supervisors and the Orange County Division of the League. of California Cities have agreed upon a cooperative financial program for the establishment, construction and maintenance of a County Arterial Highway System known as the Arterial Highway Financing Program, and WHEREAS, the Board of Supervisors has, by appropriate action, provided in the budget of the Special Road Improvement Fund for the Fiscal Year 1968 -69 funds for the improvement of streets within the incorporated cities of the County, which streets are a part of the County's Master Plan of Arterial Highways, and WHEREAS, the Board of Supervisors on November 5, 1958 has by formal resolution adopted the formal procedure for the administration of the Arterial Highway Financing Program, which procedure is outlined in a document on file with the county Clerk, formally known as the County of Orange Arterial Highway Financing Program Procedure Manual, and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 r„e.i, 0 WHEREAS, it is mutually agreed between the parties that Westcliff Drive, between Irvine Avenue and Dover Drive, a street included in the Orange County Master Plan of Arterial Highways, is a street of general County interest and should be improved in accord: ance with the policies of the Arterial Highway Financing Program. Said work of such improvement shall be referred to hereinafter as the Project. NOW, THEREFORE, IT IS AGREED by the parties hereto as follows: 1. The procedures outlined in the Arterial Highway Financing Program Procedure Manual herein referred to shall be made a part of this agreement. 2. The Contracting Authority for the Project is hereby designated as the City 3. The Project Engineer for the Project is hereby designated as the City 4. The Construction Engineer for the Project is hereby designated as the City 5. All soils engineering and material and construction testing neces- sary for the Project shall be performed by the County. This shall include preliminary soils investigations, structure foundation investigations, recommendations for structural sections and compaction requirements, and quality control of materials and construction. 6. The work shall be subject at all times to inspection by the authorized representatives of both parties. 7. Funds to be used for the Project: (a) The estimated cost of the Project covered by this agreement is: DESIGN ENGINEERING: $5,000 RIGHT OF WAY ACQUISITIOI�106,000 CONSTRUCTION CONTRACT: $5 000 CONSTRUCTION ENGINEERING: ' TOTAL: $116,000 -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 W4.>12 1J 0 (b) on the basis of the above estimate, this Project will be financed as follows: COUNTY FUNDS: $58.000 CITY FUNDS: $580000 TOTAL: $116,000 (c) Final adjustments of Project costs will be made on the.basis of the County 50 percent, the City S0 percent on eligible items in the Contract. (d) Final adjustments of project storm drain costs will be made on the basis of matching funds up to a maximum of fifty percent (50 %) of the total cost of eligible items; that is, County participation shall not exceed a maximum of twenty - five percent (25 %) of the total cost of eligible storm drain construction. (e) It is the intent of the parties hereto to comply with all applicable rules regarding the expenditure of State Gas Tax Funds. Eligibility of any storm drain item will be subject to final audit and determination by the State Controller's Office. Any future adjustment required by said Controller's office shall be made by the City with City funds, including complete refund to the County of any County gas tax funds declared by the Controller to have been expended on ineligible construction. (f) Any funds spent prior to Marcn 1. 1700 shall not be considered in the final accounting of this Project. S. County -wide extension of ` Aterial System: To promote uniformity of County Arterial Highway System with City Master Plan of Major Streets, both parties agree to:continue the promulgation of the A.H.F.P, as outlined in the aforementioned Procedure Manual. IN WITNESS WHEREOF, City has caused this agreement to be executed by.its Mayor and attested by its Clerk, and.County has caused this agreement to be executed by the Chairman of its Board of Supervisors and attested by its Clerk on the dates written opposite their signa- tures, all thereunto duly authorized, by the City Council and the Board of Supervisors, respectively. Improvements as shown on the contract drawings and described in the contract specifications exist within the existing right of way but will not interfere with construction. In making this certification, the City of Newport Beach agrees to hold the County harmless from any liability which may arise by reason of the County's reliance upon this certificate and its use of said rights of way. Irvine Avenue to Dover Drive. Execution of this agreement was authorized by the City Council at its regular meeting on March 24 by the adoption of Resolution No. 6985. Also attached are the original and two copies of Right of Way Certification and a certified copy of the revolution. After execution by the County, please return a signed copy of the Agreement to this office. Adopt a resolution authorizing the Mayor and the City Clerk to execute the Arterial Highway Financing Program (AHFP) Agreement for the subject project. 2. Adopt a minute action authorizing the Mayor and City Clerk to execute a Right of Way Certification for the subject project. DISCUSSION: On February 24, 1969 the Council adopted Resolution No. 6938 requesting the County of Orange to include within the AHFP the subject project. The County of Orange has subsequently approved the project and authorized funding in the amount of $58,000. The project includes the reconstruction of Westcliff Drive, the construction of curbed medians, a storm drain system, and the installation of a traffic signal at Westcliff Drive and Dover Drive. AHFP participation will pay for approximately 50% of the cost of reconstructing the paving in Westcliff Drive and constructing new curbed medians in Westcliff Drive between Buckingham Place and Irvine Avenue. This participation was not anticipated at the time the subject project was budgeted. Funds for all of the street improvements were budgeted from gas tax funds. One of the requirements of the AHFP is a certification by the City Council that the necessary right of way is available and that the County will not be held responsible for any liability arising from the use of the right of way. In connection with the Council meeting of March 24, 19691, attached is a resolution which if adopted by the City Council, will authorize e$ecutioa of an.ANFP agreement with the County of orange for the above street improvements. Also attached, in connection with this project, is a Right of Way Certification, execution of which is to be authorized by minute action. The agreement will be forwarded to you separately, prior to the Council meeting, upon receipt from the County and approval as to form.
