SUBJECT: ACCEPTANCE OF TRAFFIC SIGNAL INSTALLATION, DOVER DRIVE AT WESTCLIFF DRIVE

RECOMMENDATIONS:
1. Accept the work.
2. Authorize the City Clerk to file a Notice of Completion.
3. Authorize the City Clerk to release the bonds 35 days after
Notice of Completion has been filed.
DISCUSSION:
The contract for the Traffic Signal Installation, Dover Drive at Westcliff
Drive has been completed to the satisfaction of the Public Works Department.
The bid price was: $ 19,300.00
Amount of unit price items constructed 18,603.98
Amount of change orders: ( -) 696.02
Total contract cost: 18,603.98
Amount budgeted in Account No. 20- 5697 -048: 190300.00
The specifications called for the use of multi -wire cables in lieu of
individual conductors. Due to a strike at the General Electric factory, these cables were
not available. It was decided that because of the need for the signal and the unknown
duration of the strike, the individual conductors could be used, This resulted in a
cost reduction of $696.02.
The contractor is E. D: Johnson and Company, of Anaheim, California.
The contract date of completion was December 3, 1969.
The signal was placed in operation on January 22, 1970. The late completion
was due to the inability of the supplier - -one of only two on the west coast - -to deliver
the steel traffic signal poles. When the poles were delivered, one had the street
light mast arm in the wrong position. This pole was used in order to place the signal in
operation and a replacement was ordered. Approximately 42 months later, on June 6, 1970,
the proper pole was delivered, installed, and the job .completed. The contractor made
every effort to expedite the delivery of the poles on both occasions, therefore the
assessment of liquidated damages is not recommended.

CONTRACT FOR ENGINEERING SERVICES
(Design for Signalization of Dover
Drive - Westcliff Drive Intersection)
THIS AGREEMENT is made and entered into this .5th day
of March , 1969, by and between the CITY OF NEWPORT
BEACH, a municipal corporation, hereinafter referred to as
"City ", and DONALD B. HUMMEL, Consulting Engineer, hereinafter
referred to as "Engineer ":
RECITALS•
City proposes to signalize the Dover Drive - Westcliff
Drive intersection in the City of Newport Beach, and desires to
engage the services of Engineer, said services to consist of the
design and preparation of plans and specifications, and the
engineering relating to them, for the proposed signalization
project.
THE PARTIES AGREE AS FOLLOWS:
1. General
City engages Engineer to furnish the services
hereinafter specified for the compensation herein stipulated, and
Engineer agrees to perform such services upon said terms.
2. Duties of Engineer
The Engineer shall:
(a) Make necessary preliminary investigations,
including discussions with all affected public agencies, public
utility companies and equipment manufacturers;
(b) Consult and maintain liaison with the City
during the engineering design project;
(c) Prepare detailed plans and specifications for
the proposed work suitable for the calling for competitive bids
for the work; such preparation shall be in accordance with, but

not limited to, the following provisions:
(1) Plans will be similar in layout, content,
and general approach to City of Newport Beach Drawing R- 5056 -S,
entitled "Street Lights and Signals - San Joaquin Hills Road -
Jamboree Road;"
(2) The design will be essentially a perform-
ance type specification so far as signal and sensor operations
are concerned, and will make full and appropriate use, by
reference, of the State of California, Division of Highways
Standard Specifications dated January, 1969, Manual of Instructions,
Part 8: Traffic, Standard Plans;
(3) Plans will be approved and signed by a
California - licensed electrical engineer;
(4) Title block lettering will be done as
part of the signalization engineering in accordance with text
and type information provided by the City; drafting will be in
ink, or pencil, which will be the basis for a photography- produced
full size original to be supplied to the City by the Engineer;

appropriately commented on by the Engineer.

(d) All drafting paper, with a border and City
title block.
4. Completion of Services
Engineer agrees to complete all of the services
specified herein within 30 days after execution of this contract.
5. Payment by City
City agrees to pay Engineer for all services called
for under the provisions of this contract the total amount of
One Thousand Nine Hundred and no /100 Dollars ($1,900.00), payable
as follows; Ninety Per Cent (90 %) within 20 days after submission
of the completed engineering design and plans and specifications
to, and approval by, the Director of Public Works of the City,
and the remaining Ten Per Cent (10 %) within 20 days from the date
of the award of the construction contract.
(a) If either party determines that changes in
the scope of the engineering work as described in Paragraph 2
above are acessary, it is agreed that an adjustment will be made
in the engineering fee on a mutually agreeable basis.
6. Termination
This agreement may be terminated at any time by
the City upon five days' written notice to Engineer, either by
personal service or by placing said notice in the United States
mail, postage prepaid, addressed to Engineer's business office.
In the event of termination due to the fault of Engineer, City
shall be relieved of any obligation to compensate Engineer. If
this agreement is terminated for any reason other than the fault
of Engineer, City agrees to compensate Engineer for the actual
services performed up to the effective date of the notice of
termination, on the time and materials basis outlined by Engineer
in his letter - proposal dated February 14, 1969, incorporated
herein by reference.
7. Amendment
This agrement may be amended or modified only by

written agreements signed by both parties,and failure on the
part of either party to enforce any provision of this agreement
shall not be construed as a waiver of the right to compel enforce-
ment of such provision or provisions.
8. Assignment
This agreement shall not be assigned without the
written consent of City.
9. Hold Harmless
Engineer shall assume the defense of and indemnify
and save harmless the City, and its officers and employees, from

Engineer's performance of this contract and of the engineering
work and services herein provided.
IN WITNESS WHEREOF, the parties hereto have executed
this agreement this date first above written.

It is a pleasure for us to receive your invitation to make a design
engineering proposal to the city for signalization of the Dover Drive -
Westcliff Drive intersection.
We propose to prepare plans and specifications, and do the engineering
relating to them, which will show the signalization work at the inter-
section of Dover Drive and Westcliff Drive. This work will be done in
accordance with the following:
The plans and specifications will be complete and ready for
submittal to contractors for bid.
The specifications will be placed on the plans so that sep-
arate specification sheets will not be needed.
The plans will be similar in layout, content, and general
approach to City of Newport Beach Drawing R- 5065 -S entitled
Street Lights and Signals - San Joaquin Hills Road -
Jamboree Road.
There will be at most two sheets of plans although one sheet
is likely to be sufficient.
The design will be essentially a performance -type specification
so far as signal and sensor operations are concerned.
The design will make -full and appropriate use, by reference,
of the State of California, Division of Highways

The drafting paper to be employed will be provided by the
city. It will be provided with a border and city title
block. Title block lettering will be done as part of the
signalization engineering in accordance with text and type
information provided by the city. Drafting will be in ink,
or will be in pencil which will be the basis for a photog-
raphy- produced full -size original to be supplied to the city
by the engineer. Lettering on the drawings will be freehand.
The city will provide the necessary information regarding
street dimensions, utilities, underground structures, and
other aspects which bear on the signalization work.
The city will provide any traffic count data which is.
necessary to the engineering, and will present its own
views regarding the types, locations, and phasing of the
signals, and the types and locations of the sensors. The
basic traffic engineering will be done by the city, and
will be re wed and appropriately commented on by the
engineer.
The engineering will include
- a detailed cost estimate
- conferences with the serving electric utility
company regarding size, type, and location of
the electrical service to the equipment
- conferences with the signal controller and
.sensor manufacturers
- conferences with the city
Changes in scope of engineering work will be accompanied
by changes in the engineer's fee.
We will do this work for you on either a time and materials basis or a
lump sum basis -- at the option of the city, as follows:
(1) Time.and materials basis:
Engineer hours @ $25.00 per manhour
Designer and draftsman hours @ $15.00 per manhour
Travel costs for engineer between his office (in Santa Cruz)
and Newport Beach at rate of $80.00 per trip for all
trips over two (first two trips at no cost to city)
Printing, supplies, other direct costs at engineer's
invoiced costs.
Not to exceed $2,300.00 total.
(2) Lump sum basis -- $1,900.00 total.
