The request is for approval of providing part of the required off -
street parking for an apartment project in an adjacent shopping
center parking lot, The Municipal Code (Section 20.40.040) requires
approval by the Planning Commission and the City Council.
Procedure followed by the Planning Commission
The request was considered by the Planning Commission at a public
hearing on October 17, 1968. Notice was published in the Newport
Harbor Ensign on October 3, 1968 and the site posted October 7, 1968.
Findings and Recommendation of the Planning Commission
The applicant proposes to develop 114 apartments on a 6 acre site
bounded by Irvine Avenue, Mariners Drive, Rutland Road and the
Westcliff Shopping Center. He is proposing to provide all but 34
of the required parking spaces on the apartment project site. The
34 spaces will be provided through a parking agreement at the rear
of the adjacent Westcliff Shopping Center.
The Planning Commission determined that this would be a satisfactory
method of providing the required parking. Therefore approval is
recommended upon the following conditions:
1. A total of 228 parking spaces to be provided for the
apartment development.
2. The necessary documents for the parking agreement
shall be approved by the City Attorney. Such docu-
ments shall be recorded and copies furnished to the
Attorney, Building and Planning Departments prior
to issuing a building permit for the apartments.

3. A vehicular connection shall be provided between
the parking area at the southeasterly corner of
the apartment site and the proposed off -site
parking area.

A G R E E M E N T
THIS AGREEMENT made as of this , r " day of G�zr�ci,
1968, by and between THE IRVINE COMPANY, a West Virginia corporation,
hereinafter "Irvine," and the CITY OF NEWPORT BEACH.
RECITALS
Irvine is the owner and developer of that certain real pro-
perty located in the City of Newport Beach, County of Orange, State of
California, described and delineated as Parcel 1 and Parcel 2 on the
plat thereof marked Exhibit "A" and incorporated herein by this reference.
Parcel 1 shall be used for the construction and operation of residential
apartment buildings. Parcel 2 is used for the operation of a shopping
center known as the "Westcliff Plaza Shopping Center" and included within
the boundaries of Parcel 2 is a parking lot for the use of tenants,
customers and guests of the shopping center. The parties hereto desire
to provide for the use of forty -one (41) parking spaces on said parking
lot by the residents of the apartment buildings to be located on Parcel
1.
W I T N E S S E T H:
1. Irvine hereby agrees that there shall be reserved for the
benefit of Parcel 1 and the residents of the apartment buildings located
thereon the right to use not less than forty -one (41) parking spaces
located on the parking lot on Parcel 2. Said parking spaces shall be
used for the parking of passenger automobiles only, and shall not be
used for the parking of trailers, trucks or other types of vehicles.
2. Irvine hereby agrees that if it should at any future
time convey or lease as a whole either Parcel 1 or Parcel 2, said
conveyance or lease shall be subject to or shall include, as the case
may be, the parking rights herein granted.
