RECITALS: 1. Taube is the owner of that certain property located at the southeast corner of the intersection of Hamilton and Bushard Streets, in the City of Huntington Beach. 2. City is the owner of that certain property located adjacent to the southerly property line of the Taube property. 3. Taube is preparing to construct certain improve- ments on his land and will necessarily have to regrade his property. 4. Taube desires to enter upon the property of City for the sole purpose of effecting the necessary grading to his property. 5. Taube desires to dispose of excess clean soil upon the property of City so as to achieve a gradual slope on City's parcel. 6. The City owned property is presently leased for purposes of production of oil and other hydrocarbons. NOW, THEREFORE, the parties mutually agree as follows: 1. Taube may enter upon the City property above described for the sole purpose of grading his adjacent property. 2. Taube may deposit excess soil upon the City property to a level not to exceed in height the finished grade of his adjacent property. Such deposited soil shall be compacted in accordance with standards prescribed by the City Engineer. 3. Taube shall name City as an additional insured on its liability insurance policies for the period of time during which the entry is made. 4. Taube holds tie Ci-y harmless for any damage or .. loss of any nature arising out- f the grading operations or any acts of his employees or agents while entering upon the City property. In the process he will be depositing some clean soil upon the City property. This will not be objectionable in view of staff. The Public Works Director, City Engineer and the Utilities Superintendent have all reviewed the plans of Mr. Taube and have given their approval. The agreement was prepared by this office for your signature. It is anticipated that Mr. Taube will be grading for about one week in the early part of January. Tully H.
