AGREEMENT FOR ENGINEERING SERVICES (Jamboree Road Construction between Palisades Road and MacArthur Boulevard) THIS AGREEMENT is made and entered into this zv ro day of Mi+acw , /9i+, by and between the CITY OF NEWPORT BEACH, a municipal corporation, herein referred to as 'City ", and VTN ORANGE COUNTY, a licensed engineering firm,.herein referred to as "Engineer". WHEREAS, City proposes to construct that portion of Jamboree Road between Palisades Road and MacArthur Boulevard and construct certain signal improvements as set out in the invitation to submit a proposal to perform engineering services, dated February 18, 1969; and WHEREAS, engineering services are necessary in connection with said project consisting of design, plans and specifications for the entire project; and WHEREAS, Engineer has submitted a proposal dated March 4, 1969, to perform the necessary engineering services in connection with said improvements; NOW, THEREFORE, City and Engineer for the consideration hereinafter named agree as follows: 1. City engages Engineer to furnish the services herein- after mentioned, at and for the compensation herein stipglated, and Engineer accepts said engagement upon the terms hereinafter set forth. 2. Engineer shall provide services consisting of the following: (a) Preliminary investigation including discussions with all parties involved in the project. In particular, determine the State Division of Highways i 1'� fi t• ._' Z h S � 'r jf ._ A requirements for an Encroachment Permit and the signalization of the MacArthur Boulevard intersection. Also determine the County Road Department requirements for the signalization of the MacArthur intersection. (b) Field surveys necessary for design. (c) Preparation of detailed plans and special provisions for the project. Plans shall be prepared on standard sheets to be furnished by the City. Specifications shall be in typed form suitable for use in soliciting competitive bids. Design criteria to meet those of the Arterial, Highway Financing Program (AHFP) . (d) Preparation of a drainage study, including a hydrology study of the area tributary to the existing 54 -inch culvert under the proposed alignment. (e) Preparation of quantity and cost estimates for the project. (f) Submittal of plans for the MacArthur Boulevard intersection to the State for review and approval. (g) Preparation and submittal of the required State Encroachment Permit. (h) Obtaining AHFP approval of contract documents. (i) Preparation of the contract proposal in typed form suitable for inclusion in the bidding documents. (j) Consultation as may be required from time to time until construction is completed. 3. City shall: (a) Prepare and submit the required AHFP Design Report and Right of Way Certification. -2- (b) Furnish Standard Specifications and Standard Drawings.. (c) Provide standard sheets for the preparation of plans. (d) Furnish signal standard type, general location, controller type, and phase diagram for the required signal installations. (e)_ Consultation as needed to accomplish the project. (f) Arrange with the Orange County Materials Laboratory for soils engineering and materials testing services. 4. "Original drawings, reports, notes, maps, and other documents shall become the property of the City and may be reproduced as deemed necessary by the Public Works Director. 5. City reserves the right to terminate this agreement at any time by giving Engineer three days prior written notice in the United States mails, postage prepaid, addressed to any of Engineer's business offices. In the event that City shall terminate this. agreement, it shall reimburse Engineer on the basis of its standard fee schedule contained in its proposal dated March 4, 1969, for all work done up to the effective date of the termination. 6. All plans, specifications, and other documents for the project shall be completed to the satisfaction of the Public Works Director of City and delivered to him within 100 calendar days following the execution of this agreement by the City. 7. 'In consideration of the performance of the above described engineering services, City agrees to pay Engineer an amount based upon the standard fee schedule contained in Engineer's -3- a _ i proposal dated March 4, be greater than $9.,00(;:00., In the event of a change in the scope of the work or i£ the completion_�of the'project is after August 1,'1969, the prior writteh roval of the Public Works Director will be required to increase the maximum fee. The amount to be paid Engineer ehall be payable.as follows (a) Monthly partial payments, each payment { to be the amount earned as determined by the fee'schedule. The sum of the monthly partial payments shall not exceed ninety per cent (90 %) of the above maximum fee. (b) The balance of the total amount to be paid upon acceptance of the construction work by the City Council, but in any event not later than twelve (12) months after the signing of the plans by the Public Works Director. In addition, City shall reimburse Engineer for the actual cost of reproduction of copies of said plans, specifications and related documents, and filing fees, checking fees and other related costs authorized by the Public Works Director and advanced by Engineer. 8. Engineer shall indemnify and save harmless the City, and its officers and employees, from all damage and liability arising from any errors, omissions, or negligence in Engineer's performance of this agreement or from the engineering work and services herein provided. The execution of this agreement was authorised by the Council at its regular meeting on March.24 by the- adoption of Resolution No. 6956, copy of which is also attached. ds Att. lAura Lagios March 24, 1969 TO: CITY COUNCIL FROM: Public Works Department SUBJECT: ENGINEERING SERVICES FOR JAMBOREE ROAD CONSTRUCTION BETWEEN PALISADES ROAD AND MAC ARTHUR BOULEVARD RECOMMENDATION: Adopt a resolution authorizing the Mayor and the City Clerk to execute an agreement with VTN, Orange County for subject services. DISCUSSION: On March 10, 1969 the Council authorized the City Attorney to prepare an agreement for engineering services for the improvement of Jamboree Road from Palisades Road to MacArthur Boulevard. On March 18, 1969 the Orange Board of Supervisors approved the Fiscal Year 1969 -70 AHFP project list. The subject project was included in the approved project list. Compensation for the engineering services will be at a standard hourly rate with a guaranteed maximum of $9,000.00, plus an estimated $500.00 for the cost of reproducing plans, specifications and related documents. Funding will be as follows: Section 2106 Gas Tax Funds (City) $4,750.00 AHFP Funds 4,750.00 Total W-5071 A budget amendment has been prepared for Council consideration. Sufficient gas tax funds are available to finance the City share of the engineering costs. Construction funding will be provided during the 1969 -70 fiscal year. eph T. t�elin v lic Director ldg L /o2p5 "� March 10, 1969 TO: CITY COUNCIL FROM: Public Works Department E —e SUBJECT: ENGINEERING SERVICES FOR JAMBOREE ROAD CONSTRUCTION BETWEEN PALISADES ROAD AND MAC ARTHUR BOULEVARD RECOMMENDATION: Authorize the City Attorney to prepare an agreement for engineeri g services with Voorheis - Trindle- Nelson, Inc. for the design of the FILE subject project. DISCUSSION: .J On December 9, 1968 the Council adopted Resolution No. 6909 requesting tq�at the County of Orange include the subject project in the Fiscal Year 1969 -70 Arterial Highway Financing Program (AHFP). The Technical Committee which reviews the projects for AHFP has recommended that the project be included in the 1969 -70 program. -G9 The proposed project will provide a four lane divided roadway with a curbed median, free right turn lanes to and from Mac Arthur Boulevard and a traffic signal at the Mac Arthur Boulevard intersection. The full width of right of way will be graded to facilitate the construction of a future traveled lane, parking lane and curb and gutter at the time the adjacent property is developed. The estimated cost of the project, including engineering, is $183,000. Funding will be as follows: Section 2106 Gas Tax Funds (City) $ 80,000.00 AHFP Funds 80,000.00 Orange County 23,000.00 83—.60-T.-FO The Orange County funds will pay for one -half of the traffic signal and channelization at Mac Arthur Boulevard. . A proposal has been obtained from Voorheis - Trindle- Nelson, Inc. for performing the necessary design and coordination with participating agencies. Compensation will be at a standard hourly rate with a guaranteed maximum of $9,000. E1J.'k The qualifications of the firm and of the project engineer to be assigned to the work have been reviewed in detail. It is felt that the firm is especially well qualified to design a project of this type. The design of Jamboree Road between Mac Arthur Boulevard and the San Diego Freeway was done for the County Road Department by this firm under the direction of the project engineer assigned to the subject project. It is anticipated that the engineering services contract will be submitted for Council approval at the March 24, 1969 meeting, subject to the Orange County Board of Supervisiors approving the Fiscal Year 1969 -70 AHFP project list before that date. A budget amendment will be submitted with the agreement, sufficient gas tax funds are available to finance the engineering costs.
