Simpson Company 200 East Live Oak Avenue Irw;tndale, California 91706 Subject: Extension of Contract Gentlemen: for Beach Cleaning This letter, upon execution by parties for both sides, will constitute an extension of the agreement between the parties hereto dated February 14, 1969, and will constitute your authorization.to perform those services necessary to remove an accumulation of debris and wreckage from the public beaches in the City of Newport Beach, California. This letter will further incorporate by reference all of those terms as agreed to in the existing contract dated February 14, 1969, except as hereinafter amended, wherein Harold E. Simpson Company is to perform the services as a contractor for the cleaning of debris from the public beaches. Exceptions to the existing agreement of February 14, 1969, are set forth hereinafter as amendments thereto and shall be governing for all purposes in the extension of this contract: 1. Contractor shall cause the sand to be sifted as deep as necessary to remove any buried material. 2. City agrees to pay Contractor on the basis of the following hourly rates plus 15% for overhead and profit; ((a)) Low bed dump truck 17.00 (b) Hi 5h side dump truck 19.40 (c 977 Caterpillar loader 27.50 (d) Foreman 10.00 e) Chain Saw Man Labor 8.50 3. It is mutually agreed that the time estimated for completion of all work in the new portion of this contract shall be sixteen (16) working days. Contractor will make every Y .4 DA {. - � . . SIMPSON CO., hereinafter referred to as the "Contractor ". RECITALS: 1. The ocean beaches in the westerly portion of the City have become littered with an accumulation of debris resulting from severe storms; 2. The City Council has determined that it is necessary to employ a private contractor to accomplish the work of removing the debris, and has authorized the City Manager to enter into a contract for that purpose; 3. Contractor has submitted a proposal which meets the City's requirements. THE PARTIES HERETO AGREE AS FOLLOWS: 1. Contractor agrees to furnish all materials and labor necessary for the collection, loading, hauling, and disposal of all debris located on the ocean front beach between the westerly City limits and the Newport Ocean Pier. The work shall include the following specific items of performance: (a) The debris resting on the beach surface shall be gathered into piles which shall be placed above the high water mark; (b) The sand shall be sifted to a depth of six inches below grade to remove any buried material; (c) The sand at the high water mark shall be Rx� . 0 v scarified to a depth of two feet to removCT'4tg�'large foreign material that might be buried therein. Any such material' uncovered will be hauled off site. (d) Upon completion of the work the beach will be left in a reasonably clean condition, so that any remaining foreign materials may be removed with the beach sanitizer. (e) No more than five per cent (5%) of sand by volume shall be removed from the beach. 2. The work shall be performed in accordance with all applicable provisions of the City's standard Public Works specifications, which together with the Notice to Bidders, special provisions, if any, and all amendments thereto are hereby incorporated and made a part of this agreement. 3. In full compensation for all of the work called for by this contract, the City agrees to pay Contractor on the basis of the following hourly rates, plus fifteen per cent (15 %) for overhead and profit: a) Low bed dump truck $17.00 High side dump truck 19.40 c 977 Caterpillar loader 27.50 d� Foreman 10.00 4. Contractor agrees to commence work pursuant to this contract within seven days following execution thereof. It is mutually agreed that the time estimated for completion of all of the work is six working days. Contractor will make every effort to complete the work within said time. If for any reason Contractor does not complete the work within fourteen working days from the date on which work is commenced, City may terminate this agreement and shall be obliged to reimburse the Contractor only for the actual cost of work done to the date of termination. 5. The Contractor shall assume the defense of and -2- indemnify and save harmless the City, the;Direetor of General Services, and their officers and employees, from all claims, loss, damage, injury, and liability of every kind, nature, and description, directly or indirectly arising from the perform- ance of the contract or work,.regardless of responsibility for negligence; and from any and all claims, loss, damage, injury, and liability, howsoever the same may be caused, resulting directly or indirectly from the nature of the work covered by the contract, regardless of responsibility for negligence. 6. The Contractor shall be responsible for the protection of all existing improvements in the vicinity of the work area, located on either public or private property. If any such improvements are removed or damaged, then such improve- ments shall be repaired or replaced in kind at the Contractor's expense. 7. Access to the beach, maintenance of same, and pedestrian control will be handled by the City. 8. Contractor reserves the right to re- inspect the job site and to withdraw or renegotiate the terms of this agreement prior to actually commencing the work. City Clefk ih Cpy contract attached 1 i CITY OF NEWPORT BEACH OFFICE OF THE CITY MANAGER January 31, 1969 TO: MAYOR AND CITY COUNCIL FROM: City Manager SUBJECT: BEACH FRONT POLLUTION AND FLOOD DEBRIS I am sure you have noted in the newspapers that as of Thursday, January 30, our West Newport Beach front was quarantined because of sewage pollution. I have been making notes to myself as information has materialized on this problem and I am forwarding them h #rewith for your information. There is a good chance that over the weekend the quarantined area can be reduced in scope to open up that section of the beach im- mediately to the north of the Newport Pier. We should receive informat- ion on that late this afternoon. Since the entire beach from the 40th Street groin to the Santa Ana River Jetty is piled high with flood debris, this quarantine does not represent as severe a loss as it might normally. Our big concern, of course, is that this can conceivably extend over a long period of time beyond the one or two weeks it might take to clean the beach of debris. I will keep you advised on this pollution problem as it unfolds and more information becomes available. The debris on the beach between the 40th Street groin and the Santa Ana River Jetty is beyond our capability to remove in any logical period of time and also without disrupting many of our other General Services projects which should be moving ahead. For this reason, we will be recommending that the Council authorize a special appropriation to have it removed by contract. This has been added as an emergency item to your agenda for Monday evening. At that time I will give you more detail relative to the needs and the cost. I believe we are facing a cost of three to four thousand dollars. NOTES RELATIVE TO QUARANTINING OF THE WEST NEWPORT BEACH ( J Received a call from Dr. John R. Philp, Health Officer of the County of Orange at 9:30 A.M., Thursday, January 30th. He indicated that: -- A section of a main sewer line in Riverside was washed out at 4:00 A.M., Sunday, January 26. Since that time over 10,000,000 gallons per day of sewage has been diverted into the Santa Ana River. The sewage is being treated very heavily with chlorine. -- Between Sunday the 26th and Thursday the 30th, the flooded condi- tion of the Santa Ana River created enough dilution to prevent any concern of beach contamination beyond the tolerable level. With the lessening of flood conditions it has been determined advisable to quarantine certain areas of Huntington Beach, The Santa Ana River itself and the Newport Beach ocean front from the Santa Ana River south to the Newport Pier. This quarantine area in Newport Beach is acknowledged to be more than needed, how- ever, it represents a definable section of the beach recognized by the public. -- Tests will be taken within the next 24 hours to determine the exact stretch of beach in Newport which will be under continued quarantine. -- It is anticipated that it will take two.to three months or more for Riverside to repair the break and discontinue the flow into the Santa Ana River. It should be possible to lift the quarantine on the beaches one or two days thereafter. -- The quarantine merely prohibits body contact with the water for water sports, such as swimming and surfing and also''prohibits the collecting of shell fish, etc. s Page -2- w Subsequent discussion with John Wentz, Riverside City Manager, in- dicated the following: -- Problem involves complete washout of 6 to 700' of 48" and 24" paralleling sewer lines. The entire sections, including earth, fell into the river. Replacement is a major job which will involve approximately a half million dollars in cost and two to three months or more construction time. -- The 10,000,000 gallon per day or more sewage flow into the Santa Ana River will continue for the entire period 6f con- struction. Its effect upon Newport Beach will depend on the amount of water in the Santa Ana River. Heavier flow through drainage into Prado Dam could dilute to the point of low con- tamination, such as prior to the 30th. Normal low flow in the Santa Ana River could cause sewage absorption by the soil prior to its reaching Newport Beach. Exact effects trot known at this time. I will keep you apprised of this matter as in- formation evolves. Received information through Flood Control District on the following: -- Opened up Prado Dam for discharge of flood waters on 1/30/69. Dam has stored 75,000 acre feet of water. Are releasing at rate of 4,3000 acre feet per day. This is maximum under present conditions of drainage channel and will be increased as banks are reestablished and debris blockage is removed.
