June 9, 1969 TO: CITY COUNCIL FROM: Public Works Department E --L SUBJECT: ACCEPTANCE OF EMERGENCY GROINS AT THE LIFEGUARD HEADQUARTERS (C -1214) RECOMMENDATIONS: 1. Accept the work. 2. Approve the payment of $8,488.00 as full compensation for construction of the emergency groins. 3. Authorize the City Clerk to file a Notice of Completion. 4. Authorize the City Clerk to release the bonds 35 days after the Notice of Completion has been filed. DISCUSSION: The work has been completed to the satisfaction of the Public Works Department. On March 10, 1969 the City Council, after receiving an oral report from the City Manager, adopted Resolution No. 6948 authorizing the execution of a public works contract for the construction of a bulkhead at the Lifeguard Headquarters. Because of the emergency conditions that existed at that time, the City Council authorized the City Manager, without advertising for formal bids, to accept informal bids for the construction of the bulkhead. The sum of $8,500 was appropriated for the work. On April 1, 1969 the City entered into a contract with Croft and Neville, Inc. to construct the bulkhead for the sum of $8,488.00. Because of increased erosion it was felt that more protection could be obtained if a series of groins were constructed instead of a bulkhead. On May 12, 1969 the City Council approved the construction of a series of groins in lieu of the bulkhead. Prior to the beginning of construction, the contractor agreed to build the groins for the same price as the bulkhead, i.e., $8,488.00. Upon completion of the work he has submitted to the Public Works Department a cost breakdown indicating that his costs, including expected profits, were in excess of $8,488.00, but he would be willing to settle for $8,488.00 plus possession of any City- furnished material not used on the job. The tentative date of completion was to be approximately May 15, 1969, depending upon the time it took to obtain the required materials. The work was substantially completed by May 23, 1969. l DISPOSI ON: seph T evlin t P blic r s Director P /ldg May 12, 1969 TO: CITY COUNCIL FROM: Public Works Department SUBJECT: CONSTRUCTION OF EMERGENCY BULKHEAD AT LIFEGUARD HEADQUARTERS (C -1214) RECOMMENDATION: That a series of groins be constructed oceanward of the Lifeguard Building in lieu of the presently planned bulkhead. DISCUSSION: On March 10, 1969 the City Council, after receiving an oral report from the City Manager, adopted Resolution No. 6948 authorizing the execution of a public works contract for the construction of a bulkhead at the City owned Lifeguard Station at the Newport ocean pier. Because of the emergency conditions that existed, the City Council authorized the City Manager, without advertising for bids, to accept informal bids for the construction of the bulkhead. The sum of $8,500 was appropriated for the work. Since that time the erosion at the Lifeguard Headquarters has proceeded at an increased rate. It is now felt that more protection could be obtained if a series of groins were constructed instead of the bulkhead as was previously planned. The contractor started work on May B, 1969. The work has not proceeded beyond a point where a change in plans could be made. Amount of Contract $8,488.00 City Clerk ih Att: cpy of omtnwt w CONTRACT FOR CONSTRUCTION OF BULKHEAD (Contract 1Z14) THIS AGREEMENT is made and entered into this isr day Of 04PRI4. , 1969, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as the "City ", and CROFT & NEVILLE CO., hereinafter referred to as the "Contractor ". RECITALS• 1. The City Council of the City of Newport Beach has determined that it is necessary to employ a contractor to construct a bulkhead in front of the lifeguard headquarters building on the ocean front adjacent to the Newport Pier, and has authorized the City Manager to enter into a contract for that purpose; 2. Contractor has submitted a proposal which meets the City's requirements. THE PARTIES HERETO AGREE AS FOLLOWS: 1. Contractor agrees to construct a timber bulkhead at the lifeguard headquarters in accordance with Alternate "B" of the proposal dated March 24, 1969, which was submitted to the City; Contractor acknowledges that the work is of an emergency nature and agrees that it will use diligence in obtaining the re- quired materials and in prosecuting the work to completion; Contractor will make every effort to complete the work within 45 days after its commencement. 2. The Contractor shaX�_ assume the defense of and indemnify and save harmless the City, the Director of Public Works, and their officers and employees, from all claims, loss, damage, injury, and liability of every kind, nature, and description, directly or indirectly arising from the performance of the contract or work, regardless of responsibility for negligence, and from any and all claims, loss, damage, injury, and liability, howsoever the same may be caused, resulting directly or indirectly from the nature of the work covered by the contract, regardless of responsi- bility for negligence.
