Dear Mrs. Lagios:
The City of Costa Mesa has approved the Orange County Civil
Defense and Disaster Relief Plan - Emergency Fire Services,
by Resolution No. 69-30 of the City Council, adopted on
April 7, 1969.
Inasmuch as this plan takes the place of the existing system
of mutual aid agreements, dating from 1964, notice is hereby
given under the terms of the agreement that the City of Costa
Mesa intends to terminate fifteen days after filing this notice
in your office.

The City Council of the City of Newport Beach has approved the
Orange County Civil Defense and Disaster Relief Plan - Fmergency
Fire Services, by the adoption of subject resolution on April 2R, 1969.
This letter will serve as a Notice of Intention of the City of Newport
Beach to terminate the existing mutual aid ap� eements, date' ' ;;7,
fifteen days after the filing of this notice in your office.

Adopt resolution expressing approval of the Orange County Civil Defense and
Disaster Relief Plan - Emergency Fire Services, and terminating all current
agreements for mutual fire protection.
DISCUSSION:

A Mutual Aid Committee of the Orange County Fire Chiefs Association has recently
completed an exhaustive study on mutual aid fire defenses within the County of
Orange. This has resulted in the publication and adoption by the Orange County
Board of Supervisors of a new County fire disaster plan developed to guide
activities and to coordinate them with regional, State, and Federal plans in
case of a disaster. Vice Mayor Parsons, the Administrative Assistant to the
City Manager, and representatives of the Newport Beach Fire Department attended
a briefing session on this program at the March 20, 1969, evening meeting of
the Orange County Fire Chiefs Association. Also, Mayor Marshall and Councilman
Hirth attended a test exercise of the proposed plan deployment at Anaheim Stadium
this same day. The Fire Chief has recommended that Council approval be given
to the new plan. The Chief of Police, in his capacity with civil defense matters,
also finds "no reason to recommend other than Council approval."

In the fall of �, a formal fire mutual aid program was developed with this
City entering into resolutions of agreement with the Cities of Laguna Beach,
Santa Ana, Huntington Beach, Costa Mesa, San Clemente and the County of Orange.
These agreements remain in effect to this date. The new proposed emergency
fire services plan would cancel these agreements and incorporate in one document
a pre - determined program for the mobilization, organization, and operation of
the fire defense facilities within the County of Orange.
The essential voluntary nature of the new plan is consistent with current agree-
ments and is documented in Section B, Page 6 of the plan:
. . . the Fire Chief, or other person in charge of a fire protection
organization shall, in every case of requested aid, determine the
limit of assistance which his organization can render without de-,
pleting fire or rescue protection resources, personnel, and equip-
ment for the area where his primary responsibility exists, and shall
not be required to furnish aid in excess of the amount so determined.

Once aid has been given the assisting agency has the prerogative to
recall such aid whenever it is vital to the fire defenses of said
community.
The agreement further provides that, "Any mutual aid extended under this plan
is extended with the express understanding that the responsible local fire
official (in whose jurisdiction an incident requiring mutual aid has occurred)
shall remain in charge at such incident, including the direction of that per-
sonnel and equipment provided him through the operation of this mutual aid
plan".
The new plan provides a more efficient approach to mutual aid by incorporating
"task force" concepts. This cooperation among governmental agencies continues
to be in the best interest of the City and should provide improved protection
to Newport Beach properties.
The City of Huntington Beach adopted the plan at their Council meeting of
April 7, the City of Costa Mesa on April 8, and Santa Ana on April 21.
Should members of the Council have technical questions about any operational
aspects of the new plan, the Fire Chief could be called into the study session
to review this matter with you.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH EXPRESSING APPROVAL OF THE
ORANGE COUNTY CIVIL DEFENSE AND DISASTER RELIEF
PLAN - EMERGENCY FIRE SERVICES, AND TERMINATING
ALL OTHER CURRENT AGREEMENTS FOR MUTUAL FIRE
PROTECTION
WHEREAS, the Board of Supervisors of the County of
Orange, State of California, on the 11th day of March, 1969,
adopted the Orange County Civil Defense and Disaster Relief
Plan - Emergency Fire Services - known as Appendix I of Annex B
of the Orange County Operational Area Civil Defense and Disaster
Plan, as adopted by the Orange County Board of Supervisors, on
behalf of the County of Orange and all its departments and
agencies; and
WHEREAS, it is the intention of the City Council of
the City of Newport Beach to approve and agree to abide by said
Orange County Civil Defense and Disaster Relief Plan - Emergency
Fire Services - known as Appendix I of Annex B of the Orange
County Operational Area Civil Defense and Disaster Plan, as
adopted by the Orange County Board of Supervisors and to
terminate all current agreements for mutual fire protection
which have hitherto been made and entered into and executed by
the City of Newport Beach as a principal party thereof.
NOW, THEREFORE, the City Council of the City of
Newport Beach does, by this resolution, hereby approve and agree
to abide by said Orange County Civil Defense and Disaster Relief
Plan - Emergency Fire Services - known as Appendix I of Annex B
of the Orange County Operational Area Civil Defense and
Disaster Plan, as adopted by the Orange County Board of
Supervisors.
The City of Newport Beach hereby terminates all
current agreements for mutual fire protection in which the
City is a party and the City Clerk is directed to serve notice
of its intention to terminate such agreements upon the clerk
of the governing body of each of the other parties thereto as
provided by Paragraph 7 of the standard form agreement for mutual
fire protection.
The City Clerk is directed to file with the Orange
County Board of Supervisors two certified copies of this
resolution.
