1. The Costa Mesa Sanitary District has expressed its
intention to commence detachment proceedings, under the District
Reorganization Act, to detach all of their service areas which
lie within the City of Newport Beach. Following completion of
the proposed detachment, the City of Newport Beach would then
assume the services previously performed by the District,
z. Engineers have submitted a proposal to perform the
services required by the City, and the City Council bas. determined
that they are qualified to provide said services,
NOW, THEREFORE, the parties agree as follows:
1. SERVICES TO BE FURNISHED BY ENGINEERS:
A. Determination of the facilities to be detached
from the Costa .Mesa Sanitary District System.
B, Inventory of.number of parcels and of land use
in each area.
C. Estimate population and sewage flows for each
area.
D. Develop an ultimate sewering plan. that would
connect each area either to the existing City system or to County

Sanitation District trunk facilities. Alternate plans would De°`
developed when appropriate,
E. Develop interim sewering plans for areas
presently remote from existing City or Sanitation,Diatrict
facilities.
F. Prepare cost estimates for the sewering plans
developed in items D.and E.
G. Consider all aspects of sewer lines within the
City that would continue to be owned by Costa Mesa Sanitary
District.
H. Prepare a formula to be used in determining'
fees for contracting with the Costa Mesa Sanitary District for
continued interim service to remote areas.
II. PREPARATION OF REPORT
Engineers agree to submit a written report which
shall include background information, cost estimates, exhibits
and recommendations, within 120 days after execution of this
agreement. City will reimburse Engineers for the cost of repro-
ducing said report.
III. PAYMENT FOR SERVICES
City agrees to pay Engineers for their services
on the basis of 2 -1/2 times the direct labor costs, at the direct
labor rates as shown in the following fee schedule, but not to
exceed the sum of $10,000.00;
Principal 10 per hour
Engineers �6 to $8 per hour
Designers & Draftsmen $4 to $6 per hour
Typists $3 per hour
Partial payment shall be made each month during
the course of the study, up to a total of 90% of the maximum,
with the balance due upon receipt of the final printed report.

WEMUM, there has been presented to the City Council
of the City of Newport Beach a certain contract between the City
of Nawport Beach and Shuirman- Simpson, Civil Engineers, for
engineering services in connection with the proposed detachment
Of City territory from the Costa Mesa Sanitary District; and
WHEREAS, the City Council has considered the terms
and conditions of said contract and found them to be fair and
equitable;
NOW, THEREFORE, BE IT RESOLVED that said contract for
engineering services is approved, and the Mayor and City Clerk
are hereby authorized and directed to execute the same on behalf
of the City of Newport Beach.

RECOMMENDATION:
Adopt a resolution authorizing the Mayor and the City Clerk to execute
an agreement with Shuirman- Simpson, Civil Engineers, to perform the
subject study.
DISCUSSION:
The Costa Mesa Sanitary District has expressed its intention to commence
detachment proceedings, under the District Reorganization Act, of all of their service
areas which lie within the City of Newport Beach. If this can be accomplished, the
City will take over operation and maintenance of the facilities involved, and a double
taxation problem will be resolved.
On May 12, 1969 the Council authorized the preparation of an engineering
services agreement with Shuirman- Simpson, Civil Engineers, to perform a study of the
proposed detachment.
The agreement provides that compensation will be based on standard hourly
rates, with the maximum fee not to exceed $10,000. The services to be provided include:
1. Determination of the facilities to be detached from the Costa Mesa
Sanitary District system.
2. Inventory of number of parcels and of land use in each area.
3. Estimate population and sewage flows for each area.
4. Develop an ultimate sewering plan that would connect each area either
to the existing City system or to County Sanitation District trunk
facilities. Alternate plans would be developed when appropriate.
5. Develop interim sewering plans for areas presently remote from
existing City or Sanitation District facilities.
6. Prepare cost estimates for the sewering plans developed in items 4 and 5.
7. Consider all aspects of sewer lines within the City that would continue
to be owned by Costa Mesa Sanitary District.
B. Prepare a formula to be used in determining fees for contracting with
the Costa Mesa Sanitary District for continued interim service to
remote areas.
The results of the study would be submitted in a written report consisting of
background information, cost estimates, exhibits, and recommendations.

From the Costa Mesa Sanitary District
It is proposed to finance the work with a transfer from the appropriation
for the "Annual Sewer Pump Station and System Appurtenances Betterment Program." The
Engineer's cost estimate for the parallel Balboa Island Sewer Force Main proposed in
the revised program indicates that sufficient funds will be available for the $10,000
transfer.
A budget amendment transferring the funds to a new appropriation has been
prepared for Council consideration.
