The agreement entered into on Marh.6_� Imo$. ` provides that for as long as the office building contras to exist,`the parties to the agreement and you as the successors in Interest..shall make available for use by the customers and business invitees of,the tenants or occupants of said building twenty -four parking spacaa;. Also attached as an exhibit is the parcel where the spaces are located. It appears to our office that the subject parcel is now occupied for the exclusive use of Richard's Lido Center. Would you please make the necessary arrangements to implement the provi- sions of the agreement so that the business invitees of our office build - ing may make use of the subject parcel pursuant to the recorded agreement. A memorandum dated March 7 1968, directed to the City Council relating to the subject agreement. 2. The original and twg copies of the subject agXy, n *_, executed in triplicate by Earl G. Sawyer and wife and the Griffith Company. 3. Seven xerox copies of the agreement. 4. A resolution which, if adopted by the City Council, will authorize the execution of the agreement on behalf of the City and direct that it be recorded. It is requested that copies of the memorandum accompany the agenda packages and that the xerox copies of the agreement be included in the agenda packages of the Councilmen for the meeting of March 11, 1968. Prompt recording of the agreement has been requested by the other parties. It is, therefore, requested that the executed agreement ready for recording be transmitted to us as soon as available on Tuesday, March 12, together with the duplicate on inals of the agreement for delivery to the other parties. Following its recordation, the original agreement will be returned to you for your records. He related that there was an unresolved problem which was preventing consummation of the sale, specifically, that although the property is located in a C -1 -H zone there is no on -site parking nor is there an off - street parking agreement making provision for the required parking on another site. Upon investigation it was determined that the building permit for the existing building was issued in July of 1954. At that time the -H factor parking requirements were applicable which, when applied to the building in question, result in a requirement of 24 off - street parking spaces based on the formula of one parking space for each 250 square feet of floor space. There was no indication in the building department files as to why the park- ing requirements were not enforced with respect to this property, Prior to the issuance of the building permit, a letter dated April 1, 1954, was directed by the Griffith Company, who owned the property at that time, to John S. Mason, who was purchasing the property from the company, to the effect that the compan� would provide sufficient off - street parking to meet the City Ts zoning requirements in nearby parking lots under its control. After receiving the foregoing information I discussed this matter with William Mirams, a vice president of the Griffith Company, who had handled the original transaction. Mirams acknowledged the company's obligation to furnish the required parking and agreed to enter into an off - street parking agreement. If a change of use of the 32nd Street property occurs which necessitates additional parking spaces, the property owner will be required to furnish the additional spaces. The agreement is to be recorded and it will bind future owners of both properties. It is recommended that the City Council approve this agreement by adopting the resolution which appears on your agenda. This will correct the prior omission of the City and will enable Mr. Sawyer to complete the sale of his property. For so long as the office building presently 20 located on Parcel A continues to exist, Company agrees to make 21 available twenty -four (24) parking spaces located on Parcel B 22 for the personal use of the owner in fee of Parcel A and for the •23 use by customers and business invitees of the tenants or occu- 24 pants of said office building.
