2 AGREEMENT
(Street Lighting Assessment District No. 52)

4 THIS AGREEMENT is made and entered into this Id -7h
5 day of 1969, by and between the CITY OF NEWPORT
6 BEACH, a municipal corporation, hereinafter referred to as "City,"
7 and the firm of SHUIRMAN- SIMPSON, Civil Engineers, hereinafter
8 referred to as "Engineers."
9 RECITALS:
10 City proposes to install street lighting in the Harbor
11 Highlands area of the City of Newport Beach, known as proposed
12 Assessment District No. 52.
13 It is necessary to have plans and specifications prepared
14 for said project, and Engineers have submitted a proposal to
15 perform the necessary engineering services in connection with
16 said improvements.

17 NOW, THEREFORE, the parties agree as follows:
18 1. Services to be Furnished by Engineers.
19 (a) Prepare detailed plans and specifications
20 suitable for use in calling for public bids to construct and
21 install street lighting in the Harbor Highlands area of the City
22 of Newport Beach.
23 (b) Prepare a cost estimate based upon said plans
24 and specifications.
25 (c) Upon request, inspect the project area and
26 consult with the City Public Works Department staff regarding
27 interpretation of the plans and specifications, and consult on
28 any other design problems which may arise.
29 (d) Assist the City in evaluating the bids and
30 making a determination on the award of the contract.
31 (e) Prepare a draft form of special conditions that

2. Drawings and Other Documents.
(a) All drawings shall be prepared in ink on
standard mylar sheets which shall be furnished to Engineers by City.
(b) All drawings and other documents prepared by
Engineers pursuant to this contract shall become the property of
City and may be reproduced as deemed necessary by the Public Works
Director.
3. Pent for Services. City agrees to pay Engineers
for their services on the basis of two and one -half times the
direct labor costs at the direct labor rates as shown in the
following fee schedule, but not to exceed the sum of $3,000.00.
Principal $10.00 per hour
Engineers $6.00 to $8.00 per hour
Designers & Draftsmen $4.00 to $6.00 per hour
Typists $3.00 per hour
Partial payment shall be made each month during the
course of the agreement, up to a total of 90% of the maximum, with
the balance due upon acceptance by the Public Works Director of
the plans, specifications, and estimate.
4. Independent Contractor. In carrying out the terms of
this contract, Engineers shall at all times be deemed independent
contractors and not employees of the City.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement as of the day and year first above written

SUBJECT: CONTRACT FOR ENGINEERING SERVICES (PROPOSED ASSESSMENT DISTRICT 52)
Attached is the original and three copies of an engineering services
agreement with Shuirman - Simpson to perform engineering services
for the proposed Assessment District.
On April 28, 1969 the City Council approved the preparation of plans
for the work.
Please sign and forward to the City Clerk for her signature. The
City Clerk will then return them to this office for further processing.
