Dear Duncan:
This is to verify our phone conversation of this date on which
it was agreed to have the Board of Appeals on the above subject
on Tuesday, February 10, 1970, at 9:30 A.M. in the Council Chambers.
of the City of Newport Beach.
The subject of this Board of Appeals will be the interpretation
of Chapter 36 of the Uniform Building Code, 1967 Edition which
states "roof structures shall be constructed with walls, floors
and roof as required for the main portion of the building."
The applicant requests that he be permitted to use redwood in
the construction of this tower and•the Building Department and
Fire Department interpret the Code that this tower should be
made entirely of incombustibles.

SUBJECT: Off Site Parking Agreement on Behalf of the Balboa
Insurance Company -- Seaboard Finance Company
This office has received, this date, the applicable provisions
of a recorded lease between the Irvine Company and the Balboa
Insurance Company wherein the Irvine Company agrees to lease
certain parcels of land to Balboa for use in the establishment of
a parking structure in conjunction with a proposed 16 -story
office building to be erected by Balboa.
I am forwarding herewith a copy of an Exhibit prepared by the
Irvine Company setting forth various parcels located in the
transaction between Balboa and Irvine. - ..Each parcel and building
site is delineated by color coding on this Exhibit, and for your
information are described as follows:
Red Parcel - Fee land owned by Balboa Insurance Company
by deed from Irvine.
Blue Parcels
Parcel I - Owned by Irvine, leased by Balboa for use
as surface parking and landscaping
adjacent to the high rise office building.
Parcel 2 - Owned by Irvine, leased by Balboa for
construction of a multi -story parking
structure by Balboa and to include common
areas of landscape.
Green Parcel -Owned and controlled by Irvine (with
covenants from Irvine to Balboa to erect no
building in excess of 20 feet in height).
Red /Brown - Owned and controlled by Irvine (no leases)
Parcel Anticipated site of a parking structure
addition to be built and operated by Balboa.
Yellow Borders - Depict the building sites; the square
yellow border on the red parcel is the
high rise office building. The "L"
shaped yellow parcel is the parking
structure on the Seaboard Leasehold.

LOCATION: Lot 22, Tract 6015, located in the 600 block of
Newport Center, between Newport Center Drive East
and San Joaquin Hills Road and between Santa Rosa
Drive and Santa Cruz Drive.

Application
This resubdivision proposes to divide a parcel in the 600 block of
Newport Center into 3 parcels to serve as sites for a mall, a high
rise office building, and a parking structure. Parcel No. 1 will
be developed as a mall with surface parking; parcel No. 2 will be
the site of the Balboa Insurance building. Parcel No. 3 will be
occupied by a parking structure to be utilized in conjunction with
the office building. The parking structure also will accommodate
future commercial space on a portion of the ground floor.
Analvsis and Recommendation
The property in question is in the 600 block of Newport Center Drive
across Newport Center Drive from the Broadway Department Store. All
street improvements are completed with the exception of those planned
in connection with this development.
These lots are in conformance with other lots now being developed
in Newport Center and present no unusual problems from a planning
standpoing.
Approval is recommended subject to the following conditions:

Resubdivision No. 276 was continued until
October 2, 1969 in order to give the applicant
an opportunity to submit a revised map.
Planning Director Wilson presented the follow-
ing two items to the Commission at the same
time as they involve the same property.
Request to create three parcels for constructii
of office building and parking structure.
Location: Lot 22, Tract 6015, located in the
600 block of Newport Center,
between Newport. Center Drive East
and San Joaquin Hills Road and.
'between Santa Rosa Drive and
Santa Cruz Drive.
Zone: C- O -H -UL'
Applicant: The Irvine Company, Newport Beach
Owner: /Same as'applicant
Mr. James Taylor and Mr. David"Kaylor of the
Irvine Company were present at the meeting.
Mr. Taylor stated that due to the Planning
Commission having th.ree new members, he would
review the overall concept for Newport Center.
The office building to be constructed is the
first of the high rise buildings in the 600
block and basically is in conformance with the
plans for the general area. Parking will meet
and exceed code requirements.
There was further discussion regarding curb
cuts, pedestrian walkways and signalization at
key intersections.
Resubdivision No. 271 was approved subject to
the following conditions:
`1. That a Parcel Map be filed.
'2. That access rights to San Joaquin
Hills Road be dedicated to the City...

the leasehold interest of Balboa insurance Company and Meritplan
Insurance Company in the parking structure reverts to the Irvine
Company, or to any third party not a party to this Agreement, then
the undersigned agree to provide separate exits for each building:'
They further agree to provide separate utilities including fire,
sprinkler systems for each building. Furthermore, all common
openings shall be closed between the Tower Building.And the

A RESOLUTION OF 'CITY COUNCIL OF THE CITY.
OF NEWPORT BEACH OTHORIZING TO EXECUTION, OF
AN AGE NT WITH BAL10A INSURANCE COMPANY
REGARDING OFF SITE PAVING IN NEWPORT CENTER
WHEREAS, The Irvint'..pany is the owner and developer
of certain real property in the City of Newport Deaeh located
in the 600 block of Newport Centex, with the exception of
that parcel hereinafter described as Parcel "A "; and .'
WHEREAS, Balboa Insurance Company is the owner of
Parcel A. shown on the sketch to accompany legal description
attached hereto as Exhibit "II ", and located in the 600 block
of Newport Center; and
WHEREAS, Balboa Insurance Company is constructing A
16 -story office building upon Parcel A; and
WHEREAS, the required number of on -site parking spaces
as set forth in-the provisions of Newport beach Mmicipal Code
are not available on Parcel A; and
WHEREAS, the Newport Beach Municipal Code allows off
street parking to be provided on a site other than the building
site upon the condition that an agreement.betweeii the property
owner and the City is executed and recorded setting forth that
the off street parking shall be provided and maintained for so
long as the building exists without having sufficient parking
on -site; and
WHERM, an agreement has been prepared under which it
is agreed between The Irvine Company as owner and Balboa
Insurance Company as lessee, that Parcel 2 shown on Exhibit II
attached hereto will be used for purposes of providing sufficient
parking as required by the 16 -story office building located
adjacent thereto for a period of 45 years; and

Irvine Company and Balboa Spurance Company guarantee to the City
of Newport peach that the of$-site parking located adjacent to
Parcel A described above, will b/4 maintained as a parking
facility to satisfy the parking- re"irements of the Newport
Beach Municipal Code for the 16 -story office structure located
on Parcel A;
NOW, TNRREFORE, BE IT RESOLVED that the 6ity Council of
the City of Newport Beach hereby approves said agreements, and
the Mayor and City Clerk are authorized and directed to execute
the agreement between The Irvine Company, Balboa Insurance Company
and the City of Newport Beach on behalf of the City.
BE IT FURTHER REsOLYRD that the City Clerk is author-
ized and directed to record said agreement and execute any
certificate necessary to accomplish said recording.
ADOPTED this 8th day of September, 1969.
