Accept the work 2. Authorize the City Clerk to file a Notice of Completion. 3. Authorize the City Clerk to release the bonds 35 days after Notice of Completion has been filed, subject to approval of the City Attorney. 4. Assess liquidated damages in the amount of $900.00. DISCUSSION: , The contract for the Balboa Pier Parking Lot Improvements has been completed to the satisfaction of the Public Works Department. The bid price was: Amount of unit price items Amount of change orders: Total Contract Cost: Amount budgeted in Account $249,656.90 constructed: $243,066.13 $ 4,621.75 $247,687.88 No. 26- 5697 -057: $270,000.00 Four change orders were issued for the following extra work: (1) Removal of 11 palm trees which could not be removed by the P.B. & R. Department ($1,650.00) (2) Adding buff colored concrete for the median sidewalks, construction of a cross gutter to improve drainage, and construction of a small retaining wall adjacent to the pier sidewalk ($1,277.36) (3) Modifications to the sprinkler system ($790.50) (4) Substitution of larger pull boxes for the underground electrical and telephone systems ($903.89). The General Contractor, Astec /Loughran, a joint venture, has apparently become insolvent, Notices to Withhold Funds in the amount of over $107,000.00 have been received. The contractor is owed approximately $106,000.00. It appears that the sub - contractors and suppliers may be paid about 99 cents per dollar. Final determination of the amounts and methods of payment will be in accordance with the City Attorney's opinion. June 28, 1971 Page Two Subject: Acceptance of Balboa Pier Parking Lot Improvements (C -1260) The contract date of completion was March 19, 1971. Due to the contractor's relative inexperience in this type of work, award of the contract was delayed two weeks to allow for a thorough check of previous projects of all types. It is felt that this two weeks delay warrants an equal extension of the time of completion. During the project, the contractor was unable to work for one day due to rain and two days due to high winds. The above extensions of time result in a revised completion date of April 7, 1971. The paving of the parking lot was completed on April 16, 1971. While there were still some items of work to be completed, it is felt that the city had full use of the lot from that time. All contract pay items of work were completed by May 5, 1971. In addition to the above mentioned work, patching and cleanup work were needed for completion of the job. The majority of the patching work was completed by the contractor by approximately May 21, 1971. The recommended assessment of damages in the amount of $900 is based on the 9 -day period from April 7 to April 16 at the contract specified rate of $100 per day. The contractor has alleged that since the city used portions of the lot beginning April 8, no damages should be assessed after that date. The Standard Specifications clearly state that the city has the right to use completed portions of a project. This does not relieve the contractor of his obligation to complete the work on schedule. Because the firm submitting the low bid has not previously performed work for the city, an extensive investigation was made of the contractor's qualifications. The investigation disclosed that the contractor is properly licensed, holding a Class "A" (General Engineering Contractor) license. It was also learned that the contractor's experience is limited in performing work of the type and magnitude involved. However, the contractor's qualifications appear adequate to justify award of the contract. In response to concerns expressed by the Public Works Department, Mr. Neil F. Loughran, partner in the joint venture, has stated that he personally intends to supervise construction of the project. The plans were prepared by the city.
