Phoenix are owners of certain real property in the City of Newport Beach, County of Orange, State of California, described as follows: The northwesterly 251.88 feet excluding the south- westerly 140 feet of Lot 47, Newport Heights, as per map recorded in Book 4, Page 83 of Miscellaneous Maps, Records of Orange County, more commonly known as 2507 and 2525 16th Street; and WHEREAS, on February 18, 1971, Craig C. Phoenix and Paula J. Phoenix hereinafter referred to as Owner; WHEREAS, the City Council of the City of Newport Beach has determined to initiate street improvements on streets that are more than 50 percent improved and to assign the cost of these improvements to the adjoining property owners; and WHEREAS, one method available to complete the work is for the advancement of construction funds by the City; and WHEREAS, under this method the City shall advance the funds only after an agreement between the property owner or owners and City has been signed in which the owner or owners agree to repay the con- struction costs over a 2 -year period at 6 percent interest or at no interest if repaid within one year; and WHEREAS, The undersigned Craig C. Phoenix and Edward S. Phillips with the recording information filled in. In March we returned to you the Reimbursement Agreements from Reta L. Qianey and Ina Sue Reitz with instructions from the Recorder's Office that the notarization information was incom- plete. At that time you were to have the owners of the property appear before a notary and have a notarization statement filled out reading ".....so and so .... uppeared personally before me, etc and etc." and then return the agreements to this office for processing thru the County Recorder's office. To date we have not received the Agreements from Mrs. Chaney and Mrs. Reitz. Will you please check into the status of these two agreements? The property owners are paying for the cost of these improvements. In most cases the estimated cost is $215.00, although there is one large parcel with 278 feet of curb and gutter costing $780.00. On April 27, 1970 the Council authorized the staff to execute reimbursement agreements to allow the property owners on Irvine Avenue to reimburse the City for curb, gutter and drive approaches adjacent to their property over a two year period. In the interest of having curb and gutter constructed on 16th Street, it is recommended that this service also be granted to the property owners on 16th Street. The reimbursement agreement would allow the property owner to repay the City within one year without an interest assessment. If repayment is over a two year period, an annual interest rate of 6% of the unpaid balance would be charged. Confirm, modify, or overrule the Notices to Construct posted on May 6, 1970. 3. DISCUSSION: State law provides a procedure which a city may use to require property owners to construct needed improvements in streets. The procedure is found in Chapter 27 of the Improvement Act of 1911. A brief description of the procedure is as follows: 1. The City notifies the property owner to construct the improvement and sets a time for a public hearing to hear protests. 2. At the conclusion of the public hearing the City Council may order the staff to construct the improvements at the expense of the property owner if construction has not been commenced within 60 days after notice was given. 3. On April 27, 1970 the City Council directed the staff to notify property owners to construct the public improvements listed under Recommendation No. 1. Two property owners on the northwesterly side of Irvine Avenue between 15th Street and Margaret Drive did not agree to put in curb and gutter adjacent to their property as a part of the City's Irvine Avenue widening project. On May 6, 1970 a Notice to Construct curb, gutter and driveway approach was posted on each of these properties. The two property owners protested the widening of Irvine Avenue at the May 11, 1970 Council Meeting and have indicated they also intend to protest the Notice to Construct, Page Two May 25, 1970 Subject: Constructing Public Improvements by Using Chapter 27 of the 1911 Act Continuous curb and gutter on Irvine Avenue from 15th Street to 16th Street is needed to provide adequate drainage of the street. If gaps are left in the curb, mud puddles would form and decrease the efficiency of the drainage system. Also the subgrade below the pavement would become saturated causing an early failure of the pavement in that area. If an acceptable bid for the construction of the Irvine Avenue project is received, construction will begin on about June 19, 1970. Construction of the curb, gutter and drive approaches on either side of the two dissenting property owners' property should be completed in July or by early August. Chapter 27 of the 1911 Act provides that when the Superintendent of Streets (Public Works Director) finds that the construction of curbs has been guaranteed to his satisfaction in front of properties constituting more than 50% of the frontage in any block, he may and shall upon direction of the Council notify the owners of property fronting remainder of the block to construct or cause to be constructed curbs in front of their property. Six of the eight property owners between 15th Street and Margaret Drive have signed requests to have curb and gutter constructed in front of their property. These owners own 368 feet of the 478 feet fronting on Irvine Avenue. I hope this letter will explain the project and clear up any questions you may have. This project will provide for the widening and reconstruction of Irvine Avenue from 15th Street to 16th Street. The street will be widened to the standard width for a secondary street of 64 feet curb to curb with an 82 foot wide right of way. The existing right of way is 60 feet. The additional 22 feet of right of way has been dedicated to the City by the Newport Mesa School District. The proposed street improvements include the reconstruction of Irvine Avenue from 15th Street to 16th Street, construction of curb and gutter, some sections of sidewalk on the westerly side of Irvine, and the reconstruction of curb, gutter and sidewalk on the easterly side of Irvine adjacent to the Newport Harbor High School. The enclosed sketch pictures an example of the existing conditions on Irvine Avenue and also the proposed widened Irvine Avenue. As you can see, the City does not plan to use any additional right of way on the westerly side of Irvine Avenue. On this side of the street there will be eight feet from the existing property line to the new curb face. On the easterly side of the street adjacent to the high school, the curb will be moved back four feet. After the completion of the.project, the angle parking will be removed and cars will be parked parallel to the curb. In addition to the proposed street improvements, a storm drain system will be constructed. This drain will run in Irvine from 15th Street to Holly Lane. Catch basins to pick up both nuisance and storm water will be constructed at 15th Street, Margaret Drive and Holly Lane. This system along with new curb and gutter on the westerly side of the street should greatly improve drainage in the area. DISCUSSION: Included in the current budget is a project for the widening and reconstruction of Irvine Avenue from 15th Street to 16th Street. The street will be widened to the standard width for a secondary street of 64 f6ot curb to curb with an 82 foot wide right of way. The existing right of way is 60 feet. The additional 22 feet of right of way will be obtained from the Newport - Mesa School District. The School District has requested, as a condition of the right of way dedication, that the existing inadequate street lighting system along Irvine Avenue be replaced by a new system which meets City standards. This, along with the replacement of sidewalks, curbs, and gutters, is to be done at no cost to the District. Installing a new street lighting system in lieu of relocating the existing system will allow the Southern California Edison Company to eliminate the power poles in front of the High School from 15th Street to 16th Street.
