In addition, we have coordinated with and obtained significant data,
reports, maps, and other materials from various City of Newport Beach
staff, including Mr. Philip Bettencourt, Mr. Lawrence Wilson, and Mr.
Rod Gun. We have completed the initial research and coordination
efforts as outlined in our contract and we have made a presentation
to the Newport -Mesa Unified School District and visual surveys of
residential areas. We are also preparing a questionnaire survey of
Irvine Industrial Complex firms in cooperation with the City of Newport
Beach and Darley /Gobar Associates in order to secure data about future
private corporate jet activity and air cargo jet activity.
B. Paul S. Veneklasen E Associates
Paul S. Veneklasen b Associates has performed work tasks in the Initial
Research and Coordination Efforts Phase and certain tasks within the
Preliminary Impact Analysis phase.
These work tasks include;
Establishment of an official line of communications with Mr. Lou
Sutherland of Wyle Laboratories, and agreement with the "A"
weighted sound level as the principal scale for measuring noise
levels and as a basis for establishing acceptable noise criteria.
2. Analysis and evaluation of the noise standards developed by Wyle
Labs for the California Department of Aeronautics, including
developing correlation techniques and methods of interpretation
and application.
3. Monitoring of Department of Aeronautics public hearing on May 19
in Los Angeles concerning the pros and cons of the new noise
standards developed by Wyle Labs.
4. Joint presentation with Wilsey C Ham staff and Mr. Bettencourt to
the Newport -Mesa Unified School District on the work program.
5. Attendance at Orange County Board of Supervisors meeting, May 12,
1970, to hear a presentation and to evaluate the Northrop Corp.
airport noise monitoring system.

6. Visual survey of areas west of the airport in order to analyze land
uses, building construction types and quality, topographic condi-
tions as related to sound propagation characteristics, and obser-
vation of aircraft flight patterns. Tentative locations were also
selected for places to take further measurements of aircraft noise
levels.
7. Current work is to concentrate on developing noise contours based
upon the Wyle Labs reporting method and to map these according to
existing operations at the airport as they impact upon the City
of Newport Beach.
C. Darley /Gobar Associates, Inc.
To date Darley /Gobar Associates' research may be separated into two
activities, data collection and analytical system development.
Functions performed in these two activities are outlined below:
I. Data Collection
a. Interviews have been conducted with the Orange County Chamber
of Commerce, Orange County Planning Department, the Los Angeles
Department of Airports, the Irvine Co., and other public and
private agencies.
b. Data search of airport air traffic demand and air - related land
use studies have been conducted. These include FAA studies,
airport feasibility studies, airline marketing studies, tech-
nical reports, and papers presented to learned societies.
The most valuable of these are: Landrum and Brown's Survey
of the Los Angeles International Airport's Markets, various
airline market surveys, FAA reports outlining activity at
California airports, and Wilsey 6 Ham's Land Use Impact Study
for San Francisco Airport.
C. Demographic data have been collected for Orange County from
the 1960 Census and updated by the various special censuses.
From these the number of households by income level for each
Orange County city and the unincorporated areas have been
determined.
d. Orange County employment data by one -mile grid have been pre-
pared from data secured from the State of California Department
of Human Resource Development.

e. Research is still under way to ascertain the industries which
may be expected to make extensive use of the private, commercial,
and freight facilities at Orange County Airport. Private house-
holds' propensity to fly by income, occupation, or other relevant
socio- economic characteristics is also being subjected to further
study.
f. Land use and land value data have been assembled from various
secondary sources and from the Orange County Assessor.
2. Analytical Systems
a. Darley /Gobar's land use forecasting model has been applied to
the Orange County Airport area to determine expected land use
without the airport. When the Parsons report becomes avail-
able, the modified formulation of the model will be run for the
area. The second run will accommodate the inclusion of the
instantaneous population generated from the expected level of
operation of the Orange County Airport.
b. From marginal output as developed in a. and from land uses
determined suitable from the sound data of Veneklasen ✓r Asso-
ciates the impact upon land values is currently being evaluated.
It will then be possible to determine the impact upon tax reve-
nues to the relevant jurisdictions. These will then be separated
into revenues generated by airport- created land use demand and
land use demand attracted from other Orange County areas.
C. A gravity system forecasting air demand from Orange County
industry and Orange County households at LAX, Ontario, and
the Parsons proposed level of operations will be compared to
determine the demand at Orange County Airport. This will
permit estimation of sales tax, gas tax, and other population
and use - related revenues.
d. A benefit -cost approach has been devised which will implement
evaluation of the economic impact determined in b. and c. above,
along with financial and environmental cost data.

AGREEMENT FOR
ORANGE COUNTY AIRPORT IMPACT STUDY
THIS AGREEMENT, made by and between the CITY OF NEWPORT
BEACH, a municipal corporation (hereinafter referred to as CITY),
and WILSEY & HAM, a California corporation (hereinafter referred
to as CONSULTANT):
W I T N E S S E T H:
WHEREAS, CITY has determined the public interest requires
a comprehensive study of the current and long -term impact of the
Orange County Airport on all aspects of the environment in the
Newport Beach Metropolitan Area be accomplished and the conclusions
will be required as a guide for municipal policies of the CITY;
and
WHEREAS, CONSULTANT is qualified to undertake and complete
such a project and is willing to undertake the same;
NOW, THEREFORE, the CITY and CONSULTANT in consideration
of the mutual covenants and agreements hereinafter contained, do
hereby agree, each with the other, as follows:

I. OBJECTIVES
The objectives of the study shall be as hereinafter
1. That the policies and programs of Federal,
County, City and other public agencies be directed toward the
current and projected role of Orange County Airport.
2. To ascertain the views of commercial air
carriers with regard to short -term and long -term operations at
Orange County Airport.
3. To obtain views of representatives of local
institutions and organizations concerning existing and projected
problem areas within Newport Beach resulting from airport

operations,
4. To gather from public and private sources
specific data and studies and develop an evaluation of the
environmental, economic, and developmental effects of Orange
County Airport on the Newport Beach community.
5. To identify impact of the airport on local
development, policies, programs, and regulatory controls with
regard to land usage, locational criteria for airport- sensitive
uses, and zoning controls within high impact areas.
6. To identify measures available to the CITY
which could reduce the unfavorable impact of Orange County Airport
on the CITY.
II. SCOPE OF STUDY
The work to be done by CONSULTANT in this study
is set out in Exhibit "A ", attached hereto and by this reference
made a part hereof.
III. PERFORMANCE
CONSULTANT agrees to commence work on the project
following receipt by CONSULTANT of a fully executed copy of this
Agreement and to diligently continue the same to completion in
accordance with the following schedules
1. CONSULTANT will provide an interim oral report
to the City Council at its meeting on May 25, 1970.
2. CONSULTANT will provide an interim oral and
written report to the City Council, including a critique of the
Ralph M. Parsons Company findings and recommendations for Orange
County Airport, not later than July 27, 1970.
3. CONSULTANT will provide an interim oral and
written report to the City Council not later than September 28,
1970. This report will contain the preliminary findings and
recommendations of CONSULTANT, and will be presented together with

appropriate graphics and charts in an Executive Session of the
City Council for its review. Based upon the Council's concurrence
and recommendations following this review session, CONSULTANT
will deliver the final reports to the Council four weeks from the
receipt by CONSULTANT of the concurrence and recommendations of
the City Council.
4. CONSULTANT will make progress reports, oral
and written, to the designated CITY Project Manager on June 12,
1970, and August 14, 1970.
5. CONSULTANT and /or CONSULTANT's associates
will be in the City of Newport Beach and environs on numerous
occasions in the process of interviewing businesses, public
officials, private citizens, air travelers and others, and to
perform other duties in the process of this work. CONSULTANT will
advise the CITY's designated project representative in advance of
these planned visits in order to facilitate coordination of the
project with the CITY. In addition, CONSULTANT will be represented
at progress report sessions scheduled by the County's Airport
Consultant with the County Director of Aviation on Friday, May 8,
1970; Friday, June 12, 1970; Monday, July 13, 1970; Friday,
August 14, 1970; and Monday, September 21, 1970.
IV. BILLING AND PAYMENT
For furnishing the services specified under
Exhibit "A" of this Agreement, CITY agrees to pay CONSULTANT the
sum of Forty -One Thousand Nine Hundred Dollars ($41,900.00).
The CITY shall not be legally obligated to pay CONSULTANT more
than $16,000.00 during the 1969 -1970 fiscal year. The CITY
shall be obligated to pay the balance of said $41,900.00 ($25,900.00)
only to the extent that the City Council budgets funds to pay said
balance in the 1970 -71 budget. Payment shall be made in four equal
monthly installments of Eight Thousand Dollars ($8,000.00) each,

and one payment of Nine Thousand Nine Hundred Dollars ($9,900.00).
The first payment shall be made one (1) month after the effective
date of this Agreement, and additional payments shall be made
thereafter on a monthly basis, for a period of four (4) consecu-
tive months. The final payment of Nine Thousand Nine Hundred
Dollars ($9,900.00) shall be made within thirty (30) days after
the acceptance by the CITY of the final report.
CONSULTANT shall be compensated for salary and
out -of- pocket costs for travel and subsistence on the basis of
Standard Fee Schedule Form C (dated October 1, 1968), marked
Exhibit "B" and attached hereto and by reference made a part
hereof, for any specific additional assignments, court appearances,
or authorized travel and appearances not set out in the scope of
services specified under Exhibit "A" of this Agreement.
Payment for approved and designated added work
and reimbursable expenses shall be on a calendar month basis and
shall be made at monthly intervals during the progress of the
work within thirty (30) days after presentation to the CITY of
detailed statements enumerating these costs together with
supporting vouchers duly certified by CONSULTANT.
V. DESIGNATION OF AUTHORIZED REPRESENTATIVES
CONSULTANT hereby agrees, upon the signing of this
Agreement to furnish the CITY in writing the name of an individual
who will be authorized to act in person or through his designee
for CONSULTANT in all matters pertaining to the study. Such
individual shall be approved by the CITY's Chief Administrative
Officer.
CITY agrees, upon signing of this Agreement, to
furnish CONSULTANT the name of an individual who, as the CITY's
Project Representative, will be authorized to act in person or
through his designee as representative for the CITY in all matters

pertaining to this study.
It is understood and agreed by said parties that
the authorized representatives may be changed provided the parties
to this Agreement so desiring the change give at least five (5)
days' prior notice in writing to the other, naming its new
authorized representative, and that CONSULTANT's said represents-
tive shall be acceptable to the CITY.
VI.
All departments of the CITY will assist CONSULTANT
in the performance of this study, and CONSULTANT agrees to make
maximum practical use of information and staff personnel of the
CITY departments in the gathering of data and the preparation of
said reports. CITY shall also provide letters of introduction of
CONSULTANT to such other persons, firms, or governmental entities
as necessary to assist CONSULTANT in obtaining required data. In
particular, the CITY will make an official request to the Super-
visors of Orange County to obtain from them the official coopera-
tion of the County, its staff, and its airport planning consultant
to work with CONSULTANT in the development and standardization of
the basic information, criteria, historical data to the degree
necessary to assure that the results of this study as well as the
County's Airport Master Plan Study running concurrently will be
meaningful to both the CITY and Orange County.
The use of CITY records and personnel by CONSULTANT
shall be coordinated through the CITY's representative.
VII. OWNERSHIP OF REPORTS AND DATA
All reports, exhibits, data, and other work or
materials furnished hereunder shall be and remain the property of
the CITY and may be used by CITY as may be required, without addi-
tional cost to the CITY. This provision shall not apply to
material prepared by CONSULTANT for other clients or for itself.
VIII. CHANGES IN WORK
CITY may, at any time, by written request of the
CITY's Project Representative, make any minor changes in the
services to be provided hereunder, not involving a change in the

scope of the work, and at an additional cost not to exceed
One Thousand Five Hundred Dollars ($1,500.00). If such changes
cause any increase in the cost of doing the work under this
Agreement or in the time required for its performance, an adjust-
ment as mutually agreed upon will be made by CONSULTANT and the
CITY, and the Agreement shall be modified in writing accordingly.
Any claim for adjustment under this article must be made in writing
to the CITY's Project Representative within fifteen (15) days from
the date the change is requested.
IX. TERMINATION
This Agreement is subject to termination by the CITY
at any time upon serving written notice to CONSULTANT, and the
CITY shall thereafter be liable to CONSULTANT for fees and costs
accrued to the date of receipt by CONSULTANT of such notice.
X. NOTICES
All notices to CONSULTANT under this Agreement
shall be valid and effective if served upon WILSEY & HAM, postage
prepaid, by certified and /or registered mail, addressed to WILSEY &
HAM at 1035 East Hillsdale Boulevard, San Mateo, California 94404.
All notices to the CITY under this Agreement shall
be valid and effective if served upon the City Manager or mailed
postage prepaid, by certified and /or registered mail and addressed
to the City Manager, City Hall, 3300 Newport Boulevard, Newport
Beach, California 92660.
XI. GENERAL PROVISIONS
In this Agreement, whenever the context so requires,
the masculine gender includes the feminine and /or neuter and the
singular includes the plural.
The title of paragraphs herein are used for con-
venience only and shall not add to or detract from or otherwise
govern the interpretation of the form or substance of any said
paragraphs.

This Agreement represents the complete understanding
between the parties with respect to matters set forth herein. No
amendment or modification of this Agreement shall be valid unless
evidenced in writing and signed by the parties hereto.
IN WITNESS WHEREOF, the parties hereto have caused this
Agreement to be executed on the date set forth opposite their
respective signatures.

EXHIBIT "A"
SCOPE OF STUDY
CITY OF NEWPORT BEACH AIRPORT IMPACT STUDY
1. INITIAL RESEARCH AND COORDINATION EFFORTS
(a) With the assistance of the City, establish official line
of communication with Orange County Airport and
Consultant for Phase II of the Master Plan of Air
Transportation for Orange County.
(b) Review all pertinent records pertaining to traffic,
occupancy, and usage of Orange County Airport and the
system of highways serving the airport and its environs.
(c) Review the report of noise levels produced by operations
at Orange County Airport if it will be made available for
review by the County.
(d) Establish a system of reporting noise levels which will
be consistent with the County study and the California
State Advisory Committee for Developing Aircraft Noise
Standards to insure that a system common to both the
County and this study will be utilized to facilitate
comparisons.
(e) One meeting with the Newport -Mesa Unified School District
Board to discuss the acoustical aspects of the project
and shared interest.
(f) One meeting with representatives of local citizens'
groups to discuss their positions with respect to airport
impact, the acoustical aspects of the project, and shared
interests.
(g) Visually survey areas of Newport Beach which are or may
be affected by airport operations. The survey would
include;

(1) Land use;
(2) Categories of building construction;
(3) Influence of terrain;
(4) Observation of aircraft traffic patterns;
(5) Existing and future patterns planned for land
utilization;
(6) Selection of locations for noise documentation;
(7) Discussion with airport and airline officials to
determine the following:
a. Current and projected aircraft schedules;
b. Current and projected aircraft types;
C. Flight patterns (This is to include discussions
with military officials to ascertain the
relationship of military flight patterns with
operations at Orange County Airport.);
d. Reference to current FAA regulations.
(8) Discussion with FAA air traffic control officials
to determine the following:
a. Capacity of air traffic control system to
accommodate current traffic at Orange County
Airport;
b. Capability of the system to accommodate increased
air traffic activity;
c. Scope of any proposed modifications to the
system;
d. Current and proposed future regulations of FAA
concerning control of aircraft noise and
pollution.
(9) Obtain information from the Air Pollution Control
District officials and the FAA concerning current
levels of air pollution originating at Orange County

Airport;
(10) Meet with County airport officials and County
consultant to standardize data developed, and to
exchange information and report progress of study;
(11) Meet with Newport Beach City officials to summarize
the extent of development of basic information.
2. PRELIMINARY IMPACT ANALYSIS
(a) Establish noise contours, overlaying maps of Newport
Beach and environs for operations at Orange County
Airport based upon two types of service:
(1) Current level of operation, limited general
aviation aircraft, executive jets, DC -9 and 737
twin jet type aircraft;
(2) Expansion of operations to include 707s, 727s,
DC -8s, and other four - engine jet aircraft based on
standard takeoff profiles.
(b) Develop tables to correlate noise contours with the
following:
(1) Subjective reaction of residents to the effect of
noise on outdoor living quality;
(2) Subjective reaction of residents to the effect of
noise on indoor living quality;
(3) Effect of noise on non - residential land use. Parti-
cular emphasis to be placed upon schools and other
occupancies where speech communication is vital.
(c) Translate the correlation of noise contours and subjective
rating tables to new sets of contours or zones defining
impact in terms of subjective reaction, corrective
construction requirements, influences on schools, etc.
(d) Obtain preliminary progress reports from County study to

determine its range of extent of any enlargements proposed
for the airport facilities, relating same to maximum
activity such improvements could produce, translating same
to impact factors on related areas.
(e) Meet with City of Newport Beach officials to present
summarization of this phase of work in a working discussion.
3. COMMUNITY ANALYSIS
Develop land use policies, plans, and controls based upon
planning studies conducted in coordination with the analysis
of economic, environmental, and operational impacts resulting
from various alternative levels of service planned for Orange
County Airport (assuming this information is made available
by Orange County). Primary emphasis to be placed upon the
development of planning proposals, controls and programs for
the City of Newport Beach. Analyze and consider area develop-
ment factors and airport- generated impact related to adjoining
jurisdictions. These planning studies will involve:
(a) Identification in graphic form of areas most directly
affected by airport operations in terms of economic,
environmental, and developmental impacts.
(b) Evaluation of projected airport impact, City and area
developmental proposals, circulation system requirements,
and public facility needs on the developmental potentials
within affected areas. Use potentials of land and water
(including any ecological ramifications, and effects on
Upper Newport Bay recreation values) will be analyzed
with respect to airport relationships; noise pollution
effects; air pollution effects (if information available);
land markets; City, County, and area development
objectives; and ability of future circulation and public

facility systems to support various uses.
(c) A determination of feasible development alternatives
for high impact areas to minimize adverse airport effects
and achieve maximum compatibility with alternative
operational and use patterns within and adjacent to
Orange County Airport will be made. Land uses, water
uses, development densities, supporting public facilities
and traffic systems, and locational requirements for
public and institutional facilities will be considered
and indicated.
(d) Recommendations will be made for land use zoning,
building controls, public facility locational standards,
height restrictions, and other regulatory programs to
achieve suggested planning and environmental objectives
within high - impact areas.
(e) Preparation of recommended municipal policies to guide
short -run and long -term development of areas most directly
affected by future airport operations. These recommended
policies and programs will be coordinated with suggested
airport operational programs and means of achieving inter-

4. ECONOMIC EVALUATION AND ANALYSIS
Will consider and compare the following general types of
benefits;
(a) Industrial and commercial activity.
(1) More primary jobs;
(2) More transient activity;
(3) Increase primary jobs in air service employment;
(4) Image;

(5) Multiple impacts from:
a. Increased employment to serve the needs of
the primary types identified above;
b. Increased land values occasioned by the pressure
of increased population and economic activity;
c. Improved tax collection from income taxes,
sales tax, and real property taxes associated
with increased levels of economic activity.
(b) Ease of travel (commercial and vacation travel). Will
be evaluated as a community benefit based upon informa-
tion made available by determining the destination of
flights from local airports as related to the best
alternative airports. Determination of the market and
projected markets for air travel by Orange County
residents.
(c) Segmentation of benefits. The impact of the benefits
will be identified with various subcategories of County
and non - County populations. This will be identified
in terms of their impact on different income classes and
compared or related to costs relating to the benefits.
(1) Financial costs.
a. Taxes to support facility;
b. Tax base reduction;
c. Necessary public facilities to support
increased population, industry, and traffic
congestion.
(2) Environmental costs.
a. Noise pollution;
b. Air pollution;
c. Changes in socio economic profiles;
d. Reduction of residential amenities;

f. Aesthetic costs.
5. Prepare and submit for review by the City conclusions concerning
the impact upon the City of Newport Beach by various proposed
or assumed levels of operation and development at Orange
County Airport, and identify various alternative plans of
reaction which may be open to the City. Identify any common
areas of economic tradeoff between programs of County airport
development and development programs of the City of Newport
Beach whereby the plans of each may be realized within some
range of compatible balance. Identify areas of potential
tradeoff or compromise, make recommendations concerning policy
for consideration by the City of Newport Beach. .
6. Review recommendations with the City Council of Newport Beach
pointing out alternatives discovered in the course of this
study and the benefits and penalties associated with each.
7. Following review and with approval by the City Council,
produce a report document setting out optimum recommendations,
plans, and a program for action by the City of Newport Beach.
8. Print report, exhibits, and make public presentation to the City
Council of Newport Beach.

expenses (which may be referred to as "time and materials;' or "standard billing") will be the stmn of all

1. 2.2 times salary cost. Salary cost is defined as total hours worked times the employee's straight-
s time rate of pay on an hourly basis plus 20% allowance for payroll taxes and other employee
benefits. All time spent in connection with the order by executive, professional, sub - professional,
technical, and clerical employees will be included.

2. Overtime premium (overtime hours worked times the difference between overtime and straight-
time pay rates) if the client's requirements make overtime work necessary.

1. Reimbursement for actual travel and subsistence expenses paid to, or on behalf of, employees.
2. Fourteen (14c) cents per mile for use of vehicles. A minimum of one dollar ( ;1.00) per hour

C. OUTSIDE SERVICES
1. Invoice cost of services and expenses charged to Wilsey & Ham by outside consultants, profes-

1.1 The invoice cost of reproduction work other than that done by Wilsey & Ham.
2: Eight cents per square foot of blue -line prints, 25 cents per square foot for duplicate tracing,
15 cents per letter -size photocopy and 25 cents per legal -size photocopy, for reproductions made
by Wilsey & Ham.
E. MISCELLANEOUS EXPENSES

If desired, adopt Resolution No. 7/ authorizing execution of an agreement
between the City of Newport Beach an Fir—m—oT Wilsey & Ham for performance of the
Orange County Airport Impact Study.
DISCUSSION:
At the City Council meeting of Tuesday, February 24, 1970, the staff was in-
structed to negotiate a contract with the firm of Wilsey $ Ham for this project. The
text of a tentative contract was provided to members of the City Council and was dis-
cussed at the Council study session of Monday, March 23.
Since that time this project was reviewed with the City's Air Traffic Ad-
visory Committee on the morning of Thursday, April 2, 1970. Copies of the tentative
agreement were also provided to County officials for review and comment on the after-
noon of Thursday, March 2.6. On the afternoon of Wednesday, April 1, 1970, this project
was discussed with the County Director of Aviation, the Wilsey $ Ham project team and
the Ralph M. Parsons project team. This was to insure that the proposed scope of work
was sufficient to meet the City's requirements and to reduce overlapping and duplication.
Tie. contract before the City Council represents an intelligent and comprehen-
sive approac: to this potentially serious community problem. The attached Tentative
Airport Study Schedule has been revised since the Council meeting of March 23rd. It
now reflects specific dates that the City's consultants will review the Orange County
Phase II Master Plan of Air Transportation Study with the Ralph M. Parsons Company and
the C6unty'Director of Aviation.
3ecause the potential imbalance of the City's General Fund had not been anti-
cipated, it was not possible to divide this project into two phases to reduce the amount
of funds that would have to be encumbered during this fiscal period (see financial
position discussion in agenda package). Therefore, the contract should be amended at
Pagd 3 (First paragraph, Part IV) to read as follows with the new wording underlined:
IV. BILLING AND PAYMENT
For furnishing the services specified under Exhibit "A" of
this Agreement, CITY agrees to pay CONSULTANT the sum of Forty -One
Thousand Nine Hundred Dollars ($41,900.00). The CITY shall not be
legally obligated to pay CONSULTANT more than 16,000.00 uring t
1969 -10 fiscal ear. The CITY shall be obli ated to a the balan
of said 41,900.00 25.900.00) only to e extent that the City
Thousand Dollars ($8,000.00) each, and one payment of Nine Thousand
Nine Hundred Dollars ($9,900.00). The first payment shall be made
one (1) month after the effective date of this Agreement, and ad-
ditional payments shall be made thereafter on a monthly basis, for
a period of four (4) consecutive months. The final payment of Nine
Thousand Nine Hundred Dollars ($9,900.00) shall be made within
thirty (30) days after the acceptance by the CITY of the final report.

This wording (which has been approved by the City Attorney) will insure that
only the available funds are encmbered at this time and yet will permit the project to
begin in a timely manner. It is assumed, of course, that the City Council will want
to complete the project by appropriating funds during the 1970 -71 period. The City's
interests asfar as the incurrence of financial obligations are fully protected.
