Firestone Internal Audit Division Re: Joint Powers Agreement Dear Mr. Firestone: It has been brought to our attention that your office has discovered an outstanding fund which was established in June of 1970 by a Joint Powers Agreement between the County of Orange, The Coastal Area Protective League, the City of Newport Beach, the City of Laguna Beach and the City of San Clemente for the employment of a legislative consultant to assist with the passage of the "California Marine Sanctuary Act of 1969." A copy of the agreement is attached for your information. The Agreement provides for termination by Resolution of the governing bodies of all the parties. To the best of my knowledge, none of the signators have passed such termina- tion resolutions. The Newport Beach City Manager was responsible for coordinating the Agreement between the parties. The purpose of the Aqreement is obviously moot today. If this procedure meets with your approval, we would request that any remaining funds on deposit in this account be returned to the contributing parties in amounts proportionate to their respective contributions. To employ Fred Burke of Industrial Development Associates in Washington, D. C. to take necessary action to assist in securing passage of S.1447 as introduced in the Senate of the United States or similar legislation to prohibit drilling and leasing of Federal tidelands which are seaward of Marine sanctuaries which have been established under the State law. 2. For his services he shall be paid the sum of $200.00 per day as a consulting fee, plus necessary expenses. 3. The contributions from NEWPORT BEACH, LAGUNA BEACH and the LEAGUE shall be made payable to the County of Orange for deposit by the Auditor - Controller of the County of Orange in a special fund for dis- bursements. COUNTY shall contribute the sum of $5,000 from the Sunset Tidelands Budget Fund 108, Budget Unit 7041, Account 190 and shall be placed in the same fund. The Auditor- Controller shall be entitled to 1. Z4� z 'Mayor "NEWPORT BEACH" CITY OF LAGUNA BEACH By Mayor " LAGUNA BEACH" COASTAL AREA PROTECTIVE LEAGUE By 1 JOINT POWERS AGREEMENT FOR THE EMPLOYMENT 2 OF A '"' cz Pip i ti; .., LEGISLATIVE CONSULTANT 4 Pursuant to Title I, Division 7, Chapter 5 of the Government 5 Code of the State of California (Sections 6500 to 6513), a Joint Powers 6 Agreement is hereby entered into between the COUNTY OF ORANGE, the 7 COASTAL AREA PROTECTIVE LEAGUE, a non- profit corporation incorporated 8 in the State'of California, the CITY OF NEWPORT BEACH, the CITY OF 9 LAGUNA BEACH, the CITY OF SAN CLEMENTE, 10 11 12 WHEREAS, on October 29, 1969, a bill known as S.3093, "The 13 California Marine Sanctuary Act of 1969," was introduced in the Congress 14 of the United States for the purpose of extending the boundaries of the ' 15 marine sanctuaries established by the State of California, wherein the 16 production of oil, gas and other hydrocarbon substances is prohibited, 17 to the Federal submerged lands adjacent to said State sanctuaries; and 18 WHEREAS, the County of Orange and the coastal cities of Orange 19 County have a direct and vital interest in the passage of this legislati , 20 or other similar legislation, in that it would afford the coastal areas 21 of the county and state protection against the serious pollution problems 22 which could result from pollution caused by drilling or production 23 equipment involved in off -shore exploration or production. 24 WHEREAS, the parties to this Agreement have determined that in 25 order to obtain passage of this legislation it will be necessary to 26 retain the services of a Legislative Consultant. 27 NOW, THEREFORE, the parties agree as follows: 28 1. DESIGNATION OF REPRESENTATIVES FOR THE PURPOSE OF 29 THIS AGREEMENT 30 Each City which is a party to this Agreement, the County 31 of Orange, and the Coastal Area Protective League, shall designate a 32 representative who is authorized to act on behalf of each party for the �. 1. purpose of this Agreement. Each City representative shall be a member of a City Council. 2. EMPLOYMENT OF LEGISLATIVE CONSULTANT The representatives shall have the power to contract with a Legislative Consultant to act on their behalf provided that any expenses incurred by this group shall be limited to amounts which have been paid by the parties. 3. CONTRIBUTION OF FUNDS Each party to this Agreement shall pay the following sums for the purpose of this Agreement to the County of Orange, which sum shall be maintained separately and be used solely for the purposes of this Agreement: ORANGE COUNTY $ 5.000.00 COASTAL AREA PROTECTIVE LEAGUE $_2.500.00 CITY OF NEWPORT BEACH $ 2,000.00 CITY OF LAGUNA BEACH $ 2,000.00 ✓ CITY OF SAN CLEMENTE $ 1,000.00 V 4. COORDINATOR OF AGREEMENT The City Manager of the City of Newport Beach shall be responsible for coordinating this Agreement and shall serve as liaison representative between the Legislative Consultant and the representatives of the parties to this Agreement. He shall be authorized to approve the payment of claims against the fund maintained by the County of Orange. 5. DEBTS No debt, liability or obligation incurred pursuant to this Agreement shall constitute a debt, liability or obligation of any party to this Agreement. 7. TERMINATION OF AGREEMENT This Agreement may be terminated at any time by resolutions of the governing bodies of all of the parties to this Agreement. Upon termination, all just claims incurred pursuant to this Agreement shall be paid, and the funds, if any, remaining on deposit in the County Treasury shall be returned to the contributing parties in amounts proportionate to their contributions to the fund. 8. EFFECTIVE DATE This Agreement shall become effective upon its execution by the County of Orange, the Coastal Area Protective League, and at least one city. Your letter was reviewed by the Newport Beach City Council at its meeting of March 23. The City Council indicated its unanimous position that this anti -oil exploration and production bill is of vital importance to this city and to every city and county within the established California oil sanctuaries. Although no dollar amounts were discussed, the City Council also stated that it was willing to provide city funds to assist in the Washington, D. C. effort. Supervisor Allen carried a similar message to the Board of Supervisors on Wednesday, the 18th of March, and has obtained indications of sub- stantial approval of a similar policy position. Each coastal city in Orange County has a direct interest in the success of Senate Bill 3093, and this City would urge your City Council to con- sider the question of financial support for the effort to be made in Washington. If the cities and County are unanimous in their position, a meeting should be quickly scheduled in order to work out the financial details.
