DISCUSSION: E- The contract for the construction of the Buffalo Hills Park Improvements has been completed to the satisfaction of the Public Works Department. The bid price was: Amount of unit price items constructed: Amount of change orders: Total contract cost: $ 78,622.26 78,280.52 606.59 7$,887.11 Amount budgeted in Account No. 27 -7797 -017: 93,30p.00 There mere two change orders, one for the addition of a water line near Ford Road, the other for modification to the existing sprinkler system in the northerly portion of the park. The contractor is Industrial Turf of Laguna Hills, California. Plans were prepared by Courtland Paul and Associates. The contract date of completion was July 17, 1969. It provides in substance:as follows: 1.. Developer is to prepare plans and specifications for the development of the entire park site including the portion which is intended for future school use. 2. After the plans and specifications have been approved by both the City and the Developer, the City will call for public bids and will award a contract for the work. 3, Prior to the award of the contract, the Developer is to deposit the estimated cost of the project with'the City. 4. The City's financial obligations are: (a) To reimburse the Developer from the Building Exise Tax Fund, less the sum of $14,941.00 which the Developer is contributing to the project; (b) To reimburse the Developer for architectural fees not to exceed $5,200 and engineering fees not to exceed $1,000, which are attributable to the 5.73 acres deeded to the City. 5. With respect to the parcel which is to be conveyed to the school district, the City will be obligated to reimburse the Developer only if the school district declines to accept the property and fee title is conveyed to the City within 10 years after the date of the agreement. 6. The sum to be reimbursed to the Developer for the improvements constructed on the 5.73 acres owned by the City is payable in semi - annual installments over a period of 10 years beginning in 1969. 7. The contingent sum for improvements on the proposed school district property, which the City will be obligated to pay G1 Toe City Council -2- November 12, 1968 only if title to the property is conveyed to the City, will be payable in semi - annual installments commencing during the year in which the City acquires title, and extending for a period of 5 years thereafter. Approve acceptance and development of the future school site portion of the park in accordance with the at- tached proposal, subject to such proposal being formally accepted by the Newport -Mesa Unified School District. DISCUSSION: In accordance with instructions from the City Council_a ... cost- sharing arrangement has been worked out with the Bren Company for de- velopment of the Upper Harbor View Hills Park. A plan has also been developed for use of the southerly two acres which will hopefully ev- entually become part of a school site. This has been reviewed with the officials from the School District. However, the School Board has yet to take official action on the matter. The school officials are present- ly studying the legal ramifications of the proposed financial arrangement. - Basic agreement has been reached with the Bren Company on de- velopment of the northerly entrance and the City staff is now working out the details. Plans should be available for review by the City Council at the meeting of October 7. The attached summary spells out in detail the cost - sharing ar- rangement which would result in an initial expense to the City of $84,862 with $15,912 being reimbursable at such time as the School District might develop its school site in the Upper Harbor View Hills community.. Pay- ments from the building excise tax fund w- ould.commence._no earlier than July l,_ 1969; and would be spreacbver a ten year period in the amount of- $4;243 paid semi - annually. This complete financial arrangement meets with the approval of the Bren Company and has been confirmed in a letter on file with the City Council. Designated area "A ", constituting the main park, includes 5.73 acres and would be turned over to the City in fee title by The Irvine Company. Designated area "B ", which is to the,rear of the community as- sociation building, would be completely developed by the Bren Company and then turned over in fee to the City. This would constitute .36 acres. Designated area "C ", which is the future school site and which constitutes approximately 2 acres, would be made available to the City for park use and would ultimately be turned over to the City in fee title if it were not acquired by the School District within a period of five years. The foregoing would constitute a total park area of 8.09 acres with 6.09 acres belonging to the City and possibly 8.09 in the event the planned school does not.materialize. This agreement is patterned after the reimbursement agreement used in connection with the development of the East Bluff Park. IC Provides in substance as follows; !' 1. Developer is to prepare plans and specifications for the ;i development.of the entire park site including the portion which is intended for future school use. 'j 2. After the plans and specifications have been approved by both y the City and the Developer, the City will call for public bids and will award a contract for the work. 39 Prior to the award of the contract, the Developer is to deposit the estimated cost of the project with the City. 40 The City's financial obligations are: i (a) To reimburse the Developer from the Building Exise Tax Fund, less the sum of $14,941.00 which the Developer is contributing to the project; !
