AGREEMENT FOR ENGINEERING SERVICES
(Master Plan - Bayside Drive Between Carnation Avenue
and Marguerite Avenue)
THIS AGREEMENT is made and entered into this n ILL_

Of -J-y# t , 1970, by and between the CITY OF NEWPORT
BEACH, a municipal corporation, herein referred to as "City ", and
Shuirman- Simpson, a civil engineering consulting firm, herein
referred to as "Engineer ".
RECITALS
A. City proposes to update the Master Plan for Bayside
Drive between Carnation Avenue and Marguerite Avenue; and
B. Engineer has submitted a proposal to perform the
necessary engineering services in connection with said project.
AGREEMENT
1. City engages Engineer to furnish the services herein-
after mentioned, at and for the compensation herein stipulated, and
Engineer accepts said engagement upon the terms hereinafter set
forth.
2. Engineer shall:
(a) Prepare planning -type drawings on standard
City size sheets showing the following:
1. A 40 -scale photo map showing existing lot
lines and street right -of -way lines.
2. Proposed street improvements superimposed on
the above photo map, including sidewalks,
driveways, and frontage roads.
3. Existing and proposed water lines, sewer
lines, and storm drains superimposed on
duplicate copies of the above photo map.
4. Incorporate in the overall plan a landscaping
element to be developed by the City Parks,
Beaches and Recreation Department staff.
(b) Provide an aerial photo map of Bayside Drive between
Carnation Avenue and Marguerite Avenue.
3. Original drawings, reports, notes, maps and other doc-

uments shall become the property of the City and may be reproduced
as deemed necessary by the Public Works Director.
4. City reserves the right to terminate this contract at
any time by giving Engineer three (3) days' prior written notice
in the United States mails, postage prepaid, addressed to any of
Engineer's business offices. In the event that City shall termin-
ate this contract, it shall reimburse Engineer on the basis of its
standard fee schedule contained in its proposal dated June 8, 1970.
5. All plans, specifications and other documents for the
project shall be completed to the satisfaction of the Public Works
Director of City and delivered to him within ninety (90) calendar
days following authorization by City to proceed.
6. In consideration of the performance of the above des-
cribed engineering services, City agrees to pay Engineer an amount
based upon the standard fee schedule contained in Engineer's pro-
posal dated June 8, 1970, but in no event shall said amount be
greater than $5,000. The amount to be paid to Engineer shall be
payable as follows:
(a) Monthly partial payments, each payment to be the
amount earned as determined by the fee schedule. The
sum of the monthly partial payments shall not exceed
ninety percent (90 %) of the above maximum fee.
(b) The balance of the total amount to be paid upon
receipt of the final drawings and aerial photo. The
aerial photo map shall be invoiced at cost.
In addidtion, City shall reimburse Engineer for
the actual cost of reproduction of copies of said plans,
specifications and related documents, and filing fees,
checking fees and other related costs authorized by the
Public Works Director and advanced by Engineer.

7. Engineer shall'j.pdemnify and save harmless the City,
and its officers and employees, from all damage and liability
arising from any errors, omissions, or negligence in Engineer's
performance of this contract and of the engineering work and
services herein provided.
IN WITNESS WHEREOF, the parties have executed this con-
tract as of the day and year first above written.
