(Newspaper Salvage Program)
THIS AGREEMENT is made and entered into this
day of — 1970, by and between the CITY OF
NEWPORT BEACH, a municipal corporation, herein referred to as
"City ", and MEN -CAL CORPORATION, herein referred to as
"Corporation"
WHEREAS, it may be economical for City to salvage
newspapers from the City's refuse collection, there being a
market for clean newsprint; and
WHEREAS, it does not appear feasible for City's
Refuse Division to attempt a separate collection of newspapers
with the type of refuse collection equipment now in use; and
WHEREAS, Corporation has the personnel and equipment
for providing such a service; and
WHEREAS, the City Council has authorized the City
Manager to enter into an agreement with Corporation whereby
Corporation will collect newspapers in the City on a trial
basis for one month in order to evaluate the feasibility and
desirability of continuing and expanding such a program.
NOW, THEREFORE, in consideration of their mutual
promises the parties hereto agree as follows:
1. Corporation will furnish one stake body truck
and two employees to work with the City rubbish truck in a
designated area.
2. Corporation's employees will be under the
supervision and control of the Newport Beach General Services
Director.

3. Corporation will work with City three days
per week for one month in this proposed program to salvage
newspapers. Corporation will pay to City $2.00 per ton for
all newspaper picked up during this period.
4. Corporation will furnish costs and tonnage
figures at the conclusion of the month for City's analysis.
5. Corporation agrees to indemnify and hold harmless
the City, the City Council and all City employees from any and
all injury, loss or damage that may arise from any errors,
omissions, or negligence in Corporation's performance of the
work and services in connection with this contract.
6. The term of this agreement will extend for 30
days from the commencement by Corporation of the hereinabove
described services. City reserves the right to terminate
this contract at any time by giving Corporation three (3)
days' prior written notice in the United States mails, postage
prepaid, addressed to any of Corporation's business offices.
7. Corporation shall provide City with a certificate
of insurance showing that Corporation carries a minimum liability
insurance as follows:
(a) Limit of liability for injury
or accidental death ...............$500,000
(b) Limit of liability for property
damage ..... .......................$100,000
The certificate shall name City as an additional
insured for the purposes of this agreement.
