NOTICE INVITING BIDS
SEALED BIDS will be received at the office of the City Clerk, City Hall, Newport Beach,
California, until 3:30 P.M . on the 7th day of September , 1971

CONTRACT NO. 1325
Bids must be submitted on the proposal form attached with the contract documents furnished
by the Publit Works Department. The additional copy of the proposal form is to be
retained by the bidder for his records.
Each bid must be accompanied by cash, certified check or Bidder's Bond, made payable to
the City of Newport Beach, for an amount equal to at least 10 percent of the amount bid.
The title of the project and the words "SEALED BID" shall be clearly marked on the
odtside of the envelope containing the bid.

These documents shall be affixed with the signature and titles of the persons signing on
behalf of the bidder. For corporations, the signatures of the President or Vice

be aff ed to all documents requiring signatures. In the case of a Partnership, the
signature of at least one general partner is required.
No bids will be accepted from a contractor who'has not been licensed in accordance with
the provisions of Chapter 9, Division III of the Business and Professions' Code. The
contractor shall state his license number and classification in the proposal.
Plans and Contract Documents, including Special Provisions, may be obtained at the Public
Works Department, City Hall, Newport Beach, California, at no cost to licensed contractors.
It is requested that the Plans and Contract Documents be returned within 2 weeks after
the bid opening.
The City has adopted the Standard Specifications for Public Works Construction (1970
Edition and Supplements) as prepared by the Southern California Chapters of the American
Public Works Association and the Associated General Contractors of America. Copies may
be obtained from Building News, Inc., 3055 Overland Avenue., Los Angeles, California 90034,

The City has adopted Standard Special Provisions and Standard Drawings. Copies of these
are available at the Public Works Department at a cost of $2.00 per set.

Notice Inviting Bids

Labor Code (Sections 1770 et seq.), the City Council of the City of Newport Beach has
ascertained the general prevailing rate of per diem wages in the locality in which the
work is to be performed for each craft, classification, or type of workman or mechanic
needed to execute the contract and has set forth these items in Resolution No. 6982,
adopted May 12, 1969. A copy of said resolution is available in the office of the
City Clerk, All parties to the contract shall be governed by all provisions of the
California Labor Code relating to prevailing wage rates (Sections 1770 -1781 inclusive),

All bids are to be computed on the basis of the given estimated quantities of work,
as indicated in this Proposal, times the unit price as submitted by the bidder. In case
of a discrepancy between words and figures, the works shall prevail. In case of an error
in the extension of a unit price, the corrected extension shall be calculated and the bids
will be computed as indicated above and compared on the basis of the corrected totals.
The estimated quantities of work indicated in this Proposal are approximate only,
being given solely as a basis for comparison of bids.
The undersigned has checked carefully all of the above figures and understands that
the City will not be responsible for any errors or omissions on the part of the under-
signed in making up this bid.
The undersigned agrees that in case of default in executing the required contract
with necessary bonds within ten (10) days, not including Saturday, Sunday and Federal
Holidays, after having received notice that the contract is ready for signature, the
proceeds of check or bond accompanying this bid shall become the property of the City
of Newport Beach.

of Newport Beach that said contract is ready for execution, then this obligation shall
become null and void; otherwise it be and remain in full force and effect, and the amount

CONTRACT
THIS AGREEMENT, made and entered into this 07 "N day of coca .-g , 19 -7 e ,
by and between the CITY OF NEWPORT BEACH, California, hereinafter designated as the
City, party of the first part, and E. L. White Co_ Inc.
hereinafter designated as the Contractor, party of the second part.
WITNESSETH: That the parties hereto do mutually agree as follows:
1. For and in consideration of the payments and agreements hereinafter mentioned
to be made and performed by the City, the Contractor agrees with the City to furnish all
materials and labor for the construction of
OCEAN BOULEVARD.AT HELIOTROPE AVENUE STORM DRAIN IMPROVEMENTS (CONTRACT NO. 1325)
and to perform and complete in a good and workmanlike manner all the work pertaining
thereto shown on the Plans and Specifications therefor; to furnish at his own proper
cost and expense all tools, equipment, labor, and materials necessary therefor, (Except
such materials, if any, as in the said Specifications are stipulated to be furnished by
the City), and to do everything required by this Agreement and the said Plans and
Specifications.
2. For furnishing all said materials and labor, tools and equipment, and doing
all the work contemplated and embraced in this Agreement, also for all loss and damage
arising out of the nature of the work aforesaid, or from the action of the elements,
or from any unforeseen difficulties which may arise or be encountered in the prosecu-
tion of the work until its acceptance by the City, and for all risks of every description
connected with the work; also, for all expenses incurred by or in consequence of the
suspension or discontinuance of work, except such as in said Specifications are expressly
stipulated to be borne by the City -; and for well and faithfully completing the work
and the whole thereof, in the manner shown and described in the said Plans and
Specifications, the City will pay and the Contractor shall receive in full compensation
therefore the lump sum price, or if the bid is on the unit price basis, the total price
for the several items furnished pursuant to the Specifications, named in the bidding
sheet of the Proposal, as the case may be.
3. The City hereby promises and agrees with the said Contractor to employ, and
does hereby employ the said Contractor to provide the materials and to do the work
according to the terms and conditions herein contained and referred to for the price
aforesaid, and hereby contracts to pay the same at the time, in the manner, and upon
the conditions set forth in the Specifications; and the said parties for themselves,
their heirs, executors, administrators, successors and assigns, do hereby agree to
the full performance of the covenants herein contained.
4. The Notice to Bidders, Instructions to Bidders, Contractor's Proposal, and the
Plans and Specifications, and all amendments thereof, when approved by the parties
hereto, or when required by the City in accordance with the provisions of the Plans and
Specifications, are hereby incorporated in and made part of this Agreement.

5. Pursuant to the Labor Code of the State of California, the City Council has
ascertained the general prevailing rates of per diem wages for each craft or type of
workman needed to execute the contract and a schedule containing such information is
included in the Notice Inviting Bids and is incorporated by reference herein.
6. The Contractor shall assume the defense of and indemnify and save harmless the
City, the Director of Public Works, and their officers and employees, from all claims,
loss, damage, injury, and liability of every kind, nature, and description, directly or
indirectly arising from the performance of the contract or work, regardless of responsi-
bility for negligence; and from any and all claims, loss, damage, injury, and liability,
howsoever the same may be caused, resulting directly or indirectly from the nature of
the work covered by the contract, regardless of responsibility for negligence.

SPECIAL PROVISIONS
FOR
OCEAN BOULEVARD AT HELIOTROPE AVENUE
STORM DRAIN IMPROVEMENTS
CONTRACT NO. 1325
I. SCOPE OF WORK
The work to be done under this contract consists of constructing the following
improvements: pipe storm drain and Gunite open channel, including related
structures and appurtenances, a wooden foot bridge, and miscellaneous Portland
Cement concrete work.
This contract requires completion of all work in accordance with these special
provisions, the city's standard specifications (Standard S ecifications for Public
Works Construction, 1970 Edition), the plans (Drawing Number D- 5065 -5 ), the
city's Standard Drawings and Standard Special Provisions, and applicable portions
of the State of California Standard Specifications, 1971 Edition.
The city's standard specifications are available at Building News, Inc., 3055 Overland
Avenue, Los Angeles, California 90034. The city's Standard Drawings and Standard
Special Provisions may be obtained at the Public Works Department for a fee of $2.00.
II. COMPLETION AND SCHEDULE OF WORK
The contractor shall complete all work on the contract within 60 consecutive calendar
days after the date the city awards the contract. The contractor shall submit
to the engineer a written schedule of work prior to commencing work on the project
as specified in Section 6 -1 of the standard specifications.
III. AWARD OF CONTRACT
The award of the contract will be based on the total price bid for all items of
work Numbers 1 through 10. The city reserves the right to delete all or portions
of Bid Items No. 5, 9 and 10.
IV. PAYMENT
Payment for all incidental items of work, not separately provided for in the
proposal shall be included in the price bid for the various items of work and
no additional compensation will be made.
V. CONSTRUCTION SURVEY STAKING
Field surveys for the control of construction shall be the responsibility of the
contractor. All such surveys including construction staking shall be under the
supervision of a California licensed surveyor or civil engineer.
Staking shall be performed on all items ordinarily staked at intervals normally
accepted by the city and trades involved. Payment for construction survey staking
shall be included in the price bid for the various items of work and no additional
compensation will be made.

The contractor shall provide traffic control in compliance with Section 7 -10 of
the standard specifications.
One lane of traffic in both directions shall be maintained at all times on
Ocean Boulevard,
VII. PROTECTION OF EXISTING TREES AND SHRUBS AND RESTORATION OF EXISTING IMPROVEMENTS
The contractor shall protect and preserve the existing natural vegetation, trees
and shrubs within the immediate construction areas. The contractor shall remove
only interfering branches of the trees and shrubs required to construct the down-
stream rip -rap channel walls. Any limbs or branches removed to facilitate
construction shall be cut off close to the boles in a workmanlike manner. Scars
resulting from the removal of branches shall be treated with a heavy coat of an
approved tree sealant.
Restoration of existing improvements shall conform to Section 7 -9 of the standard
specifications. In addition, the contractor shall be responsible for replacing
all landscaping and sprinkler systems damaged or removed during construction. The
plant species and materials used for replacement shall be the same or an approved
equal to those damaged or removed.
The cost of protecting and restoring landscaping and fences, including relocation
and reconstruction of underground sprinkler systems shall be included in the price
bid for the various items of work and no separate or additional compensation will
be made.
VIII. EXISTING UTILITIES
Utilities shall be investigated, protected and relocated in accordance with
Section 5 of the standard specifications.
IX. WATER
The contractor shall make his own provisions for obtaining and applying water
necessary to perform his work. If the contractor desires to use available city
water, it shall be his responsibility to make arrangements for water purchases
by contacting the city's Utility Superintendent, Mr. Tom Phillips, at (714) 673 -2110,
Extension 267,
X. STORAGE AREA
The contractor may utilize the northwest corner of the Corona del Mar State Beach
Parking Lot adjacent to the work site as a storage area. The contractor shall
maintain the area in a neat and orderly manner. Upon completion of the work, the
contractor shall clean and return the area to its original condition including
repairs to the pavement as required by the engineer.
XI. CONSTRUCTION DETAILS
1. Drainaae Facilities
The contractor shall provide for continuous flow of storm and nuisance water
during the progress of the work by constructing temporary berms, channels,
sand bag dikes, etc, to avoid damage to adjacent property.

A. Storm Drain Pipe and Appurtenances
Existing storm drain pipe to be abandoned in place shall be filled
with sand and the ends concrete or brick and mortar plugged in
accordance with Subsection 306 -3.1 of the standard specifications.
Storm drain bedding and backfill shall conform to the typical bedding
detail as shown on the plans. The sand bedding material under the
pipe shall have a minimum sand equivalent value of 40. A Portland
Cement and sand slurry mixture shall be used as a backfill material
around the storm drain pipe to one foot over the top of the pipe, as
shown on the plans. The contractor shall pour the slurry mixture in
such a consistency as to insure complete back Pill consolidation around
the pipe. Blocking shall be used as required to obtain the minimum
one foot cover over the pipe. Special care shall be taken to insure
that all voids are completely filled with the slurry mixture. Each
cubic yard of the cement sand slurry mixture shall be composed of one
94 -pound sack of Portland Cement and an aggregate consisting of rock
dust and plaster sand or sands of similar nature per cubic yard.
Backfill material in all pipe trenches above the sand slurry and around
associated structures shall be placed and compacted in accordance with
Section 306 of the standard specifications, except that water densified
backfill including jetting as specified in Subsection 306 -1.8.2 will not
be permitted.
All native materials excavated from the storm drain trench and associated
structures not utilized as backfill will become the property of the
contractor and shall be hauled and disposed of away from the job site as
it is excavated.
Storm drain pipe and fittings shall be Johns - Manville "Transite" pipe
(Class III) or equal.
The cost of the P.C.C. slope anchors shall be included in the unit price
bid for the various items of work and no additional compensation will be
made.
B. Rip -Rap Outlet Structure, Desilting Basin and Channel Wall Protection
Rip -rap used for channel wall protection and the desilting basin shall
be hard rock or broken Portland Cement concrete. Broken Portland Cement
concrete available at the job site may be used in the rip -rap structures.
The minimum weight of each individual rock or piece of broken P.C.C.
shall be 30 -40 pounds.
Rip -rap for the walls of the outlet structure, the channel wall protection
and desilting basin walls shall be placed with the largest surface area
of any individual rock or piece of broken P.C.C. lying on a horizontal plane.
All rip -rap shall be placed in an interlocking fashion and all voids
between rock or concrete shall be grouted with a Portland Cement concrete
grout in accordance with Section 202 -2.1.2 of the standard specifications.

The 3/4 -inch crushed rock bedding for the desilting basin shall conform
to Subsection 200 -1.2 of the standard specifications.
C. Gunite Channel and Appurtenances
No special bedding will be required for the Gunite channel if excavation
is contained within subgrade limits. Any over - excavation greater than
one foot below subgrade will require compaction of new subgrade material
to 90% relative compaction.
The application of Gunite for the open channel shall conform to Subsection
303 -2 of the standard specifications; except that Paragraph 1 of
Subsection 303 -2.7 (Measurement and Payment).shall not apply and the quantities
of Gunite placed will be computed from the actual linear feet of dunite
channel complete in place. All measurement being along a horizontal
plane along the CL of the channel.
The cost of constructing the Gunite cut -off wall and wing -walls shall be
included in the unit price bid for the various items of work and no
additional compensation will be made.
2. Wooden Foot Bridge
The 6" x 6" Redwood deck beams shall be close grained, surfaced, structural
grade.
3. Portland Cement Concrete Improvements
A. General
Portland Cement concrete furnished for all structures, sidewalks,
drainage aprons, foot bridge footings, and their appurtenances shall
be 6.0 -B -3000.
Concrete pigment used in the buff colored sidewalk shall be "LaJollan
Buff" (C -29) as manufactured by L. M. Scofield Company, Los Angeles,
California.
B. Portland Cement Concrete Sidewalk
Weakened plane and expansion joints shall be constructed in conformance
with the City of Newport Beach Drawing No. STD - 103 -L.
All sidewalk exposed surfaces shall be given a light broom finish.
C. Portland Cement Concrete Channel Outlet Apron
Weakened plane and expansion joints shall be constructed in conformance
with applicable portions of City of Newport Beach Drawing No. STD - 118 -L.
All drainage apron exposed surfaces shall be given a light broom finish.
4. Asphaltic Concrete Improvements
Asphalt concrete furnished for construction of the 4 -inch thick join strip
shall be Type III -D -85 -100 in conformance with Subsection 400 -4 of the
standard specifications.

A tack coat shall be applied in accordance with Subsection 302 -5.3 of the
standard specifications. The cost of the tack coat shall be included in
the unit price bid for the associated asphaltic concrete.
5. Timber Pile Guard Rail Relocation

RECOMMENDATIONS:
1. Approve the plans and specifications.
2. Authorize the City Clerk to advertise for bids to be opened
at 3:30 P.M. on September 7, 1971.
DISCUSSION:
This project provides for the reconstruction of the existing storm drain
system located on Ocean Boulevard westerly of Heliotrope Avenue to the westerly side
of Corona del Mar State -City Beach Park at the easterly jetty. The reconstruction
of the system will prevent erosion of the cliff and park area adjacent to Ocean
Boulevard.
The project is a carry -over from the original 1970 -71 budget, having been
deleted at the mid -year budget adjustment.
The estimated cost of the work is $11,000.00. Funds are available in Budget
Appropriation 02- 3497 -227.
The plans were prepared by the city. The estimated date of completion is
November 6, 1971.

Enclosed are four copies of the contract documents for the construction of the
project.
It will be necessary for you to execute and return a Material and Labor
Bond for 50% value of the contract amount; a Faithful Performance Bond for
100% of contract amount; and four copies of the contract. The date of the
contract is to be left blank, and it will be filled in when the City executes
the agreement.
The processed contract documents will be distributed as follows: (1) City
Clerk, (2) Public Works Department, (3) Contractor, and (4) bonding company.
In addition to the above documents, please submit certificates for public
liability and property damage insurance and workmen's compensation insurance.

It is requested that a drainage study be prepared and cost
estimates made for correcting the inadequate drainage facility
in the subject area. I suspect that this is going to be a
complex problem, and that alternative solutions will be
possible. Therefore, after you have completed a preliminary
review, we should probably meet to discuss the alternate
concepts before final estimates are prepared.
We would like to have the estimates ready in time for
consideration in the 1970 -71 capital improvements budget.
