IN RE: GRAND JURY REPORT PLANNING
On motion of Supervisor Baker, duly seconded and unanimously
carried, the report from the 1970 Grand Jury on Planning, dated
December 8, 1970, is received and ordered filed and copies of said report
are ordered referred to the Orange County* Planning Department and the
County Administrative Officer.
IN RE: PROPOSED GRANT OF EASEMENT BARRANCA CHANNEL
UNITED STATES OF AMERICA CONTINUED
On motion of Supervisor Battin, duly seconded and unanimously
carried, the proposed Grant of Easement from the United States of America
to the Om n>n County Flood Control District for Barranca Channel right of
way is continued to December 22, 1970, for Supervisor Battin to contact
Senator John G. Schmitz regarding possible dedication of the right of way
by the Federal Government.
IN RE: LETTER PROPOSED COMMUTER TRANSPORTATION SYSTEM
CITY OF ORANGE
On motion of Supervisor Hirstein, duly seconded and unanimously
carried, the letter dated December 9, 1970, from the City of Orange
regarding proposed Commuter Transportation System is ordered referred to
the Transit District.,
IN RE: AGREEMENT LOCAL GOVERNMENT RADIO MAINTENANCE AND REPAIR
CITY OF NEWPORT BEACH
On motion of Supervisor Allen, duly seconded and unanimously
carried, the Chairman and the Clerk are authorized to sign the Agreement
dated December 15, 1.970, between the County of Orange and the C'.ty of
Newport Beach providing for Local Government Radio Maintenance and Repair,
as recommended by 'the Director of Communi.cat:lons in his letter dated
December 7, 1970.

THIS AGREEMENT, made and entered into by and between the COUNTY OF
ORANGE, a body politic and corporate, hereinafter designated as "COUNTY ",
and the CITY OF NEWPORT BEACH, a municipal corporation located in the
County of Orange, hereinafter designated as "CITY ",
W I T N E S S E T H:
WHEREAS, COUNTY owns, maintains and operates a communications sys-
tem under and pursuant to Part 89 of the Rules and Regulations of the
Federal Communications Commission of Public Safety Communications; and
WHEREAS, CITY desires COUNTY to install and maintain radio equip-
ment used by said CITY in carrying out its official activities, and is
desirous of having same maintained under a licensed technician of COUNTY;
NOW, THEREFORE, for and in consideration of the mutual covenants
and promises of the parties hereto, hereinafter contained, it is mutually
agreed by and between the parties as follows:
1. This Agreement shall apply only to Mobile and Base Station
radio equipment not utilizing or permitted to utilize approved frequencie;
primarily assigned to fire, police or lifeguard services and now permitte(
to operate on the Orange County Coordinated Systems. Neither shall this
Agreement apply to any Mobile or Base Station radio equipment should the
frequencies presently in use as of the effective date of this Agreement,
as herein provided, be changed to a frequency which is not covered by the
existing agreement for fire, police and lifeguard services.
2. (a) COUNTY agrees to install and maintain communications equip-
ment used by and in said CITY and operating under Part 89 of Federal Com-
munications Commission Rules and Regulations, and which service is not
provided for or covered under the existing agreement covering fire, police
or lifeguard units. Before COUNTY provides said service, CITY shall ob-
tain a valid Federal Communications Commission license authorizing the
operation of all of CITY's radio equipment in the applicable service.

(b) Nothing in this Agreement shall authorize or be construed

as requiring COUNTY to install or maintain any equipment of any kind in

vehicles, buildings or premises not owned by or under lease to CITY and
4
under the full -time control of CITY.

(c) COUNTY agrees to furnish a licensed supervising technician,
6
and said radio equipment and mobile units shall be under the supervision
7
of said licensed technician, who shall hold a valid first - class. radio
8
telephone license issued by the Federal Communications Commission.

(d) It is agreed that all charges for labor in connection with
10
installation and maintenance shall be borne by CITY at the monthly rates
11
hereinafter set forth in this Agreement. All equipment, material, appa-
12
ratus and parts required for the initial installation shall be furnished
13
by and at the expense of CITY.

(e) Charges made by COUNTY to CITY shall be made on a flat -rate

month following its execution. It shall remain in effect for a five -year
period, but pursuant to Government Code Section 51302, it may continue fox
additional periods of five years each unless the legislative body of
either COUNTY or CITY votes not to continue the Agreement at a meeting
more than one year before the expiration of any five -year period. Not-
withstanding the preceding sentence, either party hereto may terminate
this Agreement at any time on thirty (30) days notice, in writing, to the
other party of its election to terminate the same.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed by their respective officers, duly authorized, upon the
dates set forth opposite their respective signatures.

Attached please find five copies of an agreement
between the County of Orange and the City of New-
port Beach for Local Government Radio System in-
stallation and maintenance.
This is a renewal of our present contract with a
provision for automatic renewal in future years.
In addition, subparagraph 2(a) has been modified
to reflect current FCC directives.
Would you kindly present this agreement to your City
Council for approval and execution and return all
copies to this office to be forwarded to the Board of
Supervisors for their approval and execution by the
Chairman.
Upon completion, we will return two fully executed
copies to your office for your files.
