6 COUNTY OF ORANGE, a political subdivision
of the State of California, hereinafter
7 referred to as the County.
8 WITNESSETH-
9 WHEREAS, the Board of Supervisors by Resolution of May 31, 1956
10 adopted .the Master Plan of Arterial Highways to serve the entire Count
11 including . the incorporated cities thereof, and
12 WHEREAS, Article 2 and 3 of Chapter 9, Division 2 of the Streets
13 and Highways Code authorize a county if it so desires to expend funds:
14 apportioned to it out of the California Highway Users Tax Fund for aid
15 to cities and in the improvement, construction, or repair of streets
16 within a city, and
17 WHEREAS, the Orange County Board of Supervisors and the Orange
18 County Division „of the League of California Cities have agreed upon a
19 cooperative financial program for the establishment, construction and >
20 maintenance of a County Arterial Highway System known as the Arterial
21 Highway Financing Program, and
22 WHEREAS, the Board of Supervisors has "., by appropriate action,
23 provided in the budget of the Special Road Improvement Fund for the
24 Fiscal Year 1971:72 funds for the improvement of streets within the
25 incorporated cities of the County, which streets are a part of the
26 County's Master Plan of Arterial Highways; and
27 WHEREAS, the Board of Supervisors on November 5, 1958 has by
28 formal resolution adopted the formal procedure for the administration
29 of the Arterial Highway Financing Program, which procedure is outlined
30 in a document on file with the County Clerk, formally known as the
31 County of Orange Arterial Highway Financing Program Procedure Manual,
32 and

WHEREAS, it is mutually agreed between the parties that
University Drive North from Jamboree Road to MacArthur Boulevard
a street included in the Orange County Master Plan of Arterial Highways,
is a street of general County interest and should be improved in accord-
ance with the policies of the Arterial Highway Financing Program. Said
work of such improvement shall be referred to hereinafter as the Project.
NOW, THEREFORE, IT IS AGREED by the parties hereto as follows:
1. The procedures outlined in the Arterial Highway Financing Program
Procedure Manual herein referred to shall be made a part of this
agreement.
2. The Contracting Authority for the Project is hereby designated
as the City
3. The Project Engineer for the Project is hereby designated as
the City
4. The Construction Engineer for the Project is hereby designated
as the City
5. All soils engineering and material and construction testing neces-
sary for the Project shall be performed by the County. This shall
include preliminary soils investigations, structure foundation
investigations, recommendations for structural sections and
compaction requirements, and quality control of materials and
construction.
6. The work shall be subject at all times to inspection by the
authorized representatives of both parties.
7. Funds to be used for the Project:
(a) The estimated cost of the Project covered by this agreement is:
DESIGN ENGINEERING: $ 15,000
RIGHT OF WAY ACQUISITION: 68,000
CONSTRUCTION CONTRACT: 102,000
CONSTRUCTION ENGINEERING: 15,000

MINUTES OF THE BOARD OF SUPERVISORS
OF ORANGE COUNTY, CALIFORNIA

IN RE: RIGHT OF WAY CONTRACT EL MODENA- IRVINE RETARDING BASIN
ORANGE UNIFIED SCHOOL DISTRICT
On motion of Supervisor Baker, duly seconded and unanimously
carried_, the Chairman and the Clerk are authorized to sign the Right of
Way Contract dated October 23, 1973, between the County of Orange and
Orange Unified School District, providing for acquisition of necessary
right of way for E1 Modena - Irvine Retarding Basin, Project No. FO7BO1,
Parcel No. 1001, 1003.
The County Auditor - Controller is instructed to issue his
warrant in the amount of $600.00 in favor of the Orange Unified School
District of orange County, California or assigns and additional.warrants
as required for reconveyance and forwarding fees in accordance with
instructions from the Department of Real Property Services. Delivery
of said warrants to be delayed pending notice from the Department of Real
Property Services that adequate title to the subject property has been
obtained. Said warrants are to be made payable out of FO7BO1, E1 Modena-
Irvine Retarding Basin, Orange County Flood Control District Fund, Work
Order 172/28/46, Account Code 4001 - 410- 78OKC.

CERRITOS AVENUE CITY OF CYPRESS
On motion of Supervisor Baker, duly seconded and unanimously
carried, the Chairman and the Clerk are authorized to sign the Arterial
Highway Financing Program Project Administration Agreement dated
October 23, 1973, between the County of Orange and the City of Cypress,
providing for the construction of Cerritos Avenue at the intersection of
Holder Street, Project No. 642.
