Newport Harbor Operating Plan
V of the
County of Orange
and
City of Newport Beach
The County of Orange to include the Orange County Sheriff's Department (OCSD) Harbor Patrol
and the City of Newport Beach to include the Newport Beach Police Department (NBPD),
Newport Beach Fire Department (NBFD), and Newport Beach Harbor Department, have always
worked in collaboration to provide the highest level of service to the community. The purpose of
this Operating Plan is to define the roles and responsibilities of these entities in providing law
enforcement, marine firefighting, marine safety, and boater assistance services in Newport
Harbor.
Following the cancellation of the Mooring Management agreement between OCSD and the City
of Newport Beach, and the creation of a City of Newport Beach Harbor Department on July 1,
2017, additional City staff and resources were committed to support community services in
Newport Harbor. Clarifying jurisdiction, protocols, and the roles and responsibilities of the
County and City will assist both entities with delivering premier public safety and community
services that will enhance overall service levels to the public in Newport Harbor.
Purpose
To clarify jurisdictions, protocols, and roles and responsibilities for the County of Orange and the
City of Newport Beach in the delivery of public safety and community services in Newport Harbor.
Definitions*
City Tidelands: Tidelands granted to the City of Newport Beach by the State of California (See
attached map).
County Tidelands: Tidelands granted to the County of Orange by the State of California (See
attached map).
Law Enforcement Incidents: Calls for service relating to crimes defined in the Penal Code and all
other non-marine/boating related laws.
Marine/Boating Laws: Harbors and Navigation Code (HNC), California Vehicle Code (CVC), Fish
and Game Code (FGC), Orange County Codified Ordinance (OCCO), and Newport Beach Municipal
Code (NBMC).
Marine Safety: Safety on the water is the mutual responsibility of both the County and the City.
The rule of response for these entities shall be the closest and most available personnel and
equipment and each entity shall reinforce each other's rescue, boater safety or prevention
actions, with the understanding that such rescue, boater safety and prevention actions include
all areas of Newport Harbor (City or County Tidelands) without respect for jurisdiction.
Newport Harbor: The body of water consisting of both County Tidelands and City Tidelands (See
attached map).
Tidelands: Submerged offshore land within the territorial waters of a state, county or city. For
the purposes of this Operating Plan, Tidelands stop at the seawall/bulkhead inside Newport
Harbor where the water meets the natural or manmade land or structures.

Agency Responsibility
Law Enforcement: OCSD Harbor Patrol
1. The OCSD Harbor Patrol agrees to be the first responder to all Law Enforcement Incidents on the
water in City and/or County Tidelands. After their initial response, the Newport Beach Police
Department will assume the investigation of Law Enforcement Incidents.
2. The OCSD Harbor Patrol shall enforce all Marine/Boating Laws and other applicable
statutes and regulations on the waters within Newport Harbor (City and/or County
Tidelands).
Law Enforcement: Newport Beach Police Department
The Newport Beach Police Department shall have responsibility and authority for Law
Enforcement Incidents and investigations in that portion of Newport Harbor that lies
within the City limits and City Tidelands, both land and sea.
Firefighting: OCSD Harbor Patrol
The OCSD Harbor Patrol shall be responsible for marine firefighting on the waters within
Newport Harbor (City and/or County Tidelands) where the Newport Beach Fire
Department cannot access via land.
Firefighting: Newport Beach Fire Department
The Newport Beach Fire Department shall respond to and attempt to suppress all fires
along the bulkheads on the shoreline (City and/or County Tidelands) in those areas where
they can utilize their apparatus and equipment. The Newport Beach Fire Department shall
have the responsibility for firefighting operations for all structure fires on land and on the
water (City and/or County Tidelands) where they have access (e.g., marinas, private
residences/docks, etc.).
Marine Safety: OCSD Harbor Patrol
The OCSD Harbor Patrol assumes primary responsibility for Marine Safety within the
waters of Newport Harbor (City and/or County Tidelands).
Marine Safety: Newport Beach Harbor Department
The City assumes primary responsibility for Marine Safety on ocean beaches, beaches in
Newport Harbor and other oceanfront uses within the City's jurisdictional limits.
