Newport Blvd. Area Code 714 673 -2110 DATE May 7. 1971 Description of Contract Population Estimate Authorized by Resolution No. 7402 , adopted on April 12, 1971 Effective date of Contract April 12, 1971 Contract with State of Calif nia, Dept. of Finance Address 1623 - 10th Street Amount of Contract Sactaronto, CA 95814 -city Cle c r Contract No. 1473 AGREEMENT XX THIS AGREEMENT made and entered into this day of April , 19 71, at Sacramento, California, by and between DEPARTMENT OF FINANCE of the State of California, hereinafter called the Department, and the City of ■arse *t leach hereinafter called the City: W I T N E S S E T H: WHEREAS, it is provided in Section 2107.2, Streets and Highways Code, that any city or city and county may apply to De- partment to estimate its population or the population of any in- habited territory annexed to the city subsequent to the last fed- eral census, and WHEREAS, said Section 2107.2 provides that Department may make the estimate if in the opinion of Department there is available adequate information upon which to base the estimate, and WHEREAS, City desires to have Department estimate pop- ulation of City and Department is willing to make such estimation, provided adequate information is available upon which to base the estimate, NOW, THEREFORE, it is hereby mutually agreed between parties hereto as follows: 1. City shall provide such data as are requested by Department in order that Department may determine whether adequate information is available upon which to base an estimate of popu- lation. In the event Department determines that adequate informa- tion upon which to base an estimate of population is not available Form SD -115 Rev. 012268 Estimate Y,' 0 0 Page Two it shall inform City and shall explain to City the basis for this determination and in such case Department may render no further services hereunder. Upon completion of such estimate of population and if requested to do so by City, Department shall file a certified copy thereof with the Controller pursuant to Section 2107.2, Streets and Highways Code. It is further mutually understood and agreed that Department shall have full and complete charge in the selection and application of the method or methods used in estimating the population of City and that City shall certify as to the accuracy of all information furnished from local records for use in preparation of said estimate of population. 2. Within thirty (30) days after notification by De- partment to City of completion of such estimate of population, City agrees to reimburse Department for all costs incurred by Department in connection with the performance of this agreement. Said costs shall be a standard fee determined by reference to a scale of charges based upon past cost experience of the Depart- ment and the size of the City as officially established. The standard scale of charges is attached as Appendix A, which is by reference hereby made part of this Agreement. 3. Department shall furnish a statement to City of amount due from City as hereinabove provided upon the completion of the services to be rendered under this Agreement by Department and City agrees to pay Department the amount due as shown in such statement within thirty (30) days after receiving such statement. City shall provide such data as are requested by Department in order that Department may determine whether adequate information is available upon which to base an estimate of population of City. In the event Department determines that there is not adequate information upon which to base an estimate of population it shall inform City and shall make available to City the basis for this determination and in such case Department shall render no further services hereunder. However, should Form BD -115 rev. 03168 Page Two Department determine that there is adequate information upon which to base an estimate of population, Department agrees to proceed to perform such further work as it deems necessary in order to make an estimate of population of City. Upon completion of such estimate of population De- partment shall officially certify the figure at the earliest practicable date. City agrees to accept as final the estimate as officially certified. Prior.to the official certification Department may transmit to City a statement, to be regarded as preliminary and subject to change, of the estimate of population and of the basic data used in its preparation. it is further mutually understood and agreed that Department shall have full and complete charge in the selection and application of the method or methods used in estimating the population of City and that City shall certify as to the accuracy of all information furnished from local records for use in pre- paration of said estimate of population. 2. Upon completion of said estimate of population, City agrees to reimburse Department for all costs incurred by Department in connection with the performance of this agreement. Said costs shall be determined by reference to a scale of charges based upon past cost experience of the Department and the size of the City as officially established by the popu- lation estimate. Said scale of charges is attached hereto as 'Schedule A,' which is by reference hereby made part of this agreement.
