Finance Department ❑ cc: /Ii.,...�. ., AGREEMENT FOR ENGINEERING SERVICES (Design of Master Plan Water Supply Transmission Main for Harbor View Hills, Sector IV) THIS AGREEMENT is made and entered into this ,JO TK day of apRiL , 1971, by and between the CITY OF NEWPORT BEACH, a municipal corporation hereinafter referred to as "City ", and the firm of RAUB, BEIN AND FROST, AND ASSOCIATES, Civil Engineers, hereinafter referred to as "Engineer "., WHEREAS, City proposes to provide domestic water service to a hillside area known as Harbor View Hills, Sector IV, which is partially located in three undeveloped water pressure zones (Master Plan Zones III, IV and V); and WHEREAS, engineering services are necessary to design and prepare plans and specifications for a Master Plan Water supply transmission main to deliver domestic water to this area; and WHEREAS, Engineer has submitted a proposal to design and prepare plans and specifications for the proposed transmission main; NOW, THEREFORE, the parties agree as follows: 1. General City engages Engineer to furnish the services hereinafter specified for the compensation herein stipulated, and Engineer agrees to perform such services upon said terms. 2. Duties of Engineer The Engineer shall: a. Perform a preliminary investigation of the overall project right of way, including contact with property owners and adjacent property owners. -1- 0 b. Perform all field survey work necessary for design of the 16 -inch water transmission main, including data to tie water main into the Zone IV pumping station. c. Design and prepare detailed plans and specifi- cations for construction of approximately 3,000 feet of 16 -inch water transmission main from the proposed Zone IV pumping station along the westerly property line of Pacific View ;Memorial Park and San Joaquin Hills Road to the inter- section of proposed Spyglass Hill Road. The plans shall be prepared on sheets supplied by City with a plan view scale of 1" = 40'. d. Prepare construction specifications, bid proposals and contract documents on multilith masters for the project suitable for use by City in calling for competitive bids. e. Prepare final quantity estimate and related cost estimate for project. f. Consult and maintain liaison with City during the engineering design project. 3. Duties of City City agrees to provide Engineer the following: a. Consultation as needed to accomplish the project. b. Standard sheets for preparation of plans. C. Any soils data required for design of the project. 4. Completion of Services Engineer agrees to complete all of the services specified herein within 45 days after execution of this agreement. -2- Ci 5. Payment by City City agrees to pay Engineer for all services called for under the provisions of this agreement on the basis of the hourly rate schedule set forth below, but not to exceed the sum of Thirty -seven Hundred Dollars ($3,700.00). Consultation and Registered Engineer $25.00 per hour Engineering Design Calculations and Supervision $19.00 per hour Drafting $17.00 per hour Field Survey Crew $46.00 per hour Typist $10.00 per hour The hourly rates shown above will be subject to an eight percent (8 %) increase each ensuing August 1st, beginning August 1, 1971, until completion of the project. The amount to be paid Engineer shall be payable as follows: a. Monthly partial payments, each payment to be the amount earned as determined by the fee schedule. The sum of the monthly partial payments shall not exceed ninety percent (90 %) of the above maximum fee. b. The balance of the total amount to be paid upon acceptance of the construction work by the City Council but in any event not later than twelve (12) months after the signing of the plans by the Public Works Director. In addition, City shall reimburse Engineer for the actual cost of reproduction of copies of said plans, -3- specifications and related documents and other related cost authorized by the Public Works Director and advanced by Engineer. 6. Termination This agreement may be terminated at any time by City upon three (3) days written notice to Engineer by placing said notice in the United States mail, postage prepaid, addressed to Engineer's business office. In the event of termination due to the fault of Engineer, City shall be relieved of any obligation to compensate Engineer. If this agree- ment is terminated for any reason other than the fault of Engineer, City agrees to compensate Engineer for the actual services performed up to the effective date of the notice of termination on the basis of the fee schedule contained in this agreement. 7. Amendment The scope of the services to be furnished by Engineer may be changed and the maximum fee revised upon prior written approval of the Public Works Director 8. Assignment This agreement or any portion thereof shall not be assigned without the written consent of City. 9. Hold Harmless Engineer shall assume the defense of and indemnify and save harmless the City, and its officers and !M, 0 employees, from all claims, loss, damage, injury and liability, directly arising from any errors, omissions, or negligence in Engineer's performance of this agreement or from the engineering work and services herein provided.
