FRAZEE SANTA ANA, CALIFORNIA 92701 June 2, 1971 Ai Mr. Dennis O'Neil Acting City Attorney City of Newport Beach 3300 Newport Boulevard Newport Beach, California 92660 Dear Mr. O'Neil; AREA CODE 714 535 -62+2 C_/3Z3 Pursuant to your recent inquiry, this office has reviewed the request of the City of Newport Beach and the attendant requirements of this office providing special legal services to the City of Newport Beach relating to the prosecution of misdemeanor violations of the Newport Beach Municipal Code. It is our understanding that the city, on an interim basis, desires to retain the services of one or more attorneys to act as Special Assistant City Attorneys for purposes of prosecution. It is our further under- standing that such services would entail court appearances on a weekly basis for the Monday night Traffic Court and every Friday morning for the non -jury trial calendar. In addition thereto, appearances, as required for the jury calendar, would likewise be required. Based upon these requirements, this office would be pleased to represent the City of Newport Beach on a special retainer basis for a fee of $800 per month, payable upon presentation of a monthly statement. This office is comprised of three men as you are aware, namely Stephen C. Stewart, formerly City Prosecutor and Assistant City Attorney for the City of Costa Mesa for a period of two years (1968- 1969); Richard O. Frazee, who has practiced in the criminal courts of the County of Orange for the past year and one half; and the undersigned, formerly Assistant City Attorney for the City of Newport Beach for two and one half years Mr. Dennis O'Neil June 2, 1971 Page Two. (1967- 1969). It would be the understanding of this firm that each of the three partners would be named as Special Assistant City Attorney for purposes of prosecution, so that any of the three could make the necessary court appearances on behalf of the City. We have undertaken a tentative program for assignment of responsibilities on fixed dates, but due to unavoidable conflicts, the need may arise for a substitute of personnel. In the event the City of Newport Beach desires this office to undertake any additional legal matters during the interim period of recruitment for the position of City Attorney and Assistant City Attorney, we feel well qualified and are willing to do so on a negotiated fee basis.
