(2) That obligations of STATE under terms of this.Agreemant are subject to the allocation of funds by the California highway Commission. (3) That neither STATE. nor any officer or employee thereof shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by CITY under or in connection with any work, authority or jurisdiction delegated to CITY under this Agreement. Please see that a signed copy is returned to us for filing. Laura Lagios City Clerk LL:swk enc. cc: Finance Director RECOMMENDATION: Adopt a resolution authorizing the Mayor and City Clerk to execute the subject agreement with the State of California, Division of Highways DISCUSSION: The current 1970 -71 budget provides $3,300 in the Gas Tax Fund for the extension and landscaping of the concrete median island in Coast Highway from Hazel Avenue to Seaward Road. The improvement is primarily a safety feature to discourage left turns across Coast Highway. The subject agreement provides for the State to pay for one -half of the island construction costs, estimated to be $1700. The plans have been prepared by the city and an informal construction contract will be let upon receipt of the fully - executed agreement from the State.
