share of the cost of mintenance in the manner provided in
that. - agreement for maintenance which is in effect at the

(1) To pay to CITY, promptly upon rendition of a
statement therefore, STATt's> share of the design engineering
costs, construction engineering costs and construction costa
required to complete the IMPROV1;Mi;NT referred to herein.

It is estimated that STATE's share of the IMPROVEMMIT is
$1,700900. The actual amount of STATE's share will be
determined after the IMPROVEMENT is cWleted,- but in no
event shall STAM 's share esceed.$1,700.00 unless otherwise
provided in a subsequent.agrtement between CITY and :STATE.
(2) To maintain the ImPROVT;ExENT. as constructed.
(3) The State will not participate in the construction
or maintenance of the landscaping and sprinkler system being
installed by the City at this lotion.

It is mutually understood and agreed:
(1) That design engineering costs, including all
overhead charges attributed to design engineering, are-to
be 13.4 per cent of construction costs of the IMPROWMINT.
(2) That obligations of STATE under terms of
this.Agreemant are subject to the allocation of funds by
the California highway Commission.
(3) That neither STATE. nor any officer or employee
thereof shall be responsible for any damage or liability
occurring by reason of anything done or omitted to be done
by CITY under or in connection with any work, authority or
jurisdiction delegated to CITY under this Agreement. It is
also understood and agreed "that, pursuant to Government Code
Section 895.4, CITY shall fully indemnify and !gold STATE

harmless from any liability ir,,po for injury (as defined
by Government Code Section 810.6] occurring by reason of
anythinx done or omitted to be done by CITY under or in
connection with any work, authority or jurisdiction delegated
to CITY under this Agreerent.
(.4) That neither CITY nor any officer or employee
thereof, is responsible For any iJamage or liability occurring_
by reason of anything done or omitted to be done by STATE
under or in connection with any work, authority or juris-
diction not delegated to CITY under this Agreement. It.is
also :understood and agreed that, pursuant to Government Code
Section 895.4, STlliL shall fully indemnify and hold CI'T'Y
harmless from any liability. imposed for injury (as. defined
by Government Code Section 610.8) occurring by reason of
anything done or omitted to be done ixy S A'k'." under or in
connection with any work, authority or jurisdiction not
delegated to CITY under this agreement.
(5) What, should any portion of the project be
financed with Federal Funds or State Gas Tax Funds all
applicable procedures and policies relatincr to`the -use of
such funds shall apply notwithstanding other provisions of
this agreement.

agreement for sendinlw, on to the appropriate State
Department for execution.

RECOMMENDATION:
Adopt a resolution authorizing the Mayor and City Clerk to
execute the subject agreement with the State of California,
Division of Highways
DISCUSSION:
The current 1970 -71 budget provides $3,300 in the Gas Tax Fund for the
extension and landscaping of the concrete median island in Coast Highway from Hazel
Avenue to Seaward Road. The improvement is primarily a safety feature to discourage
left turns across Coast Highway.
The subject agreement provides for the State to pay for one -half of the
island construction costs, estimated to be $1700.
The plans have been prepared by the city and an informal construction
contract will be let upon receipt of the fully - executed agreement from the State.
A budget amendment revising the present appropriation in the amount of
$1700.00 to reflect the state contribution has been prepared for Council consideration.

City Os Newport Beach and the State of California for the
extension of the median island in East Coast Highway between
Haaftl Avenue and Seaward Roady and
WMEAS, the City Council has considered the terms
and conditions of said contract and found them to be fair and
eauitabley
NOW, TMREFOFLv BE IT WTSOLVRD that said contract for
the aervices above described is approved, and the Mayor and City
Clerk are hereby authorised and directed to execute the same
on behalf of the City of Neioport Beach.
