RIGHT OF WAY CERTIFICATION

The City of Newport Beach hereby certifies in connection with
the right -of -way for the Balboa Boulevard Widening, AHFP Project Number
637 that:
1. All right -of -way has been acquired, or condemnation
suit has been filed on all parcels not acquired by
negotiation.
2. Improvements as shown on the contract drawings and
described in the contract specifications exist within
the existing right -of -way and will either be relocated
or will not interfere with construction.
In making this certification, the City of Newport Beach agrees
to hold the County of Orange harmless from any liability which may arise
by reason of the County's reliance upon this Certificate and its use of
said right -of -way.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
AN ARTERIAL HIGHWAY FINANCING PROGRAM AGREEMENT
BETWEEN THE CITY OF NEWPORT BEACH AND THE COUNTY
OF ORANGE IN CONNECTION WITH THE IMPROVEMENT
OF BALBOA BOULEVARD
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain Arterial Highway
Financing Program agreement between the City of Newport Beach
and the County of Orange in connection with the improvement
of Balboa Boulevard; and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair
and equitable;
NOW, THEREFORE, BE IT RESOLVED that said Arterial
Highway Financing Program agreement for the highway improve-
ments above described is approved, and the Mayor and City
Clerk are hereby authorized and directed to execute the same
on behalf of the City of Newport Beach.
