THIS AGREEMENT is made and entered into this Z&,c. v day of
1973, by and between the CITY OF COSTA MESA, a municipal
corporation, herein referred to as "COSTA MESA ", and the CITY OF NEWPORT BEACH,
a municipal corporation, herein referred to as "NEWPORT BEACH ".
WITNESSETH:
WHEREAS, COSTA MESA has an Arterial Highway Financing Program (AHFP)
project for the widening of Placentia Avenue between 19th Street and the
southerly COSTA MESA boundary which is 165± feet north of Production Place;
WHEREAS, NEWPORT BEACH has an AHFP project for the widening of the
easterly side of Placentia Avenue between the southerly COSTA MESA boundary
and the southerly NEWPORT BEACH boundary which is 165± feet south of Production
Place, said project also includes construction of improvements in NEWPORT BEACH
on the westerly side of Placentia Avenue between 16th Street and 165± feet north
of Production Place,
WHEREAS, it is in the best interests of both COSTA MESA AND NEWPORT
BEACH to combine the two AHFP projects into one street construction project
administered by COSTA MESA;
WHEREAS, COSTA MESA and NEWPORT BEACH desire to set out their respec-
tive rights and obligations concerning the improvement of Placentia Avenue.
NOW, THEREFORE, IN CONSIDERATION OF THE FOREGOING, IT IS AGREED
AS FOLLOWS:
1. NEWPORT BEACH shall design and prepare plans and cost
estimates suitable for obtaining bids for the widening of

the easterly side of Placentia Avenue between the southerly
COSTA MESA boundary and 165± feet southerly of Production
Place.
2. COSTA MESA shall design and prepare plans and cost estimates
suitable for obtaining bids for the widening of that portion
of Placentia Avenue northerly of 165± feet north of Production
Place.
3. COSTA MESA shall contract for and shall supervise the con-
struction of said improvements in both cities.
4. NEWPORT BEACH shall reimburse COSTA MESA within thirty (30)
days after receipt of an itemized statement setting forth
NEWPORT BEACH'S share of the project: construction costs.
Said share shall be the cost of all work done in NEWPORT
BEACH and :shown on the approved plans. The estimated cost
of this work is $8,400. The actual amount of NEWPORT
BEACH'S share shall be determined after completion of the
work covered by the construction contract and shall be based
on the price paid to contractor.
5. During construction COSTA MESA shall assign a qualified
inspector, who shall be charged with overall contract adminis-
tration and who shall assure that construction proceed in
accordance with the plans and specifications. NEWPORT BEACH
shall assign a qualified inspector to observe work within
NEWPORT BEACH. COSTA MESA'S inspector shall be in charge of
the construction contract, and any changes requested by the
NEWPORT BEACH inspector shall be made to the COSTA MESA in-
spector.

6. Each city :shall be responsible for conforming to the County
of Orange AHFP requirements (i.e. design report, Environmental
Impact Statement, Right of Way Certification, etc.) on its own
project and obtain an authorization to advertise from the
County.

OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
A COOPERATIVE FINANCING AGREEMENT BETWEEN THE
CITY OF NEWPORT BEACH AND THE CITY OF COSTA
MESA FOR THE WIDENING OF PLACE -NTIA AVENUE FROM
165 FEET SOUTH OF PRODUCTION PLACE TO 16TH
STREET.'
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a cooperative financing agreement
between the City of Newport Beach and the City of Costa Mesa for
the widening of Placentia Avenue from 165 feet south of Produc-
tion Place to 16th Street; and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair and
equitable;
NOW, THEREFORE, BE IT RESOLVED that said cooperative
financing agreement for the services above described is approved,
and the Mayor and City Clerk are hereby authorized and directed
to execute the same on behalf of the City of Newport Beach.

municipal corporation, herein referred to as "COSTA HEW, and the CITY
OF NEWPORT BEACH, a municipal corporation, herein referred to as "NEWPORT
BEAC11' .
WITNESSTH THAT:
WHEREAS, COSTA "MESA is engaged in purchasing right of way for
the purpose of between Nineteenth Street and
the Southern COSTA HESA boundary;
WHEREAS, portions of said widening project will encroach into
NEWPORT BEACH due to the unusual location of the boundary between COSTA
*MESA and NEWPORT BEACH;
WHEREAS, in order to complete the widening of Placentia Avenue
to the ultimate eighty foot (80 ft.) right of way, COSTA MESA and NLIMORT
BEACH desire to set out their respective rights and obligations concerning
the improvement oZ said street.
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. COSTA MESA shall acquire for street widening purposes
Parcels 2 and 3 shown on Exhibit `A" attached hereto and
by this reference made a part of this agreement. Said
parcels lie within the city limits of NEWPORT BEACH.
2. NEWPORT BEACH shall, upon receipt of proper demand,
reimburse COSTA MESA in an amount equal to fifty
percent (50X) of the total purchase price of the
aforementioned Parcels 2 and 3. The '. iEWPORT BEACH
share of the purchase price is estimated to be $4,500;

this amount is to be the maximum payable by NEWPORT
BEACH unless it becomes necessary to condemn the property.
In this event, NEWPORT BEACH agrees to pay fifty percent
(SOS) of the total purchase price as determined by the
Court.

SUBJECT: COOPERATIVE FINANCING AGREEMENT FOR RIGHT OF WAY ACQUISITION TO
WIDEN PLACENTIA AVENUE BETWEEN 16TH STREET AND PRODUCTION PLACE
RECOMMENDATION:
Adopt a resolution authorizing the Mayor and the City Clerk to
execute the subject agreement with the City of Costa Mesa.
DISCUSSION:
The City of Costa Mesa is presently engaged in acquiring right of way to widen
Placentia Avenue from 19th Street to the Costa Mesa city boundary between 16th Street
and Production Place. The street right of way will be widened from 60 feet to 80 feet
with 10 feet being taken from each side of the street. Southerly of 16th Street the
10 -foot strip of right of way required on the westerly side of the street is in the
City of Newport Beach. See the attached sketch.
The subject agreement provides for the City of Newport Beach to pay for 50%
of the acquisition costs of the two parcels shown on the attached sketch. The other 50%
of the cost will be financed with County Arterial Highway Financing Program funds, under
a Costa Mesa AHFP project. The estimated cost to Newport Beach is $4500.00. If it
is necessary to condemn the property, the city would pay 50% of the total purchase price
as determined by the court..
Sufficient funds are currently available in the Gas Tax Fund account for
acquiring right of way for street widening purposes.
The City of Costa Mesa will obtain the necessary appraisals and perform the right
of way negotiations.
