City of Newport Beach and the County of Orange providing
for street sweeping at the Orange County Airport. This
cont ^act was authorized by the City Council at its meeting
of July 26 by the adoption of Resolution No. 7501, copy of
which is enclosed.

JOINT EXERCISE OF POWERS AGREEMENT
PROVIDING FOR STREET SWEEPING AT THE
ORANGE COUNTY AIRPORT
THIS AGREEMENT, made and entered into this ! day of
=z9 1971, by and between the CITY OF NEWPORT BEACH,
a municipal corporation, hereinafter referred to as "City ", and the
COUNTY OF ORANGE, a body corporate and politic, hereafter referred to
as "County ".
W I T N E S S E T H:
WHEREAS, the County requires certain street sweeping services
at the Orange County Airport; and
WHEREAS, the City presently has the required personnel and
equipment and does sweep streets in the vicinity of the Orange County
Airport; and
WHEREAS, the County desires to contract with the City for such
street sweeping services; and
WHEREAS, the provisions of Title 1, Division 7, Chapter 5,
Article 1 of the California Government Code, entitled "Joint Exercise
of Powers Agreements," authorize two or more public agencies to jointly
I exercise any power common to the contracting parties;
NOW, THEREFORE, the parties agree as follows:
1. The City agrees to furnish street sweeping services to
the County by sweeping once a week approximately four curb miles of
roadway along Airport Way North, Loop Road, and Airport Way South.
2. The scheduling of the service to be provided shall be
agreed upon by the City General Services Director and the County
Director of Aviation, who are hereby designated the administrators of
this Agreement by the City and County, respectively.
3. The County agrees to pay the City for the services provided
at the rate of two dollars and fifty -eight cents ($2.58) per curb mile

4. The County Auditor- Controller shall pay the City for
services performed within thirty (30) days following receipt of a
written invoice by the County.
5. This Agreement shall remain in effect for one year
through .=-� 4 / 1972, It may be terminated earlier by

either party following thirty (30) days' written notice.
6. The County by entering into this Agreement assumes no
liability for the payment of salary, wages, retirement benefits, workmen's
compensation or any other employee benefits to any officer, employee
or agent of the City engaged in providing services to County pursuant
to this Agreement.
7. County agrees to defend, hold harmless and indemnify City
against any claim, lawsuit or judgment for damages arising out of City's
performance of the services provided for in this agreement regardless of
responsibility for negligence. County further agrees to provide compreh
sive liability insurance coverage for City's benefit while performing
services under this agreement with minimum coverage in the amount of
$500,000 for death of or injury to more than one person, $300,000 for de
of or injury to one person and property damage in the amount of $100,000
for each accident,
IN WITNESS WHEREOF, the parties hereto have caused this
Agreement to be executed by their respective officers duly authorized
upon the dates'set forth opposite their respective signatures.

MINUTES OF THE BOARD OF SUPERVISORS

IN RE: TRACT MAP NO. 7380
On motion of Supervisor Clark, duly seconded and unanimously
carried, Tract Map No. 7380 is received and Bond No. MNR- 648090 in the
sum of $2,500.00 with Aztec Enterprises, a Limited Partnership, as
Principal, and the Insurance Company of North America, as Surety, to
guarantee payment of the 1971 -1972 taxes on Tract No. 7380 is approved.
IN RE: TRACT MAP NO. 7236
On motion of Supervisor Baker, duly seconded and unanimously
carried, Tract Map No. 7236 is approved and the following streets are
accepted: Yale Avenue, Cloverdale Lane, Ranchgrove Drive, Waverly Lane,
Abbotswood Circle and Edgemere Drive. The grant in fee simple of Lots
"A" and "B ", subject to improvements'for green belt purposes, is accepted
and all vehicular access rights, as dedicated, are also accepted.
Bond No. END 183 22 54 in the amount of $124,500.00 to guarantee
street improvements in the sum of $72,400.00, sewer system installation
in the sum of $13,700.00, water system installation in the sum of
$36,000.00 and street lighting system installation in the sum of
$2,400.00, Bond No. BND 183 22 54 in the sum of $1,000.00 to guarantee
monumentation and Bond No. BND 183 22 54 in the sum of $8,400.00 to
guarantee payment of 1971 -1972 taxes on Tract No. 7236 with Levitt & Sons
of California, Inc., as Principal and the Firemen's Insurance Company of
Newark, New Jersey, as Surety, are approved.
The Chairman and the Clerk are authorized to sign the agreements
to guarantee street improvements, sewer system installation, water
system installation, street lighting system installation and monumentatior
installation.

On motion of Supervisor Caspers, duly seconded and unanimously
carried, the Chairman and the Clerk are authorized to sign the Joint
Exercise of Powers Agreement, dated July 13, 1971, between the County
of Orange and the City of Newport Beach, providing for street sweeping
at the Orange County Airport.

Earlier this year we asked whether the City of Newport Beach would
be willing to extend its weekly street sweeping program to include
approximately four curb miles of Airport roadway. At that time we
were informed that this service was possible and could be rendered
at $2.58 per curb mile per sweeping.
In determining what formalities were necessary to obtain this service
from your City, we were advised by our County Counsel that such an
arrangement between the County and a municipality must take the form
of an Exercise of Joint Powers Agreement. Thereafter, an Agreement
suitable to the County Counsel and Mr. O'Neil, Acting City Attorney,
was prepared in final form and submitted to the Board of Supervisors
for its approval. A copy of Minute Order, July 13, 1971 authorizing
the Chairman to sign is attached. Supervisor Battin has since signed
the Agreement.
May I ask that this item be placed on your Council's Consent Agenda
with approval requested. If the Council acts favorably, please have
the Mayor sign all three copies and return the original and one copy
to my office.

SUBJECT: STREET SWEEPING SERVICES ON ORANGE COUNTY AIRPORT PROPERTY
RECOMMENDATION:
Adopt Resolution No. authorizing execution of an agreement
between the City of Newport Beach and the County of Orange for
street sweeping services on Orange County Airport property.
DISCUSSION:
Approximately two miles of the access roadways at Orange County
Airport have been swept weekly by airport maintenance personnel using small
ineffective equipment. The City of Newport Beach has been approached about
providing street sweeping services on airport property. Due to the adjacency
of the City's street system to the airport, such services can be conveniently
and efficiently provided at a rate of $2.58 per curb mile.
The proposed Exercise of Joint Powers Agreement was approved by
the Orange County Board of Supervisors on July 13, 1971.
