AGREEMENT FOR APPRAISAL SERVICES
THIS AGREEMENT is made and entered into this J (�
day of %�� 1971, by and between the City of Newport
Beach, hereinafter referred to as "City," and GEORGE HAMILTON
JONES, MAI, hereinafter referred to as "Appraiser;"
W I T N E S S E T H:
WHEREAS, City is planning a public works project for
the widening of Balboa Boulevard from Coast Highway to 44th
Street, which would involve the acquisition of approximately
twenty -five to thirty feet of right -of -way on the northeasterly
side of Balboa Boulevard; and
WHEREAS, in connection with said project, it will be
necessary that City acquire various interests in private property
within the project area, either through negotiation or by exer-
cising the power of eminent domain; and
WHEREAS, in order to determine the fair market value
of the property to be acquired by City it will be necessary that
City retain the services of a qualified real estate appraiser; and
WHEREAS, Appraiser has submitted a proposal to perform
the necessary appraisal services for City;

NOW, THEREFORE, the parties agree as follows:
1. SERVICES OF APPRAISER
Appraiser agrees to provide the following services
(a) Prepare a comprehensive appraisal report on
the parcel known as 4405 Channel Place.
(b) Prepare comprehensive appraisals of four
partial take parcels between Channel Place and River Avenue.

Said parcels are shown on the attached Exhibit "A" which by this
reference is hereby made a part of this agreement.
(c) Determine the fair market value of the five
ten -foot radius corner cutoff parcels shown on Exhibit "A."
(d) Consult with the City administrative staff
and City Attorney upon request.
2. COMPLETION OF SERVICES
The work described in items 1(a), l(b) and 1(c)
above shall be completed and the required reports delivered to
City on or before December 1, 1971.
3. COMPENSATION
Appraiser shall be compensated on the basis of
the following hourly rates following his submission to the City
of an itemized statement or statements:
Appraiser's time
Associate's time
$35.00 per hour
$20.00 per hour.
It is further provided that the maximum fee to be charged for
items l(a),l(b) and 1(c) shall not exceed $5,250.00. It is under-
stood that the preparation of the comprehensive appraisal in
item l(b) above will require the services of a contractor or
cost estimator to determine the economics of building rehabilita-
tion after the taking. The fee for such services shall be in
addition to the aforementioned maximum fee. The additional fee
and qualifications of the individual shall be approved by the
City Public Works Director and Appraiser prior to his retention.
4. TERMINATION
At any time prior to the completion of the work,
upon request of City, Appraiser shall cease work, in which event
his compensation shall be based on the time expended up to the
date when he was requested to cease work.

5. COURT APPEARANCES
When requested to do so, Appraiser agrees to appear
in court as an expert witness in any condemnation case involving
the above described property and to assist City's legal counsel
in preparing any such condemnation case for trial. Appraiser
shall be paid the additional sum of $ 300.00 per diem for court
appearances as an expert witness.
6. INDEPENDENT CONTRACTOR
Appraiser, his agent and employees, in the perfor-
mance of this agreement, shall at all times be an independent
contractor and shall under no circumstances be considered as
officers or employees of City.
IN WITNESS WHEREOF, the parties hereto have executed
this Agreement on the date first above written.
