Dear Mrs. Lagios:
Enclosed is a copy of the Agreement between
the City of Newport Beach and the City of Costa Mesa, approved
at the City Council meeting of August 16, 1971, for the construc-
tion of a traffic actuated signal and safety lighting system at
the intersection of Placentia Avenue and West 16th Street.

THIS AGREEMENT made and entered into this 16,ck day. of ,
1971, by and between the City of Costa Mesa, a municipal corporation, here
called "COSTA MESA" and the City of.Newport Beach, a municipal corporation, here-
inafter called "NEWPORT BEACH ".
WITNESSETH THAT:
WHEREAS, the safety of motoring and pedestrian traffic at the inter-
section of Placentia Avenue and W. 16th Street requires the installation of
traffic- actuated control signals and safety lighting at said intersection,
WHEREAS, portions of said property are within the City boundaries of
the City of Newport Beach and the City of Costa Mesa,
WHEREAS, it is the desire of the parties hereto to set out their
respective rights and obligations concerning the improvement of said intersection.
NOW, THEREFORE, for and in consideration of the covenants herein con-
tained, performed and to be performed, the parties hereto agree as follows:
(1) The parties hereto agree.to share the construction contract cost
of a traffic - actuated signal and safety lighting system at the intersection of
Placentia Avenue and W. 16th Street in the same ratio as the number of legs under
each party's jurisdiction entering the intersection are to the total number of
legs entering the intersection.
(2) The total cost of construction shall initially be borne by
COSTA MESA.
(3) The construction of the project shall be subject to the determina-
tion by the State of California Division of Highways and Federal Highway Authority
that the project is eligible for funding through the Traffic Operations Program
to Improve Capacity and Safety (TOPICS).
(4) NEWPORT BEACH agrees to authorize the State to transfer TOPICS
funds from the NEWPORT BEACH allocation to the COSTA MESA allocation. Said funds
will be in the amount of twenty -five percent (25X) of total eligible TOPICS costs
for the construction of the project. The NEWPORT BEACH share of the total eligible
TOPICS costs is estimated to be $7,250.00.
(5) NEWPORT BEACH shall, upon receipt of proper demand, reimburse
COSTA MESA in an amount equal to twenty -five percent (25X) of the matching funds
required for the construction of the project. The NEWPORT BEACH share of the
matching funds is estimated to be $2,900.00.
(6) The total cost for constructing the project shall include the
actual cost of the construction contract, construction engineering, inspection
and administration as Bet out in the final accounting for the TOPICS program.
(7) After completion of the Project, the traffic signals and lighting
shall be maintained or modified by COSTA MESA.
(8) Any modification to the trafflo::sil system shall first be
approved by NEWPORT BEACH.
(9) Upon annual submission by COSTA MESA of maintenance, modification
and energy costs, NEWPORT BXArH shall pay to COSTA MESA its propas share
of said costs which shall be in the same ratio to the total costs as the number of
legs under NEWPORT BEACH's juris""Paa catering the intersection ars to the
total number of legs entering the intersection, said ratio presently being twenty-
five percent (25%).
IN WITNESS WHEREOF we have placed our hands and seals on the day and

COOPERATIVE FINANCING AGREEMENT BETWEEN THE CITY OF COSTA MESA AND
THE CITY OF NEWPORT BEACH MR INSTALLATION OF TRAFFIC SIGNAL AT
PLACENTIA AVENUE AND 16TH STREET
Attached are three copies of the above agreement for execution
by the City of Costa Mesa. One copy is to be retained by the
City of Costa Mesa, the original returned for our files and
the third copy is for your files.
This agreement was authorized by the City Council on July 26
by the adoption of Resolution No. 7494.
