Enclosed find a fully executed copy of the lifeguard agreement with your
city for the 1971 -72 fiscal year. The agreement provides for your city to
furnish contract lifeguard services on certain County beaches. The payment
for the contract services is funded-by the Harbor District.
Your attention is called to Paragraph 4 of the agreement whereby your city
shall provide the Harbor District with a schedule of lifeguard services
proposed for the County beach area in question within 10 days after execu-
tion of the agreement. Due to the elapsed time to date, it would appear
that a due date of October 4, 1971, would. be more reasonable.
IUpon receipt of your city's schedule, activity reports (if not previously
submitted) and appropriate billings, payments for contract services can be
processed immediately.
It is anticipated the Board of Supervisors will favorably act upon the
Financial Assistance Agreements in the near future. A fully executed copy
of that agreement will be forwarded to your office at the earliest possible
date. Your patience with the processing of these agreements is appreciated.
Should questions arise concerning the contracts, please contact Mr. Larry
Leaman, at 834 -4794.

may exist, it being expressly understood that CIT_' shall resocnd, with
qualified personnel, to emergency calls therein at any time during such
fiscal year.
3. C TY agrees to employ cniy properly trained and qualified
lifeguards and supervisory personnel in the discharge of its obligations
under this Agreement, and to maintain and provide an appropriate training
program, satisfactory 'completion of which shall be mandatory for all
lifeguards employed by CITY. CITY further agrees to provide adequate
supervisory personnel at all times, it being the intent of the parties
that lifeguard service of high duality and standards shall be -available
at all times.
k. The standard of service provided shall be subject to the
approval of DISTRICT, and within ten (10) days after the e.:ecution of this
Agreement, CITY shall provide the Director of Harbors, Beaches and Parks
with,a schedule of lifeguard service prcpo d by i.

Agreement provided, and subject to the further ribht of DISTRICT to
request the placing of a lifeguard station or personnel at any point
in the unincorporated area of Orange County deemed necessary by the
DISTRICT.
8. It is further agreed, he.. ?ever, that CITY will res..cn d with

9. It shall be the duty of the Chief Lifeguard of C---T47 to
immediately notify the DISTRICT in the event od sea rescue or aircraft
emergencies whereby other City, District or S'%at3 reSCUe USiitS may be
alerted and coordinated for standby o assistance.
10. The control and su1,e - v4sion of all 3.ifegu rds and other
rescue personnel of the CITY shall be so called to duty at any such
emergency, shall be in the lifeguard or ot'-ier public officer or employee
in charge of the area where such emerc,�ncy occ,rts.
11. All personnel of the CITY cmiie On aeroency duty hereunder,
and while going to and returning from the scene of sue_: c erg ncy, shall
be deemed to remain the employee of the C17Y; and any Stt—e- p'crsonnel
furnished for an emergency on any beach at which the CITY fur ashes
lifeguard service hereunder shall likewise be deemed to remain a State
employee. �
12. If, within the CITY's qualified persoc_-:1, there ar li_eguardsl
trained to use, and equipped with, Self- Contained ;inderv;ater '33_:: thing
Apparatus (SCULA), such personnel shall be made available to serve to
the extent reasonably permitted by their cs.p;:bilities, trainin,;,
experience and equipment as determined by the Chief Lifeguard of CITY
in an Orange County undeneatez rescue team coordinated and called into

0- V,NGE, a body politic. nd corporate, hereinafter referred to as the

corporation, located within the County of Orange, hereinafter referred
to as the "CITY."
WITNESSETH:
WHEP.EAS, the CITY is situated on the coastli-a of the County of
Orange, where many and various persons, not . ^.ecessariiy residents of the
CITE', but including as well residents of the COUNTY, all other counties
in the State of California, and of other

four - fifths vote of all its members, Resolution. No. 71 -1039, , dated
September 21 , 19 71 , making the findings required by Section
25553 of the Government Code;
NOW, THEREFORE, it is agreed between the CITY and the COUNTY as
follows:
1. CITY agrees to provide lifeguard services during July,
August, September, and June of the 1971 -72 fiscal year, and
all such time during the remainder of such fiscal year as-the reed

2. CITY agrees to em -)loy only,-- operly trained and qualified
lifeguards and supervisory personnel in the disci:arge of its obligations
under this Agreement, and to maintain and provide an appropriate

3.. COUNTY hereby designates the Director of Harbors, Beaches, and
Parks as its liaison officer for the purposes of the administration of
tas Agreement. CITY shall file monthly with such liaison officer a
complete written report of its activities and services rendered pursuant
to and under this Agreement.
4. COUNTY, in consideration of the performance by CITY as in
this Agreement provided, does hereby appropriate and agree to pay to
CITY the sum of =Sixty-Five Thousand Four ilunred For_v

5. It is furthc.2 agreed, however, that CITY will respond with
cualified personnel anywhere within the COUNTY to the extent Here are

within the CITY when, in the opinion of the Director of Harbors, Beaches
and Parks, an emergency exists which warrants additional assistance

7. The control and supervision of all lifeguards and other
rescue personnel of the CITY who shall be so called to duty at any
such emergency, shall be in the lifeguard or o cher public officer or
employee in charge of the area where such emergency occurs.
8. All personnel of the CITY while on emergency duty hereunder,
and while going to and returning from the scene of such cs:ergency,
shall be. deemed to remain the employee of the CITY, and any State
personnel furnished for an emergency on any beach at which the CITY
furnishes lifeguard service hereunder shall likewise be deemed to
remain a State employee.
9. If, within the CITY'S qualified personnel, there are life-
guards trained to use and equipped with, Self-Contained Underwater
Breathing Appartus (SCUBA), such personnel shall be made available to
-z-ve to the extent reasonably permitted by their capabilities,
training, experience and equipment as determined by the Chief Lifeguard
of CITY in an Orange County underwater rescue team coordinated and
called into duty by the Director of Harbors, Beaches and Parks.
IN WITNESS M"EREOF, COUNTY has caused this Agreement to be
executed by the Chairman of its Board of Supervisors, and attested by
its Cleric, and CITY has caused this Agreement to be executed by its
N_nyor, and attested by its Clerk, all thereunto duly au*_ho-rized on the
